HOUSE RULES The South Carolina Yacht Club is intended for use only by Members, Dependents and Guests. The Club is normally open each day of the year for service except Mondays and Tuesdays from 7am to 10 pm and Sunday from 11 am until 8 pm. These hours may be changed as deemed appropriate and indicated by Member usage and determined by Management. The Club office is open Monday through Friday (except holidays) from 9 am to 5 pm. Other Club facilities open and close at different times, and reference should be made to specific sections of these House Rules for information concerning specific facilities. Adjustments will be made for those occasions when a holiday falls on a Monday and the House Committee determines that the Club should open for such holidays. ARTICLE I - GENERAL RULES Section 1. Members will sign for purchases using their name and membership number. Dependents and Guests will sign for their purchases using the name and number of their sponsoring Member. Cash will not normally be accepted by the Club except for payment of monthly accounts. Bills are rendered monthly and payment is due upon receipt. Section 2: Members, Dependents, and Guests will at all times conduct themselves as ladies and gentlemen. When, in the opinion of the House Committee, a Member or a person for whose conduct a Member is responsible conducts himself inappropriately, the House Committee may invoke such discipline as it deems sufficient, including without limitation the suspension of such Member’s privilege of using the Club. Serious or repeated violations may be referred by the House Committee to the Board of Governors for additional discipline. Section 3: The Club is not responsible for personal injury, damage or loss to Members, Dependents, or Guests or to their property (including boats and gear thereon). Members, by their acceptance of the privilege of Membership and of use of the Club, for themselves, Dependents and Guests, release and discharge the Club for any such liability, damage and responsibility. Section 4: No reprimand will be expressed to a Club employee by any Member, Dependent or Guest. Any complaint will be made to the Manager or to the House Committee. Section 5: No gift or gratuity will be given to any employee of the Club unless expressly authorized by the House Committee. Section 6: The Club maintains a bulletin Board in the Bluefish Lounge. The Bulletin Board is intended to provide information of common interest to Members. Notices expressly approved by the Manager may be displayed by Members. Section 7: The Club maintains marked spaces for the parking of vehicles. Vehicles will only be parked in such marked spaces and will not be parked on the grounds of the Club, on driveways or walks within the bounds of the Club, or on roadways adjacent to the Club, such as may obstruct entrances and exits to Club facilities or to parking lots. Parking on the Clubhouse lot for boating purposes is prohibited. An improperly parked vehicle may be moved by the Club at the expense of the owner. Section 8: The use of the Clubhouse for commercial enterprises or for the solicitation of business by any Member shall be restricted to cases where those attending the meeting are established customers, clients or business associates of the Member or, if unknown to the Member, are invited personally by the Member and not by means of print or broadcast media or by written or telephonic communication to any type of list of potential customers. Section 9: A cancellation fee equal to the full amount of the Special Event Charge times the reservation number will be charged on all Special Events in which the Member fails to notify the Club 48 hours in advance of the

cancellation of the event. Certain events may require additional notification time and will be announced on a case by case basis. The Management will print reminders in all promotional material alerting the Membership to this policy. Policy applies only to Special Events.

ARTICLE II - DEPENDENTS Section 1: A Dependent is a person who is a child of a Member whose domicile is with the Member and who is under the age of 25 years. Section 2: Children under twelve are not permitted on Club premises unless a Member is present with supervising them at the facility they are using, unless they are participating in an organized Club activity at which supervision is expressly provided by the Club. Section 3: A Member may authorize his or her dependents to purchase goods and services from the Club, and such authorization is presumes. If notice in writing to the contrary is furbished to the Club Manager, the Club will endeavor to prohibit charges by such dependents, the Member will nevertheless continue to be responsible. Management of the Club may refuse to serve food or beverages to a dependent child if such child upon request does not present an identification card. Section 4: A Member is responsible for the conduct of his or her dependents and the consequences thereof. A Member is also responsible for all purchases by his or her dependents.

ARTICLE III - GUESTS Section 1: Guests may use the facilities of the Club only as provided in this section. A Sponsoring Member of a Guest is the Member who invites or whose Dependent invites a Guest to use the Club. The Sponsoring Member of a Guest is responsible for the conduct and charges of the Guest. A Member, in sponsoring a Guest, shall consider that the facilities of the Club are for social use of the Members and that any Guest should be socially acceptable to the membership of the Club generally. Guest privileges may be revoked at any time by the Manager or the House Committee. Section 2: Guests are those persons invited by the Members or their Dependents to use the Club facilities as follows. A. Clubhouse: A Guest residing within Beaufort County may use the Clubhouse only in the presence of the Member or Dependent by whom he is invited. This benefit is restricted to four (4) social visits per calendar year per resident of Beaufort County. A Guest who resides outside Beaufort County may use the Clubhouse facilities upon presentation of a Guest card. Normally a Guest card will be issued by the Club to a Guest residing outside Beaufort County for periods up to two weeks upon the request of a Sponsoring Member. B. Swimming Pool: A Member or a Dependent may invite guests to use the pool facilities with such Member or Dependent. A Guest who resides outside Beaufort County may also use the Swimming Pool upon presentation of a Guest Card. Normally a Guest card will be issued by the Club to a Guest residing outside Beaufort County for periods up to two weeks upon the request of a Sponsoring Member. C. Tennis Facilities: A Guest residing within Beaufort County may use the tennis facilities with the Member or Dependent by whom the Guest is invited. Guests who reside outside Beaufort County may use the tennis facilities upon presentation of a Guest card. All Guests will register prior to commencement of play on the registration list provided by the Club. The Sponsoring Member will pay such charges as are established by the House Committee for the use of the tennis facilities by Guests.

D. Yachting Activities: Non-members residing within the Beaufort County area may not participate in the Club’s yachting activities except as the Guest of a Member or Dependent or as a participant in yachting events approved by the Yachting Committee. Non-members residing outside the Beaufort County area may participate in the yachting activities with a Member or his Dependent, or may be issued a Guest Card by the Club for periods up to two weeks upon the request of a Sponsoring Member. All Guests who participate in the yachting activities must pay the charges imposed by the Club for such use. E. Club Groups: Official Club Groups (Bridge, Book Club, Salty Sisters, Briny Brothers, Cruise Fleet, and any others as determined by Club Management) are for the enjoyment of SCYC members only. Section 3: Club Management, with the support of the Executive Board and Membership Committee, maintains the right to deny usage to any Club guest should it be determined that his or her guest usage becomes excessive. Generally, excessive use is considered to be more than four (4) visits in one calendar year.

ARTICLE IV - CLUBHOUSE Section 1: The Clubhouse will normally be open Wednesday through Saturday from 7 a.m. to 10 p.m. and Sunday from 11:30 a.m. to 5 p.m. However, the Manager or his representative may determine that the Clubhouse is not being used by a reasonable number of persons so as to justify remaining open. Upon such determination, the Manager or his representative may close the Clubhouse. Section 2: Coats are standard attire for gentlemen in the Catesby Room after 5:30 pm, except on special occasions. Casual attire is permitted at all times in all areas of the Clubhouse with the exception of the Catesby Room. Refined Denim is permitted in the Clubhouse in all areas except for in the Catesby Room. Shirts and Shoes are required at all times. Men shall not wear hats or caps in the Clubhouse except on special occasions when the wearing of such is appropriate. Items such as Bathing Suits and Flip-Flops are not permitted anywhere within the Clubhouse. Dependents and Guests should dress accordingly. Section 3: Clubhouse facilities are available for use in common by Members, their Dependents and Guests. Table reservations are encouraged in the Catesby Dining Room. Clubhouse facilities may be reserved by Members for private activities within guidelines used by the Club Manager in the operation of the Club. An appropriate guarantee may be required. Section 4: Smoking is not allowed at any time in the Clubhouse. A designated smoking area is located on the Catesby side of the deck.

ARTICLE V - FOOD & BEVERAGE SERVICE Section 1: No food and beverages will be consumed on the premises of the Club except for food and beverages served by the Club. The service of alcoholic beverages by the Club is subject to all limitations and regulations imposed by law. Section 2: The Club may refuse to serve food and beverages to any person whose conduct or condition is not proper in the judgment of the Manager or representative. Section 3: No individual will be allowed to supply their own food and/or beverage for the purposes of hosting a private gathering at the Club (to include the Sports Center and pool area). All food and beverages for such functions held at or in conjunction with the Club must be purchased from the Club. Section 4: Bar service is available in the Bluefish Grill from 11:30 a.m. until closing.

Section 5: Dinner is served in the Catesby Dining Room Tuesday through Saturday from 5:30 p.m. to 9 p.m. Continuous food service is available in the Bluefish Grill from 11:30 a.m. to 9 p.m. Wednesday through Saturday and until 8 p.m. on Sunday. Section 6: Full Menu take-out food service is available Wednesday through Saturday from 11:30 a.m. to closing.

ARTICLE VI - BOATING FACILITES Section 1: Upon prior approval by the Manager, Members may moor or store their boats in designated spaces without charge for up to two consecutive nights. Thereafter, a charge for such space and utilities will be paid by the Member in accordance with the schedule of charges established by the House Committee. The maximum time of temporary mooring or storage by any Member will be five days per calendar month. Any boat remaining beyond the permitted period may be removed by the House Committee. Section 2: The House Committee may grant to transient boats from outside the Beaufort County area the privilege of mooring at the Club’s docks for up to two consecutive nights. A transient is a Guest of the Club but the privilege may be revoked by the Manager or the House Committee at any time. Section 3: The owner of a boat moored or stored at the Club is responsible for it at all times. All boats must adhere to the Windmill Harbour Marina Rules and Regulations. If in the judgment of the House Committee or the Windmill Harbour Marina Association a boat owner is abusing his privilege of using the Club’s boating facilities, he may be charged accordingly and such use may be terminated. Section 4: The Rules of the Road apply to all vessels in or approaching the Club’s boating facilities. All vessels will be properly secured to a dock, and docks will not be modified or defaced. Utilities will be connected to a boat properly and with proper connectors. Section 5: Recreational swimming is not permitted in the Harbour.

ARTICLE VII - TENNIS FACILITIES Section 1: The Club’s tennis facilities are normally open to Members, their Dependents, Guests, and Guests of the Club, Monday through Sunday, from 8 am. until dusk. The courts are closed whenever the nets are lowered. Section 2: Proper tennis etiquette and sportsmanlike conduct will be observed at all times. Excessive noise, racquet throwing and profanity will not be permitted. Section 3: All players, including guests, must be registered on the registration sheet in the Pro Shop prior to the commencement of play. At the time of registration, the member who made the reservation shall be responsible for court fees if guests have not paid the applicable guest fees. Any uncollected fees will be then charged to the signing member’s account. Fees are to be set by the Sports Committee. Section 4: Reservations may be made at the Pro Shop in person or by telephone (843-681-3100). NO STANDING RESERVATIONS WILL BE ACCEPTED. A reservation is forfeited if a court is not claimed by the reserving person within ten minutes after the starting time of the play period reserved. Thereafter, it may be used by persons in the order of their appearance on the standby sheet maintained at the Pro Shop. If there are no standbys for that time, the court may be claimed on a first come first serve basis. The Club may charge a court fee for use of the tennis facilities by guests, as may be determined from time to time.

Section 5: The Pro Shop is operated by the Club, which determines the selection, quality and price of merchandise in the Pro Shop. Purchases may be made by charging items to a Member Account. Cash sales are permitted. Complaints and adjustments will be handled by Sports Center Staff and if need be will be ultimately resolved by the Manager of the Club. Section 6: The rules of the U.S.T.A. shall apply at all times, except when they conflict with the local rules or with and of the rules herein. Section 7: Club members may reserve a court up to seven days in advance. Only two court times per week will be permitted by a Member on a reservation basis. The group captain must give his or her name and membership number and the names in his or her group. Abuse of reserved courts not being used will be addressed by the Sports Committee, which could result in suspension of members’ reservation privileges. Each court reserved must have one member present for play to which that member is responsible for applicable guest fees. Section 8: At the end of their reserved playing period, players must promptly relinquish their court to the next players. Once a Member is off the court, the Member may sign up for the next available court time. Section 9: Singles and doubles may each play on a court for a period of two hours. Doubles will be encouraged during peak periods of play to eliminate wait time. Section 10: Proper tennis attire as determined by the Tennis Professional is required at all times. Colors are permitted, but cut-offs, Bermuda shorts, jams, bathing suits, gym shorts, tee-shirts, slacks, and running shorts are not permitted. Regulation tennis shoes are required. Section 11: Use of the tennis courts and facilities at the Club shall at all times be subject to the control of the Tennis Professional. The Tennis Professional shall determine the suitability of the tennis courts for play. Courts will be closed when necessary for maintenance operations or when dictated by safety considerations or by reason of adverse weather conditions as determined by the Tennis professional in his or her sole discretion. Section 12: The Tennis Professional is authorized to implement temporary rules as may be necessary during peak periods of play and tournaments, including without limitation: a. Two courts may be reserved for tennis instruction at all times. b. Players may secure only one reservation time per day and cannot make additional reservations for Members of their family or friends. Only if a court is available may players play a second time on the same day. Section 13: Children under the age of thirteen are not allowed on the courts without adult supervision. Section 14: Running, ball playing, skate boarding and noisy or hazardous activity will not be permitted within the facilities of the Sports Center.

ARTICLE VIII - SWIMMING FACILITES Section 1: The swimming pools are normally open from Monday through Sunday from dawn to dusk, weather permitting. Section 2: Children under 13 years of age must be accompanied at all times by a Member or Dependent not less than 18 years of age while using the swimming facilities. This policy is in place even if there is a lifeguard present. Section 3: Persons using the swimming facilities will comply with the Swimming rules posted.

Section 4: All persons using the swimming facilities must be registered on the registration sheet maintained at the Pro Shop or the Pool area. At the time of registration the Member will sign a chit for any charges as established by the House Committee for the use of the swimming pools and related facilities. Section 5: Use of the pool facilities at the Club at any time is at the swimmer’s own risk. Section 6: Swimming is permitted only during open hours of the pool. Section 7: Showers are required prior to entering the pool. Section 8: Food, drinks, glass objects, drinking glasses and sharp objects are not permitted in the pool. Section 9: All swimmers must wear bona fide swimming attire. Cut-offs, dungarees and Bermuda shorts are not considered appropriate attire. Section 10: Children must be three years of age and potty trained to be permitted in the main pool. Children in diapers are not permitted in the pool. Section 11: Rafts and floats of any kind are not permitted in the pool at any time. Section 12: Running, ball playing, skate boarding and noisy or hazardous activity will not be permitted in the pool area. Pushing, dunking and dangerous games are not permitted. Section 13: Snorkeling equipment, other than a mask, is not to be used in the pool area except as part of an organized course of instruction. Section 14: Out of consideration of others, radios and recorders must be listened to with earphones. Section 15: All persons using the pool furniture are required to cover the furniture with a towel when using suntan lotions. The use of these preparations stains and damages the furniture. Section 16: All persons using the pool area are urged to cooperate in keeping the area clean by properly disposing of towels, cans, etc. Section 17: Smoking is not allowed in the pool area. Section 18: Shirts are required when outside the pool area. Section 19: The pool staff has full authority to enforce these rules and regulations, and any infractions will be reported to Club Management.
