Petitioner is also doing social work and works as whistleblower also . The instant PIL is an outcome of the fact that the responsible respondents are violating the fundamental as well as human rights i.e. right to live safe & secured
life.
In
the
unsecured
circumstances & situation in the State, the grievance of the petitioner is that there is worst law & order condition in the State which is continuous dangerous to life and liberty to every citizen who is against the interest of some of
the
powerful persons in the State etc. The suspicious death of Justice Loya , Adv. Kahandalkar are the serious examples of situation. The future victims are also targeted.

After various news in newspaper, the factual position came before the public about the miserable condition of law & order in the State which shows the life of even Judge , Lawyer s or common citizens are not safe who is against the interest of powerful & influential person . Many cases occurred in the State shows the influence & pressure over the judicial officers,

Writ Petition Under Article 226 of Constitution of India The Petitioner named above most humbly and respectfully begs to submit as under; 1]
The Petitioner is a citizen of India and doing social work
in Nagpur City. Petitioner is also doing social work and works as whistleblower also. The respondent no.6 is Chief Minister of Maharashtra state & also having ministry of Home department with him.

The Petitioner being `the social worker duty
bound to take care of rights of common citizen about welfare, safety & security of every citizen in society. The petitioner also filed Public interest litigation related with the scam about sanitation & Civil work in Nagpur City controlled by Nagpur Municipal Corporation. On the basis of various past incidences the petitioner is aware about modus operandi of the
person who
having power & influence in the State ,
which may result into danger to life and liberty of the concern person/Citizen who are against them . 3]
In the unsecured circumstances & situation in
the State, the grievance of the petitioner is that there is worst law & order condition in the State which is continuous danger to the life and liberty to every citizen who is against the interest of some of the powerful & influential persons in the State etc.

There are the various serious incidences in the State occurred during the current tenor of respondent no. 6 as a Chief Minister of the State of Maharashtra some are more serious, which are: (i) In the December 2014 at Nagpur in the jurisdiction of P.S. Sadar ( Ravi Bhavan )Nagpur there is suspicious death of the C.B.I. Judge Brijgopal Harkishan Loya, the special CBI judge presiding over the trial of
BJP president Amit Shah and
several top Gujarat police officers for the encounter killing of Sohrabuddin Sheikh and his wife Kauser Bi.
(ii) In the jurisdiction of P.S. Sadar Nagpur, there is suspicious death of Adv. Shrikant Khandalkar on 29th Nov. 2015 who was arguing various PIL’s about various Scams in the State, who also had proofs against the powerful & influential persons including allotment of U.L.C land Scam (Civil W.P.No.55/2004 before Bombay High Court Nagpur Bench).
(iii) There is Fake Stamp Paper Scam in Nagpur, proofs of which disappeared in the P.S. Sadar & J.M.F.C. Court No.6 Nagpur in the jurisdiction of P.S. Sadar , in which many of the nearest & dearest of respondent no.6 are involved .
(iv) There is double murder case in the area of P.S. Sonegaon Nagpur & allegation were against the police officers , persons who are nearest and dearest of respondent no.6 -the persons who are involved in Fake Stamp paper Scam.

(v) There is criminal conspiracy against future victim Adv. Satish Uke who has filed various petitions and criminal cases against respondent no.6 as well as against nearest & dearest of respondent no.6. The entire machinery of respondent no.6 i.e. Dept. of Law & Judiciary as well Home Dept. are working in these matters .

A.P. Shah on 23.11.2017 the senior member of the judiciary spoke out about the allegations of foul play in the December 2014 death of Brijgopal Harkishan Loya, the special CBI judge presiding over the trial of BJP president Amit Shah and several top Gujarat police officers for the encounter killing of Sohrabuddin Sheikh and his wife Kauser Bi. The said incidence of death occurred / started at Ravi Bhavan Nagpur within the jurisdiction of respondent no.3. Apart from referring to the grievances of Loya’s family members regarding the suspicious circumstances of his death, Justice A.P. Shah also expressed concerns regarding allegations of corruption as the late CBI judge was allegedly offered a bribe of Rs 100 crore for a “favourable” judgment in the weeks and months running up to his sudden demise.

stressed the
need
to
maintain
the
confidence of the people in the integrity of the judiciary. Calling Loya an honest and upright judge, he added, “Not enquiring into the allegations made by the family would send a very wrong signal to the judiciary, particularly the lower cadre.” He further added that, “In such cases where prima facie material is available to investigate, it is ‘absolutely necessary’ to order an enquiry…. The judiciary is the tallest institution of the country and people have tremendous faith in it. Any misgivings of the family of a member of a judiciary should be addressed.”

All the above news items creates suspicion of there is
conspiracy which resulted into death of Justice Loya & in the background stated in the news item. News items dated 20, 22 & 23rd Nov. 2017 collectively annexed herewith & marked as Annexure –A .

When the said incidence of Justice Loya occurred in
Nov-Dec.2014, till today no inquiry or investigation is conducted in this issue. In the same period of year 2014 the petitioner came to know the whisper about the said incidence from Adv. Khandalkar & one retired Judge Shri Prakash Thombre who were with Adv. Satish Uke,
but it is strange
that the respondents No.1 to 3 & 5 don’t know anything about same & did not reacted on the said incidence .This shows the influence & pressure,
the incidence was not
disclosed & investigation was not set in motion . from circumstances anyone can guess who can be beneficiary of such incidence & investigation is needed in that direction.
7] Later on , in Nov. –Dec 2015,
the petitioner is also got
shocked because of the incidence occurred in the jurisdiction of respondent no.3 about the suspicious death of Adv. Shrikant Khandalkar . Adv. Khandalkar exposed various Scams of the high handed, powerful persons & influential’s .
8] It is well known to many people that Adv. Khandalkar supplied important information to Adv. Satish Uke about some persons including Advocates who managed the issues in serious scam , cases, which also includes the land scam of various U.L.C. land allotment in Nagpur district . On the basis said information Adv. Uke filed various petitions. When it was seen on the T.V. Chanels that Adv. Uke gave his reactions

Khandalkar, at that time the petitioner asked the Adv. Uke about incidence occurred with Adv. Khandalkar , Adv. Uke gave shocking information by showing proofs which were unbelievable, which were supplied by Adv. Khandalkar to Adv. Uke . Adv. Uke also gave information about the threats received by Adv. Khandalkar prior to causing the said incidence with him . No proper investigation is not took place by the State Police under influence & pressure .
9] After some month , in Feb 2017 petitioner asked Adv. Uke what happened about Adv. Khandalkar’s
matter then he
replied that Bombay High Court Nagpur bench directed him not to file applications, complaints or proceedings against or in name - reference of any Advocates , Judges or other persons as well as not to post anything on social media or not to speak with media . Adv. Uke told that So, he is not in position to do anything in this regard otherwise also Court directed him not to deal with any immoveable properties owned by him , if he does anything then he will suffer the loss to his life as well as properties . Adv. Uke also told that the responsibles are so high handed & powerful persons, that they can do anything as they did with Justice Loya , Adv. Khandalkar. Adv. Uke told that now he is not in position to speak about it because of restraining orders of the Bombay High court. So, practically there is no way to surface the truth. 10] That, the restraining orders passed against Adv. Uke, such orders are in the matter of issue related with respondent no.6. The restraining orders are particularly restrain about speech and expression and not to deal with properties. The restraining order passed in Criminal Contempt petition No.7/2016 dated 8.02.2017 is as follows, “It is further directed that Satish Mahadeorao Uke shall not deal with the properties referred in his

of this Court.” The other orders in the said matter are includes rejection of applications without reading it. The lady Public Prosecutor Smt. Ketaki Joshi who assisted the Hon’ble High Court in Criminal Contempt petition No.7/2016 against Adv. Uke is the wife of Advocate S.S. Joshi
who represented the party related with land in
ULC Scam (order dated 06.11.2009 in CAF NO.688/2009 in First Appeal No. 112/2001 passed By Hon’ble High Court Nagpur & Order of Addl. Collector, ULC Nagpur dated 16.05.2008 shows name of Adv. S.S. Joshi). The said scam is a related matter with contempt matter against Adv. Uke & scam matter in which Adv. Khandalkar was involved as Advocate who died in suspicious way, in same matter Adv. Uke had also filed intervention application to place evidences of scam on the court’s record. Many of the nearest & dearest of respondent no.6 is named in this ULC matter.

11] There are allegations made by Adv. Uke about Fake Stamp Paper scam of corers of rupees against nearest & dearest of the respondent no.6. According to Uke the evidences are made disappeared by the interested one from Police Station Sadar Nagpur & J.M.F.C. Court No.6 Nagpur . Whatever may be the paper which is of record that should be required to be on record. In this matter, which shows circumstances, influence and pressure under which the said incidence is occurred. Order of the J.M.F.C. Court dated 5.06.2015 is annexed in his regard is annexed herewith as Annexure –C.

Like pressure & influence over Justice Loya to give
favorable order in favor of influential person , there is also allegation from Adv. Uke that Sessions Court Nagpur’s order in
the
matter
changed/manipulated
against
respondent
no.6
is
under pressure & influence . The
order passed by Hon’ble High Court in this issue shows happening of such incidence . Copy of the order dated 18.02.2015 passed by Hon’ble High Court in the Criminal Writ Petition No. 110 of 2015 challenging the said change is annexed herewith as Annexure-D .
13] That, the Crime No.
239/2014 dated 14.11.2014
registered at P.S. Sonegaon Nagpur U/s 302,201 of I.P.C. This is double murder case as per the allegation made by Adv.

Uke against respondent no.6 & his nearest and dearest one . As per allegations the police authority destroyed the evidences of first dead body of young girl & shown another dead body of man to twist the case i.e. under pressure & influence. Police did not registered statement of Adv. Uke nor respondent no.6 or concerns & filed “A-final Summery” No 36/2016 dated 10.03.2016 in the JMFC Court No. 8 Nagpur, wherein various documents firmly shows that there is substance in the allegation made by Adv. 14] The remarkable time consumed in the Hon’ble High Courts in the matter of respondent no.6 Devendra Fadnavis, The Chargesheet against Devendra Fadnavis about offence of rioting
etc.

to
be
compromised
&
quashed
as
compounded without placing charge sheet on the record of Hon’ble High Court in APL No. 824/2014. In overall, the petitioner is not using any word even by wrong meaning or with any intention against the judiciary or judicial officers or Judges or Courts or lawyers or anyone working in court, but this petition is filed in their fovor , interest & to protect their rights & life. 15] The situation & circumstances in the background of above cases clearly shows that the after Justice Loya & Adv. Khandalkar , there are some future victim, out of them

future victim would be of similar incidence or criminal conspiracy is Adv. Satish Uke . Adv Uke will be victim to make it end of all the evidences which Adv. Uke have. Adv. Uke or any one others like him would be not safe in society , in police protection or even in jail because all the machinery is in the hand of influencial persons like respondent no.6 or his related person. Anyone i.e. Judges, police officer or any citizen like the petitioner may be future victim of such situation. That in such circumstances investigation is needed in all above cases by the hands of the police machinery of some different State where same ruling party of Maharashtra State should not be ruling party there . Even C.B.I. who is under control of Central Govt. where ruling party in Central Govt. is same of Maharashtra State.
16] The cause is so immediate & serious that the petitioner has no other efficacious remedy except to approach this Hon’ble court by way of this public interest litigation and the petition under Article 226 of the Constitution of India.

The petitioner craves leave to amend the instant
petition, withdraw the same & to file fresh one . The petitioner is no way benefitted out of this petition & no personal interest is involved in this petition. 18] The petitioner did not filed similar petition before the Hon’ble High court or before the apex Court of India
