Fish and Wildlife Service Notice of Availability of an Environmental Assessment/Habitat Conservation Plan and Receipt of Application for Incidental Take of Golden-Cheeked Warbler

The Applicant, White Water Springs, L.L.C., has applied to the U.S. Fish and Wildlife Service (Service) for an incidental take permit pursuant to section 10(a) of the Endangered Species Act (Act). The Applicant has been assigned permit number TE–110131–0. The requested permit, which is for a period of 30 years, would authorize incidental take of the endangered golden-cheeked warbler (Dendroica chrysoparia). The proposed take would occur as a result of the construction and operation of a residential development on 1,758-acres (717 hectares) of the White Water Springs property, Burnet County, Texas. The Service has prepared the Environmental Assessment/Habitat Conservation Plan (EA/HCP) for the incidental take application. A determination of jeopardy or non-jeopardy to the species and a decision pursuant to the National Environmental Policy Act (NEPA) will not be made until at least 60 days from the date of publication of this notice. This notice is provided pursuant to Section 10(c) of the Act and National Environmental Policy Act regulations (40 CFR 1506.6). Section 9 of the Act prohibits the ‘‘taking’’ of endangered species such as the goldencheeked warbler. However, the Service, under limited circumstances, may issue permits to take endangered wildlife species incidental to, and not the purpose of, otherwise lawful activities. Regulations governing permits for endangered species are at 50 CFR 17.22. Applicant: White Water Springs, L.L.C., plans to construct a residential development on 1,758-acres of the White Water Springs property, Burnet County, Texas. This action would adversely affect 369.1 acres (148.8 hectares) of oak-juniper woodland resulting in take of the golden-cheeked warbler. The Applicant proposes to compensate for this incidental take of the golden-cheeked warbler by contributing $300,000 to a conservation entity for use in the purchase and preservation of golden-cheeked warbler habitat within the acquisition area of the Balcones Canyonlands National Wildlife Refuge and by preserving 20.7 acres (8.3 hectares) of habitat on-site which will be managed in perpetuity for the benefit of the golden-cheeked warbler.

      September 26, 2010    Mr. Clayton Napier  US Fish & Wildlife Service Field Office  10711 Burnet Road, Suite 200  Austin, Texas 78758    Re:  Permit #TE‐110131‐0    Whitewater Springs (Preserve at Balcones Canyonlands) – Bertram, Texas    Dear Mr. Napier:    Land  Strategies,  Inc.  (LSI)  took  over  project  management  of  the  Whitewater  Springs  subdivision  (aka,  Preserve at Balcones Canyonlands) in June 2010.  On behalf of the landowner (Montvale), respectfully  submit the following information to update you on the progress we have made in 2010 with respect to  the  Whitewater  Springs  subdivision,  located  in  Burnet  County,  south  of  Bertram,  Texas.    This  letter  is  meant to serve as the required annual written report for the subdivision.    In  Section  2  of  the  subdivision,  barricades  were  installed  at  the  entrances  to  Canyon  Ridge  Court  and  Suncrest Trail, to bar any access to these cul‐de‐sacs, as these roadways (as approved by Burnet County)  have steep grades with no protection at the terminus of the cul‐de‐sacs at the steep drop‐offs.  Those  barricades will remain at the entrances to these cul‐de‐sacs until further improvements are made to the  roadways, as may be necessary, in order to address erosion and safety concerns.    We  are  currently  negotiating  a  contract  with  the  Lower  Colorado  River  Authority  (LCRA)  regarding  a  public versus private water supply system for the subdivision.  It is anticipated that the LCRA Board of  Directors  will  review  the  elements  of  the  proposed  contract  and  vote  to  approve  (or  approve  with  amendments or comments) at their November 2010 board meeting.  We have made good progress with  LCRA in this respect, and anticipate approval of the contract in November.  In conjunction with this LCRA  contract,  we  are  working  with  a  water  engineer  and  surveyor  to  locate  various  test  water  well  sites  through  Sections  2  and  5  of  the  subdivision.    We  have  met  with  the  Central  Texas  Groundwater  Conservation  District  and  Burnet  County  to  determine  any  and  all  regulatory  issues  associated  with  drilling  test  water  wells,  including  processes,  timing,  and  required  permits,  if  any.    We  will  continue  forward to drill these test water wells, to ensure there is adequate water capacity for the Montvale lots  within the subdivision.    We are also working in conjunction with Montvale’s attorney to amend the Declaration of Covenants,  Conditions and Restrictions (CCRs) of  Whitewater  Springs Subdivision (Section 1, 2, 3, 4, and 5); these  amendments  are  being  coordinated  with  the  Whitewater  Springs  Property  Owners  Association  (POA),  and we are making good progress in this regard.  The amendments are in response to various changes  desired  by  the  POA  to  the  existing  CCRs,  and  will  also  include  information  based  on  our  negotiations  with LCRA regarding water service for the subdivision.   

In order to stop the spread of oak wilt throughout the subdivision, at the end of September 2010, two  (2) trenches were dug along Murphy Drive – one trench was dug along Lots 609‐611, and one trench was  dug around Lots 620 and 621.    We continue to move forward with future development of lots, as per the approved subdivision plats.   As stated above, we are also continuing our coordination with LCRA regarding water issues, and are in  regular communication with the POA with respect to various issues throughout the overall subdivision.   Additionally, we are aware of the bird habitat and nesting schedule (from April to August), and continue  to comply with limitations on development and construction during that time.    Please feel free to contact me should you have any questions or require additional information.    Best regards,        Paul W. Linehan, ASLA  President    PWL:enw    cc:  Albuquerque Office (PO Box 1306, Room 4102, Albuquerque, NM 87103)  cc:  Robert Teeter – Madison Realty Investors
