ARTICLE 1- NAME The association will be called Tanzania Muslim Students And Youth Association and in this constitution will be knows as (TAMSYA).

ARTICLE 3. EMBLEM Large circle with the map of Tanzania in it is an open book with a pen together with words that reads in Arabic “IKRAA” and the words around the circle that reads Tanzania Muslim students and youth Association (TAMSYA).

CALL “Let there arise out of you a band of people inviting to all that is good, enjoining what is right, and forbidding what is wrong: they are the one to attain felicity” (Qur’an 3:104).

ARTICLE 5 ORIGIN TAMSYA will be the independent national organization of students and Muslim Youth in the country".

6.

ARTICLE 6. AIM AND OBEJCTIVES.

6.1

AIM i.

To propagate and to enhance the delivery a correct knowledge of Islam so as to glorify the word of Allah. ii.To merge students and youth in the struggle against poverty, ignorance, diseases and moral destructions.

6.2

OBJECTIVES i. To increase awareness to the Muslim community. ii.

To help students and Youth create Islamic moral behaviors through moral, ideological and social teachings.

iii.

To aggravate Islamic brotherhood and cooperation with other organizations with such aims and goals.

iv.

To merge students and youths in the struggle against calamities facing the society.

v.

To represent Tanzania Muslim students and Youths in the national and international matters.

vi.

To cooperate with other social, government, religious, national and international organization so as to bring about social and national development.

vii.

To supervise, defend and speak up for the right of Muslim students and Youths in Tanzania.

viii.

To operate and supervise development projects for social services and to own movable and immovable properties.

ix.

7.

To volunteer in performing other activities with benefit for Muslim students and Youths as well as the society at large.

ARTICLE 7. METHOD AND STRATEGIES.

7.1

The method to be adopted by the organization should concur to the Qur’an and Sunnah of the prophet {s.a.w}.

7.2

The organization will do its daily activities through its members for services and projects.

8. 8.1

ARTICLE 8 MEMBERSHIP TAMSVA MEMBERSHIP WILL BE OF TWO TYPES. 8.1.1 Membership by originality. 8.1.2

(i)

Membership by dignity.

8.1.1. MEMBERSHIP BY ORIGINALITY This will be open for all Muslim students in schools, Colleges, madrasas, universities and other education institutions and Muslim Youths by applying, being accepted and paying the membership fee. Youth membership will be for individuals and youth institutions or their associations. Youths will join TAMSYA directly from district level but not from their branches.

8.1.2. HONORARY MEMBERSHIP. Honorary Membership will be open for any Muslim without considering his/her age or sex, who will be proposed by TAMSYA district, regional or national level and authorized by TAMSYA national executive committee and they will be appointed according to their importance in the society for the aim of defending TAMSYA interests. 8.1.3. RIGHTS OF MEMBERSHIP BY ORIGINALITY. (i) To participate in all legitimate meetings relate to him/her.

To participate in daily organization activities with accordance to the rules and regulation.

(iii)

To propose or/and elect organization leaders.

(iv)

To be proposed or/and elected a leader of the organization

(v)

To participate in organization committee regarding the rules and regulations.

(vi)

To question or/and criticize (where necessary) operation of the organization for the sake of organization and Islam.

(vii)

To cooperate with other leaders together with other members in making decisions where necessary.

ARTICLE 9. ORGANS OF TAMSYA BOARD OF TRUSTEES. i.

There will be a board of trustees which should be known in this constitution as “BOARD” which will be appointed by the TAMSYA national executive committee by making consultation with TAMSYA national secretariat and will operate for only two years.

ii.

Board will be made up of seven members, five among them will be approved by general assembly; general secretary and the executive secretary will enter for the position they held.

iii.

Board will set the organization policies, supervise its activities and put up much effort to accomplish the objectives of TAMSYA.

iv.

Board is the chief supervisor of trusts and properties of TAMSYA.

v.

Board will represent the organization in all legal matters and treaties.

vi.

Board will have the power to barrow and land properties on behalf of the organization (TAMSYA).

vii.

In its first meeting, board will elect one of its members among those approved by the general assembly to be a chairperson.

viii.

Executive secretary will be the permanent secretary of the board.

In case of any vacancy created by any of the board embers for any reason, TAMSYA president in collaboration with executive committee will nominate another person to fill the gap by choosing the acceptable member with regard to his/her qualities, experience and knowledge.

x.

The quorum of the board of trustee will not be less than four (4) members and its resolution will be passed by not less than half of its members attended in the meeting.

xi.

All resolutions of the board will be in accordance to the Qur’an and Sunnah of the prophet (S.A.W).

BRANCHES OF TAMSYA Every school, college and/or membership association of TAMSYA will be the branch of TAMSYA.

ii.

The branches mentioned in 9.2.1 will make TAMSYA district level.

iii.

TAMSYA districts will make TAMSYA regional level.

iv.

TAMSYA regions will make TAMSYA national level. REPRESENTATION. i. (a)

BRANCH GENERAL ASSEMBLY. There will be TAMSYA branch general assembly which will be attended by:

(i)

Chairman of TAMSYA branch.

(ii)

Vice Chairman TAMSYA branch.

(iii)

Secretary of the branch.

(iv)

Vice secretary of branch.

(v)

Heads and secretary of the branches of TAMSYA committee.

(vi)

All students of a branch.

(vii)

Custodian of TAMSYA branch.

DUTIES OF BRANCH GENERAL ASSEMBLY. (i) To receive, discuss and pass previous minutes of the meeting. (ii)

To receive, discuss and pass development reports of TAMSYA branch.

To receive, discuss and pass income and expenditure reports of the branch.

(iv)

To discuss the matters of benefit to the branch and make proposals in branch executive committee and/or district.

(v)

To elect branch leaders.

BRANCH EXECUTIVE COMMITTEE. There will be the branch executive committee which will include: (i)

Chairperson of TAMSYA branch.

(ii)

Voice chairperson of TAMSYA branch.

(iii)

Secretary of TAMSYA branch.

(iv)

Vice secretary of TAMSYA branch.

(v)

Treasurer of TAMSYA branch.

(vi)

Heads, secretaries and committee members of TAMSYA departments of a particular branch.

DUTIE BRANCH FOXECUTIVE COMMITTEE (i) To implement the strategies/plans and TAMSYA branch activities.

(a)

(ii)

To present the general report of TAMSYA activities in the branch general assemble.

(iii)

To implement plans and resolutions of branch general assembly.

ii. DISTRICT GENERAL ASSEMBLY There will be district general assembly which will be attended by (i) District chairman of TAMSYA. (ii)

District vice chairman of TAMSYA.

(iii)

District Secretary of TAMSYA.

(iv)

District Vice secretary of TAMSYA

(v)

District executive secretary of TAMSYA.

(vi)

District treasurer of TAMSYA.

(vii)

District chairpersons and vice chairperson secretaries of TAMSYA Committee.

(viii) Heads and secretaries of departments or committees of TAMSYA district. (ix) (b)

Custodian of TAMSYA district.

DUTIES OF DISTRICT GENERAL ASSEMBLY (i) To receive, discuss and pass minutes of meetings. (ii)

To receive discuss and pass development reports of TAMSYA district.

(iii)

To elect the leaders of executive committee of TAMSYA district.

(iv)

To approve the custodian of TAMSYA district.

(v)

To elect three members to represent district in the general assembly of TAMSYA regional level

(c) EXCUTIVE COMMITTEE OF TAMSYA DISTRICT There will be the executive committee of TAMSYA district which includes:(i)

District chairman.

(ii)

District vice chairman.

(iii)

District secretary.

(iv)

District vice secretary.

(v) (vi)

District treasurer. Heads, secretaries and members of committee of or department of TAMSYA district.

(d)

DUTIES OF EXEDUTIVE COMMITTEE OF TAMSYA DISTRICT. The following are the duties of executive committee of TAMSYA district: (i)

To receive, discuss and pass the minutes of the previous meeting.

(ii)

It will be the organ concerned with daily activities of TAMSYA district.

(iii)

It will give out the report of TAMSYA district activities in the general assembly of TAMSYA region.

(iv)

It will receive plans resolution and strategies and/or directives of the district and regional general assemble.

iii.

REGIONAL GENERAL ASSEMBLY.

a) There will be a regional general assembly which will be attended by:(i)

TAMSYA regional chairman.

(ii)

TAMSYA regional vice chairman.

(iii)

TAMSYA regional secretary.

(iv)

TAMSYA regional executive secretary.

(v)

Chair persons and secretaries TAMSYA regional departments or committees.

(vi)

TAMSYA regional treasurer.

(vii)

Chairpersons Amirah and three members from the district.

(viii)

Custodian of TAMSYA district.

b) DUTIES OF REGIONAL GENERAL ASSEMLY. (i) To receive discuss and pass the minutes of previous general assembly of the region concerned. (ii)

To receive, discuss and pass the development reports of TAMSYA region.

(iii)

To approve the nomination of custodian of TAMSYA region.

(iv)

To elect leaders of TAMSYA regional executive committee of level.

(v)

To elect three members who will join chairman and Amirah to represent region in TAMSYA national general assembly.

c) EXECUTIVE COMMITTEE OF TAMSYA REGION. There will be the executive committee of TAMSYA region which includes: (i)

TAMSYA region chairman.

(ii)

TAMSYA regional vice chairman.

(iii)

TAMSYA regional secretary.

(iv)

TAMSYA regional vice secretary.

(v)

TAMSYA regional executive secretary.

(vi)

Heads, secretaries and members of the department or committee of TAMSYA region.

(d)

DUTIES OF EXECUTIVE COMMITTEE OF TAMSYA REGION. The following are the duties of executive Committee TAMSYA region. (i)

To receive, discuss and pass the minutes of the previous meeting.

(ii)

It will be the organ concerned with daily activities of TAMSYA at the region.

(iii)

To provide report of TAMSYA regional activities in the general assembly of the region.

(iv)

It will receive plane, resolutions and strategies and/or directives of regional and national general assembly for implementation.

9.3.4 (a)

NATIONAL GENERAL ASSEMBLY. There will be national general assembly of TAMSYA which includes: (i)

National president/Amir of TAMSYA.

(ii)

National vice president of TAMSYA.

(iii)

National secretary general.

(iv)

National vice secretary general.

(v)

National chairlady (Amira) of TAMSYA.

(vi)

National executive secretary of TAMSYA.

(vii)

All national executive committee.

(viii) Five members from every region. (ix)

(b)

Other members from different levels of TAMSYA who will be approved by national executive committee of according to their status and their importance in the general assembly.

DUTIES OF NATIONAL GENERAL ASSEMBLY. National general assembly of TAMSYA will have the following duties:(i)

To receive, discuss and pass the minutes of previous general assembly.

(ii)

To receive and discuss the development report and make general evaluation of TAMSYA activities for the previous year.

(iii)

To set action plan and strategies for the following year.

(iv)

To elect leaders and members of TAMSYA national.

(v)

To approve the members of national secretariat where necessary.

(vi)

To approve the board of trustee members.

(vii)

To receive, discuss and approve proposals or/and amendment of a constitution.

9.4

TAMSYA DEPARTMENTS. There will be four major committee/departments which are: Department of Education and Vocational Training, department of finance economy and planning; department of women affairs and the department of information, relation and social welfare.

9.4.1 DEPARTMENT OF EDUCATION AND VOCATIONAL TRAINING. (a)

There will be education and vocational training committee which will have the following members: (i)

Chairman of the department.

(ii)

Secretary of the department.

(iii)

And three members nominated by executive committee.

(b)

DUTIES AND RESPONSIBILITIES OF DEPARTMENT OF EDUCATION AND VOCATION TRAINING. The department of Education and vocation training following duties and responsibilities.

9.4.2

will have the

(i)

It will be the permanent department concerned with all educational matters.

(ii)

To implement and work upon decisions and directives of the executive committee concerning education.

(iii)

To plan, coordinate and implement plans or activities which enable Muslim students and youths strengthen their beliefs and knowledge.

DEPARTMENT OF FINANCE, ECONOMY AND PLANS. a. There will be the department of finance, economy and plans of TAMSYA which will have the following members: (i)

Department chairman.

(ii)

Department treasure.

(iii)

Three members nominated by executive committee.

(c)

DUTIES AND RESPONSIBILITIES OF DEPARTMENT OF FINANCE, ECONOMY ANDPLANS. (i)

It will be the permanent department responsible for making plans and all matters pertaining finance.

(ii)

To collect membership fees as agreed by the executive committee.

(iii)

To collect gifts, alms and charities.

(iv)

To prepare, implement, supervise and coordinate plans and various projects of TAMSYA.

(v)

To work upon investments of financial projects and social services.

(vi)

To provide guidance and directives about supervision, expenditure and financial control of TAMSYA funds in all branches.

(vii)

And to implement other activities concerned with financial matters.

9.4.3 DEPARTMENT WELFARE.

a) There will be a department of information, relation and social welfare which will have the following members: i.

Department chairman.

ii.

Department secretary.

iii.

Three nominated members by the executive committee.

b. DUTIES AND RESPONSIBILITIES OF THE DEPARTMENT OF INFORMATION, RELATION AND SOCIAL RELATION. i.

It will be the permanent department which will be engaged in all matters concerning information relation and social relation.

ii.

It will be the department concern with information and propagation of TAMSYA.

iii.

To act upon decisions and engaged in directives of executive committee concerning relations and social relation.

iv.

To strengthen communication and relation with the government and other associations inside and outside them country.

v.

To keep and preserve all records concerning students and youths.

vi.

To supervise and coordinate all matters concerning technology, information and communication.

9.4.4 DEPARTMENT OF WOMEN. (a)

There will be a special section for women of TAMSYA which includes the following:i. Amirah of the department/section. ii. Vice Amira. iii. Secretary. iv. Vice secretary. v. Members nominated cording to the need.

9.4.5 SECRETARIATE (i)

There will be a national TAMSYA secretariat which will be made up of nine (9) members who have ever been TAMSYA leaders or leaders of any other respectable organization or any Muslim with whom by his/her character or skills or/and his/her profession or

/and his/her experience or/and his/her knowledge will be needed to accomplish the objectives of TAMSYA.

(ii)

Secretariat will be the strategic and advisory organ which will run its activities and meeting according to the formalities that they will set for themselves.

(iii)

The names of the members of the secretariat will be appointed by the executive committee and approved by general assembly.

(iv)

In their first meeting, members of the secretariat will elect a chairperson and a secretary among them.

DUTIES AND SECRETARIATE.

To supervise and give direction of implementation of TAMSYA policies by making or/and receiving strategic plans in order to attain TAMSYA objectives.

(ii)

To advise executive committee of TAMSY in it daily execution.

(iii)

To emphasize and motivate the implementation of action plan of TAMSYA.

(iv)

To prepare and supervise election of leaders in TAMSYA national general assembly.

(v)

To do whatever with benefit to TAMSYA without affecting general regulations of TAMSYA.

ARTICLE 10: RULES AND REGULATIONS. 10.1 (i)

MEETING RULES. General assembly of TAMYSA will be convoked by executive committee of a particular post.

(ii)

10.2 10.2.1

Any meeting of TAMSYA will be valid if it will be attended by numbers concerned to this constitution.

MEETING REGULATIONS.

TIME. (i) The normal TAMSYA general assembly will be held once per year.

10.2.2

(ii)

The emergency general assembly may be held at any time required for the condition that the number should reach one third (1/3) of all members.

(iii)

The meetings of the executive committee will be held after every two months or at anytime for emergence.

(iv)

Department meetings will be held after every two weeks or at anytime for emergence.

ATTENDANCE. Half (½) of the legitimate members of the meeting of TAMSYA will be valid; except where it is instructed otherwise in this constitution.

DECISION. (i)

Decisions in the meetings will be attained by means of agreement of the members or by majority votes.

(ii)

In case the number of voters becomes the same chairman will have a supplement vote.

(iii)

All decisions of the meetings must observe foundations of Qur an and sunnah.

ARTICLE 11. QUALITIES OF LEADERS, DURATION OF LEADERSHIP AND RELECTION RULES REGULATION.

11.1 QUALITIES OF LEADERS. TAMSYA leader in any post should have the following qualities. (i)

Should be a pious Muslim.

(ii)

Should be knowledgeable.

(iii)

Should have good characters.

(iv)

Should have good health.

11.2 (i)

DURATION OF LEADERSHIP. All elected leaders will remain in power for the period of two years and can be re-elected for another period of leadership.

(ii)

11.3

The appointed or employed leaders shall hold their position according to the rules and directives of their treaties. RULES OF ELECTIONS.

11.3.1

ELECTORAL COMMISSION.

There will be the electoral commission which will be appointed by the executive committee of the particular post and it will consist of not less than three (3) members, including the custodian of that post. (i)

The electoral commission will be for all posts ie. branches, districts and regions.

(ii)

In case of TAMSYA national level, secretariat of TAMSYA will be the electoral commission.

11.3.2

11.4

REGULATIONS OF ELECTION. (i)

The names of the contestants will be appointed by TAMSYA members who will participate in TAMSYA general assembly of that post with regard to ARTICLE (11.1) but the members should not appoint themselves.

(ii)

The electoral commission of the post concerned can propose a name(s) where necessary.

(iii)

All members will have the right to vote so as to elect TAMSYA leaders in a particular post.

(iv)

The electoral commission formed will be responsible in supervising the election.

REGIONAL ELECTION (i)

Every school, college etc will propose a name{s} of the contestants with regard to ATRICLE (11.1) and those names or contestants should be proposed but the contestants should not propose propose themselves.

(ii)

The electoral committee of a region may propose a name(s) where necessary.

(iii)

All Muslims representatives in the college/ school will vote for regional leaders.

(iv)

The electoral committee formed by regional secretariats will be responsible for supervising election.

12. ARTICLE 12: LEADERSHIP STRUCTURE. 12.1. THE FOLLOWING WILL BE THE LEADER OF TAMSYA. i.)

President (Amir) or Chairman.

ii.)

Vice President {Vice Amir}.

iii.)

Secretary General.

iv.)

Vice secretary general.

v.)

Executive secretary.

vi.)

Amirah.

vii.)

Vice Amirah.

viii.)

Heads of departments / Committee.

ix.)

Custodian.

12.2. DUTIES AND AUTHORITIES OF LEADERS. 12.2.1. TAMSYA PRESIDENT (CHAIRMAN). i.

He will be a chief spokesman of TAMSYA.

ii.

He will be the chief supervisor of TAMSYA activities.

iii.

He will lead and/or supervise all executive meetings and general assembly.

iv.

He will propose the minutes of the meeting.

12.2.2. VICE PRESIDENT {VICE CHAIRMAN} i.)

He will perform his responsibilities as directed by the president.

ii.)

He will perform the presidential responsibilities in THE absence of the president.

12.2.3.

SECRETARY GENERAL (i.)

He will be the chief executive of TAMSYA.

(ii.)

He will provide the reports of all meetings of the executive committee and general assembly.

(iii.)

He will be the secretary in all executive meetings committee and general assembly.

(iv.)

He will form a special committee and explain its duration of execution.

(v.)

He will provide a report of TAMSYA activities in the executive committee twice a year.

(vi.)

He will receive performance reports of the region and prepare executive nation reports of TAMSYA.

12.2.4.

VICE SECRETARY GENERAL.

(i.)

He will perform his responsibilities as directed by secretary general.

(ii.)

He will perform the responsibilities of secretary general in his absence.

EXECUTIVE SECRETARY.

i.)

He will be engaged in TAMSYA daily activities.

ii.)

He will be engaged in communication and reports of TAMSYA in a particular post.

iii.)

He will cooperate responsibilities.

iv.)

He will perform other responsibilities as directed by the president.

12.2.6 AMIRAH OF TAMSYA. i.)

She will be the chief spokes women of TAMSYA women wing.

She will be in charge with all matters pertaining women and girls in general.

She will supervise and leads all meetings of women section.

She will ensure that targets of women wing are accomplished.

12.2.7 VICE AMIRAH. i)

She will cooperate with Amirah in executing her responsibilities.

ii)

She will act for the position in absence of Amirah.

12.2.8 CHAIRPERSONS OF TAMSYA GENERAL DEPARTMENTS. The chairpersons of the departments of TAMSYA in all posts will have the following responsibilities. (i)

To lead meetings of their departments.

(ii)

They will be accountable for their department responsibilities.

12.2.9 SECRETARIES OF GENERAL COMMITTEES OF TAMSYA. a. Education and vocational training secretary. i.

He will be the academic officer of TAMSYA of a particular post.

ii.

He will be responsible for all academic matter of TAMSYA.

b. Financial secretary. i.

He will be the assistant treasurer of the association.

ii.

He will be responsible for all matters pertaining financial plans and economy of the organization.

c. Information, relation and social welfare secretary of TAMSYA. i.

He will be the relation and social welfare officer.

ii.

He will be responsible in all matters pertaining information, relation and social relation of TAMSYA.

d. Women wing secretary. (i)

She will be the chief executive of women section in collaboration with Amirah and vice Amira.

(ii)

13. 13.1

SECTION 13: RULES AND REGULATIONS. All members and leaders of TAMSYA should be good Muslims and should observe keenly Islamic moral conducts and teachings.

13.2

Any deliberate transgression of the minor section above (13.1) strict discipline measures will be taken by a concerned authority.

13.3

Disciplinary measures which will be taken will start from strictly waning, uphold for a time or termination.

13.4

Measures should also be taken against any person who violates this constitution or whose bad deeds have marred the beauty of TAMSYA.

13.5

The person that disciplinary measures have to be taken against him should be given enough time for defense.

13.6

There will be the chance for appealing to the higher organs but national executive committee will be the last organ of appeal and its decisions will no longer be appealed.

She will be responsible for the implementation of responsibilities of women section of TAMSYA in all section.

ARTICLE 14 AMENDMENT OF THE CONSTITUTION. 14.1

This constitution will not be changed or amended anywhere except by the permission of more than half of all members of TAMSYA general assembly.

14.2

Proposal(s) of the constitution amendments should be presented before the board of trustees for discussions and suggestions. Executive committee will distribute the proposal(s) to the members so as to evaluate them three months before the general assembly.

14.3

Executive committee will present the amendments proposed in the general assembly together with the fundamental reasons as well as the suggestions of board of trustees.

14.4

The amendments will be presented to the board of trustees after been accepted in the special meeting of national general assembly.

15.

ARTICLE 15: TIME TO START USING THE CONSTITUTION This constitution will start to be used on this 7th July 2008 AC equal to 18th MUHARRAM 1429 H.
