On the 28 April 2017 I received correspondence from , Helen Raptis', lawyer, Damian Balian - Zervos Solicitors. I'm separated from her whilst occupying the same house at 25 Benjamin Street, Parkville, 3052 and currently find myself forbidden from entering the house. I went to the house to take some of my personal belongings but the locks were changed . I rang North Melbourne - Police Station to be informed that they cannot do anything because this is a civil matter. I then left the house. Helen Raptis , another person and my son were situated at a coffee shop across the street, not intending to come to the house. Helen Raptis then called the police as around 5 minutes after I left, I received a call from my wife's mobile, which she handed to the Constable Moore - North Melbourne - Police Station attending the Benjamin Street property. Constable Moore informed me that I could return to pick up what I need from the house. I returned to pick up 3 pre-packed boxes of books, chargers and miscellaneous items. I asked the Constable Moore how I return to the house to take additional belongings I need given the locks had been changed preventing access without an intervention order being in place. He told me to ring the Police Station and they will give me access to the house. On the 3 May 2017 at 4PM , I rang North Melbourne - Police Station requesting to organise access to take additional paperwork and account related documentation . By happenstance I got the same person , Constable Moore. I did say that I met him on the 28 April 2017 when i went to take a few things .

Constable Moore did remember and said th at I don't need to call the Police Station as there was no Intervention Order in place to prevent me and Helen Raptis informed him that I could go anytime to collect my belongings . I replied to Constable Moore that I'd prefer if he could call her to verify that this as the case given her Solicitor advised that I cann ot contact her. Constable Moore did contact her and he rang me back to confirm Helen Raptis was OK with me going to the house . She ask Constable Moore that I ring her to organise the time . I did call Helen Raptis at 4:48PM - 3 May 2017, but she did not answer. I then at 4:52 - 3 May 2017 sent Helen Raptis the following text message:

'Helenfrom norlh Melb police slolion advice you said 10 ring you 10 arrange lime. Since no answer, confirm by IXl lhal lOam lomorrow iI's ok'

After 12 min she replied by text message:

'As my lawyer has already advised you in wriling you are not al liberly 10 come around whenever you feel like il. You ignored Ihis advice lasl week. You are now Ilying 10 ignore il again norwilhslanding Ihe Slress and anxielY your presence causes me given your pasl violent behaviour lowards me. / have arrangedfor your car and belongings 10 be delivered 10 your Werribee home 10mOrrOw. This will ensure Ihe relurn o!your belongings and negale any fll/ure needfor you 10 come 10 my home. Please do NOT conlaCI me in whalever \I'ay again and direcl all fUlure communicalions via my solicitor. Ifyou ignore Ihis requesl/will have no allernative bU110 rely on Ihese communications 10 seek an inlervenlion order. Thank you'"

At 5:08PM - 3 May 2017, I rang the Police Station and talk to the same Constable Moore again . Constable Moore said he can ring her again because this is what she said to him. Then I said it is not going to be necessary Given the fact that I own the house at 25 Benjamin Street, Parkville, 3052 which is also the registered business address of my profession , Mechanical and Environmental Eng ineering - Enviromech , where with in resides my personal and professional paperwork, software and account related documentation , it creates confusion I damaging personal and professional interference, to me that the Solicitor representing Helen Raptis - Damian Balian - Zervos Lawyers on one hand notifies, not to enter the house and on the other hand Helen Raptis advises the Police that I can have access.

When I attempt access, her text message to me, above, does not align with what Helen Raptis is saying to the North Melbourne - Police Station - Constable Moore. The Solicitor - Damian Balian - Zervos Lawyers sets timelines requiring account information which cannot be met under such circumstances and conditions as his client, Helen Raptis , currently restricts access without any evidenced violence or threat existing .
