Cocalico School Board Members: Pursuant to your advertisement for bids to be opened Wednesday, August 19, 2015 11:00 AM the undersigned agrees to furnish and deliver to one or more of your schools designated in your Instructions to Bidders such items of this bid as you may accept, in full accordance with your specifications at the prices set forth on the attached proposal pages. The undersigned acknowledges that time of delivery is vital for the operation of your schools, and is therefore “of the essence” in this contract and that upon any defualt by the undersigned in making delivery within the time specified in the Instructions to Bidders, you may obtain the supplies elsewhere and recover any loses from the undersigned. The undersigned also agrees to promptly remove and replace any rejected articles at no expense to you, and so as not to interfere with or delay your school operation. The undersigned, intending to be legally bound agrees (A) that his bid shall remain irrevocable and subject to acceptance for 120 days after bid opening date; and (B) that bid/s for any one or more items may be accepted separately, and without regard to possible nonacceptance of other items bid on. INSTRUCTIONS FOR NON-COLLUSION AFFIDAVIT This Non-Collusion Affidsvit is material to any contract awarded pursuant to this bid. According to the Pennsylvania Antibid-Rigging Act, 73 P.S. 1611 et seq., governmental agencies may require Non-Collusion Affidavits to be submitted together with bids. 2.

The member, officer or employee of the bidder who makes the fmai decision on prices and the amount quoted in the hid must execute this Non-Collusion Affidavit.

Bid rigging and other efforts to restrain competition and the making of false sworn statements in connection with the submission of bids are unlawfUl and may be subject to criminal prosecution. The person who signs the Affidavit should examine it carefUlly before signing and assure himself or herself that each statement is true and accurate, making diligent inquiry, as neceasazy, of all other persons employed by or associated with the bidder with responsibilities for the preparation, approval or submission of the bid.

INSTRUCTIONS TO THE BIDDERS Sealed proposals are invited under the following conditions for furnishing the Public Schools of Cocalico School District, Denver, Lancaster County, Pennsylvania, with Goods and Services as may be needed for the 20 15/2016 school term.

1.

The Cocalico School Board reserves the right to waive any informality, reject any or all bids, or the bid on any particular item. Any deviation from the below listed instructions may result in the bid being rejected by the District.

2.

All items shall be as specified or an approved equal. Manufacturer’s name must be given if bid is submitted on article other than specified. Samples submitted to the Board will be retained unless the bidder indicated in his proposal that they be returned.

3•

All items bid shall be in the size container or quantity specified in the description. No deviation from these amounts will be accepted. If you cannot supply these items as specified, please do not submit a bid on the item. Use the Vendors Notes coulumn to communicate and item specification changes to the District.

4.

Mi orders will be accepted any time after Sept. 16, 2015, but no later than Feb.1, 2016. Cocalico School District reserves the right to cancel total orders or partial orders not received by Feb. 1, 2016.

5.

All invoices must carry the name of the District, the purchase order number, the invoice number and the department to which the goods were delivered. Invoices are to be mailed to the Business Office, South Fourth Street, P0 Box 800, Denver, PA 17517-0800. Ml invoices will be paid within 45 days Arl’ER the date of delivery.

6.

All bids with all required paperwork must be in the Business Office by August 19, 2015 at 11:00 AM.

7.

Submit original bid and make copies for your record. Bids must be submitted on the forms provided by the District. When returning a bid, label the sealed envelope with the bid title and open date.

8.

Mi bids are awarded based on the total bid price of each item number and not the unit price. The unit price is there for convenience only in calculating the total price. Delivery or Shipping costs should be figured into the total item price, as part of the bid price, not listed as a separate additional charge on the bid. Any bids that do not follow these guidelines may be rejected by the District.

9.

All supplies for the District are to be packed, labeled and delivered to the District location printed on the purchase order. Orders not delivered to the ship to address may be rejected by the receiving building at the awarded vendors cost. No additional charges shall be added to the District billing for multiple delivery locations.
