Whereas, there currently is a need for clarification of the Senate Bylaws in context of Senator attendance; and, Whereas, it is the mandated that the Committee of Internal Affairs maintain transparency and readability in the Senate Bylaws. Therefore, be it enacted by the Student Senate of the University of North Carolina at Charlotte: SECTION I: The following is to be added to the “Definitions and Conventions” section of the Senate Bylaws, found at §3-1.1. Such additions are to be made effective immediately following successful ratification. (t) The term “Senator” refers to the individual who is currently representing a recognized constituency by occupying the Senate position that represents said constituency. This term is divorced from the term “Officer”, in that the term “Officer” is not inherently tied to the term “Senator”. (u) The term “Officer” refers to the individual who is currently employed in one of the roles that is designated by the term “Officer(s) of the Senate”, as described in §3-2.1 This term is divorced from the term “Senator”, in that the term “Senator” is not inherently tied to the term “Officer”. SECTION II: The following amendments shall be made effective immediately following successful ratification to the specific section of the Senate Bylaws, found at §3-1.16, “Removal from Office”. (a)
§3-1.16. Removal from Office. Attendance Removal: When a Senator has exceeded the total number of absences, the Senator will appear at a hearing of the Internal Affairs Committee. The Chair of the Internal Affairs Committee shall give the Senator a written notice at least 5 days prior 24 hours prior to the date time the hearing is to occur. The Senator in question is allowed one postponement, and the Chair of the Internal Affairs Committee is required to give another five day written notice of the date 24 hour written notice of the new hearing. cannot provide proper excuses for his or her absences, his or her membership of the Senate will can be revoked by a two-thirds vote of the Internal Affairs Committee, following the Committee’s discretion. If the Senator fails to attend the hearing or contact the Chair of the Internal Affairs Committee to reschedule the hearing, the hearing will be conducted in absentia. Pursuant to §3-1.1(t), an attendance removal is a divorced process to that described in §3-2.12, “Removal of an Officer”. Disciplinary Removal: Any Senator alleged to have acted in a manner inconsistent with the Oath of Office shall be brought before a Special Assembly. i. The President Pro Tempore shall chair the Special Assembly unless he or she is being presented for removal, in which case the Parliamentarian shall assume the chair. ii. Senators shall be removed from Office upon a three-fourths vote of Senators present in a Special Assembly.
SECTION III: The following amendments shall be made effective immediately following successful ratification to the specific section of the Senate Bylaws, found at §3-2.12, “Removal of an Officer”. §3-2.12. Removal of an Officer. If a Senator does not believe that an Officer is performing the duties listed in these By-Laws, the Senator may submit a Petition to remove that Officer from their position. The petition must be signed by a majority of Senators and submitted to the President of the Senate. The Officer may be removed from his/her position at the special assembly the petition is presented with a two-thirds vote of the Senators present. Pursuant to §3-1.1(u), a removal of an officer is a divorced process to that described in §3-1.16, “Removal from Office”.
