and List of Dates

This petition seeks a court-monitored investigation by an SIT or the CBI into the high level of political-bureaucratic-corporate

internal

Parliament,

from Essar Group of

Companies which is one of India's leading business conglomerate having multi-billion infrastructure

dollar investments

in oil, steel. energy,

ports. shipping.

and services sectors in India, This information is being

placed before the Hon'bie Court by the petitioner's society for its kind consideration and appropriate directions.

This Hon'ble Court has on the issue of corruption developed public law and framed guidelines in the past e.g. Vineet Narain vs. UOI - Jain Hawata Case (1998) 1 SCC 226; in the CVC case (CPIL vs. UOI (2011) 4 SCC 1) the doctrine of institutional SCC : CPIL vs. UOI)

integrity was enunciated [(2011) 4

and the CVC appointment was quashed on the

facts of the case; the 2G Spectrum scam case (CPIL vs. UOI (2012) 3 SCC )) as explained in the Presidential Reference Case by five judges (2012) 10 SCC 1 where norms have been laid down in connection with the grant and transfer of natural assets belonging to the nation and in what cases open auction and bidding are to be adopted. Similarly while quashing Coal allocations in Manohar Lal Sharma vs. Principal Secretary (2014)

has

formulated

society

applicable

seeking

similar

intervention in the instant case.

The internal emails and documents from one of India's biggest business group reveal how in violation of the Constitution and the laws of the land, major corporates like Essar manage to influence the political executive, the bureaucracy, the police and the media, in order to serve its business interests rather than public interest which they are legally obligated to uphold. The emails show how Essar attempts to bribe by bestowing favours on Ministers, top politicians, top bureaucrats and police officers in violation of various sections of the Prevention of Corruption Act 1988.

These favours are in the form of expensive gifts and jobs to the persons they recommend.

The

entire

matter

is

crying

out

for

a

thorough

oourt-monitored

investigation by an SIT or CSI since the same is necessary to uphold democracy. the rule of law and rights of the citizens under Articles 14 and 21 of the Constitution of India. The prevailing corruption in the country in high places seriously impairs the right of the people of this country to live in a corruption free society governed by rule of law. This is a violation of Article 14 and 21 of the Constitution. The right to life guaranteed to the people of this country also includes in its fold the right to live in a society, which is free from crime and corruption.

The conduct of the journalists and media companies in taking favours from corporates

and in carrying out planted stories is in violation of

journalistic norms and ethics. The Government

of India is obligated to

withdraw the privileges like subsidized land, newsprint, houses etc. that have been extended to media organisations

and journalists

who are

indulging in paid news. or publishing news reports to favour corporates, or who are taking favours from corporate.

The instant case has several similarities with the Radia tape case (yVPC 16 of 2011) which showed Many illegalities and corrupt activities that have been exposed include appointment & functioning of regulators for extraneous considerations.

THE CASE IN BRIEF

2)

The present writ petition deats with the phenomena of corrupt nexus

between

business

and government.

The

nation was

shocked

when

recently several arrests were made and FIR lodged In connection with secret and confidential papers being systematically copied and allegedly passed over to powerful commercial

interests.

This petitioner society,

through a confidential source whose identity needs to be fully protected, has come in possession on internal emails and documents of Essar Group of Companies

(hereinafter 'Essar'), which indicate how Essar has been

cultivating ministers, polilicians,

bureaucrats

and journalists

in order to

serve its business interests, Essar, In turn, apparently gets favoured from such influential persons who can take executive decisions, change public pouctes, raise questions

in Parliament,

leak confidential

government

documents and plant stories in the media. This Information Is being placed before

the

Hon'ble

Court

by

the

petitioner's

society

for

its

kind

consideration and appropriate directions.

3)

This Hon'ble Court has on the issue of corruption developed public

law and framed guidelines in the past e.g, Vineet Narain vs. UOI - Jain Hawala Case (1998) 1 SCC 226; in the CVC case (CPIL vs. UOI (2011) 4 SCC 1) the doctrine of institutional integrity was enunciated [(2011) 4

sec

: CPIL vs. UOI) and the CVC appointment was quashed on the facts of the case; the 2G Spectrum scam case (CPIL vs. UOI (2012) 3

scc

1) as

explained in the Presidential Reference Case by five judges (2012) 10 SCC 1 where norms have been laid down in connection with the grant and transfer of natural assets belonging to the nation and in what cases open auction and bidding are to be adopted. Similarly while quashing Coal allocations In Manohar Lal Sharma vs. Principal Secretary (2014) 9 SCC 516 the court has formulated applicable constitutional principles.

4)

This petition, apart from placing certain material and information,

deals with the broader and significant questions and seeks this Hon'ble Court's intervention to frame guidelines, norms and standards in relation to

a)

Access,

meetings and interviews

bureaucracy and the representatives/employees

between the ministers & of commercial interests

including consultants, facilitators, middlemen and lobbyists;

b)

The

phenomenon

of

corporate

gifts

and favours

being

bestowed on public servants or on those who can exercise influence over public servants.

c)

The issue of paid news/stories planted in the media through

journalists who are conferred various favours by corporate houses.

Planting Questions

5)

In Parliament

In Parliament, the MPs have a right to question the Government on

various

issues

including

issues

concerning

economy. After the "cash-for-questions' sting operation showed Parliament,

sectors

of

the

scandal erupted when a television

MPs accepting

11 MPs from various

specific

cash for raising questions

parties

were

expelled

from

in the

Parliament. They challenged their expulsion before this Hon'ble Court. A

constitution

bench of this Hon'ble Court upheld that said the expulsion

(Raja Ram Pal vs Speaker, Lok Sabha (2007) 3 SCC 184).

6)

it appears

However,

the serious

crime of raising questions

in

Parliament at the behest of corporate houses is still a sad real~y. Internal report and emails from Essar reveal that the group is apparently planting questions in Parliament. A Monthly tnformation System (MIS) report dated 27.08.2012 was prepared by Essar's Senior Vice-President

Mr. Rajamani

Krishnamurti on various business interests of Essar including Steel, Mines, Shipping etc. The chapter on steet sector of the said report inter-alia states:

"Planted

Questions

regarding

pricing

mechanism of NMDC which are expected to be answered on the floor of House on 27"' August and:1" September, 2012, respective/y," On another issue concerning the company, the said report reads: "Planning to plant Parliament Questions by September 2012: A copy of relevant pages of the said report dated 27.08.2012

2012." Since this email was copied to the official Essar email-id, it caused some unrest and Essar's senior officer Mr. Ashish Rajgarhia wrote back on the next day: "Suggest we refrain from using the official Essar ID for such communication

and specially name of Mr. PSR." Mr. Krishnamurti then

replied: ·Ok. Will keep in mind. Sorry for the inconvenience." A copy of the said email exchange dated 24.08.2012 is annexed as Annexure P2 (Pg

33-'()0

). The

email exchange

also shows how a story was

planted in the media by Essar on the same issue on which Parliamentary Question was planted. The petitioner society requests this Hon'ble Court to direct a thorough investigation

into these disclosures

since they mi ght

involve high level corruption and sanctity of Parliament which is v~aJ for democracy.

Ministers,

Politicians

and Bureaucrats

Essar's internal notes and emails reveal how the company

institutionalized

a mechanism

to bestow significant

favours,

has

monetary

benefits and shower gifts on persons with influence. An inter-office note sent by Essar's President. Corporate Affairs in June 2009 states: "With the new UPA govt taking over at Centre and their fresh innings starting, this is an opportune moment for us to invest on right people at right places for reaping long term benefits. The fact that large number of MPs have been meeting

Not just high-end gifts, Essar sponsors luxury travel of influential

An office note and series of emails reveal how Essar has

institutionalized the practice of granting jobs to persons who have the backing of the ministers, politicians, senior bureaucrats, and other influential persons. An inter-office note was sent by Essar President, Corporate Affairs Mr. Sunil Bajaj to Essar's senior Director Mr. Prashant Ruia in June 2009, The said note states: "Almost al/ comorate houses

Out of the 60 people who want their candidates to work with Essar, there are candidates referred by Mr. Beni Prasad Verma (then Steel Minister). Mr. Sriprakash Jaiswal (then Coal Minister). Mr. Sanjeev Kumar (private secretary

to then Minister for Petroleum

Mr. B.K. Lala, a contractor with the Essar group in Dantewada, was arrested for allegedly handing over Rs. 15 lakh to Maoists on behalf of the Essar Group. According to a report by The Indian Express on July 9, 2012, "as the company was accused of paying extortion money to Maoists, Essar

GM DVCS Verma was arrested and slapped with seditIon charges ... Essar washed its hands of Lala after the case came to light.' 33}

That the intemal emalls and documents from one of India's biggest business group reveal how in violation of the Constitution and the taws of the land, the major corporate like Essar manage to influence the political executive, the bureaucracy, the police and the media, in order to serve its business interests rather than public interest which they are legally obligated to uphold, B. That the emails show how Essar bribes and bestows favours on Ministers,

lop politicians,

top bureaucrats

and police officers in

violation of various sections of the Prevention of Corruption Act 1988. These favours are In the form of expensive gifts and jobs to the persons they recommend. C. That the conduct of the journalists and media companies in taking favours from corporates

and in carrying out planted stories is in

violation of journalistic norms and ethics. The Government of India is obligated to withdraw the privileges like subsidized land, newsprint, houses etc. that have been extended to media organisations and journalists reports

who are indulging in paid news, or publishing

to favour

corporates,

or who are taking favours

news from

corporates D. That the entire matter is crying out for a thorough court-monitored Investigation by an SIT or CBI since the same is necessary to uphold democracy, the rule of law and rights of the citizens under Articles 14 and 21 of the Constitution of India.

E. That the prevailing corruption in the country In high places seriously impairs the right of the people of this country to live in a corruption free society governed by rule of law. This is a violation of Article 14 and 21 of the Constitution. The right to life guaranteed to the people of this country also includes in its fold the right to live in a society, which is free from crime and corruption.

Inter Office from

Sunil Bajaj .President, Corporate Affairs Date: June 2009

To Silri PSR

Pursuant to my discussions with you, it was decided to strengthen the Corporate Affairs work at Deihl. With the new UPA govt taking over at Centre and their fresh innings starting, this Is an opportune moment for us. to Invest on right people at right places for reaping long term benefits. I have noticed' that quite a tot of them, especially the young parfiamentarians, are techno-sawy and they prefer to communicate over emails, and Isms' than the tradittonal letters. We have to have the

right strategy to penetrate this base, and with this in mind, I propose to gift about 200 top-end cell phones to some of these esteemed leaders,' and also some of the top bureaucrats. These phones will have SIM cards supported by us by about Rs.5000/- per month.

'Many corporate houses like Reliance and Airtelare already doing this as a part of their relationshlp buifding exercise, and experiencing the benefits of such a strategy.

I would be thankful if you will give your sanction for this expense and fund allocated.

SRI PSR. As you are aware tbat as per Management's deci:sion Deepa!Nati gifting was stopped in the yeer 2010 and since then we've discontinued distribution of any Deepawan I Christmas J New Year gifls. However, during the same time almost all of our major competitors have persisted vllth theIr respective festive gifting and consider this as an integral part of their Jong-term relationship buildlng strategy as it helps establish and enhance critical relationships~ Corporate Deepa'Jvati gifts ate an Incredible app(oach to create lasting impressions among the associates. Although, it is a yearly ritual, but the expectations of the government officials at all levels remains high and they look r01VJardfor some kind of gesture from such large ccrporate house. I understand that businesses are not doing very Y/ell with recession and fiquidily crunch thereof, but on the other hand f strongly believe that festive giRing is an effective v/ay to build a sense of partnership \vith valued resources lt may also please be noted that \lIithin our group, different business verticals engage in corporate gifting during Deepawaf & 'othef festive Occasions, hovrever it is dono in a disorganised manner wherein there is no syr\Errgy amongst these vem-c-ais and .nstances of dupticacy has also bean observed. Deepawali & N&\'VYear is the only lime in the entire calendar year wherein gifts are dislnbuted to (he person in

tile middle and the rower ranks in various ministries, \vtlo are very vital in sustenance and procurement of important Information & cocements. and most of the times it has been observed that these resources are left out during festive gifbng. The economy is still down but by offering small corporate grtts ~ve can at least snow that we value them. Keeping in view,

Inter Office From

Shri PSR

President; Corporate Affairs

Date:

.

Juo",2009

Almost all corporate houses come aCfOSSthe phenomena of "job requests' from the power centres, le, Govt offices that they lnteract on an everyday basis" or from powerful

politicians, or bureaucrats.

This trend

vias

discussed in many of the CRG

meetings also for a selutlon benefrting both the sides. You will understand that if we have to Interact with these people on a regular basis. we

have to entertain such requests .. At Delhi we have daily interaction with top political leaders, Mintstrle.s of Steel, petroleum, power, shipping, DoT and scores of others on some case or the other. Moreover, most of the time the youngsters who they ask us to accommodate are also highly qualified, talented and competent ones. We Can easily accommodate them In any of our business divisions after proper intervIew against existing vacancies. In as much as we are recruiting people from outside, why not entertain these peopte ? We have Aegis that recrult young people on a regular basis .. where we can keep a certain number of vacancies for people recommended by political bosses, bureaucrats etc. We at Dalhl are under pressure on this front, and I am sure this Is the case wlth Ahmedabad, Che-onal etc. also·.· Therefore, I request at least 200 jobs be earmarked for this kind of requests and a strategy worked out by Business divisions to entertain qualified applicants who come under this category. The names supplied by us can be kept in a separate data bank by CHRor HR of that business division and entertained at the time of vacancies. I VJoIJld request for your agreement

Dear Raja, AS discussed with you and Mr A.nil Agarwal on alleged revealation of source of story by PTI correspondent to Mr C S verma, I had a word wi th her, I wi sh to

state:

page 1

Annexure 27 The corresponden~

is trustworthy

and known to me for years.

She had said while talking to us that she would take quote from Nr C S Verma I Who is acting chairman of NMDC. Before that she got the quotes from sponge iron association.

JSW, Essar and

we'l spun.

Armed with these she had asked Mr verma for comments saying steel majors feel you are charging high prices for iron ore. Asked if she had revealed the source to verma, she said even her office does not know about the source and offered to confront Verma on the source issue on a conference call in our presence. 1 would, knowing her, ~~uld vouch for the pti correspondent.

Essar GM arrested for paying protection money to Maoists Supriya Sharma. Sep 27, 2011 RAIPUR: Dantewada police have arrested a general manager (GMl of Essar group on charges of paying protection money to Maoists. This is possibly the first time ever that a senior corporate executive has been held on such charges.

DVCS Varma, the general manager of .Essar Steel Limited, was arrested from Kirandul, the mining town where the company operates an Iron ore beneficiation plant. He was produced before a magistrate who sent him to two days of police custody for further interrogation. The police have arrested him under sections 121 and 124 (Al of the Indian Penal Code that amount to waging war against the state and sedition. Dantewada police superintendent Ankit Garg also said he was dispatching a team to Chitrakonda, in neighbouring Orissa's Malkangiri district. to arrest the company's deputy manager C Srinivas. The current investigation was sparked off with the arrest of B K Lala, a building contractor of Essar, who was picked up at a weekly village bazaar on September 9. The police claim he was carrying 15 lakh rupees. which he confessed he was delivering to the MaOists through alleged naxalite associate Lingaram Kodopi on behalf of Essar, Since then, the police served legal notices to Essar as well as Jai Johar, a Jagdalpur based non-profit organisation that carries out CSR activities funded by the company. The co-managers of Jai Johar, two brothers, Pawan Dubey and Narendra Dubey went into hiding as soon as the notice was served. ''The fact that they are unwilling to be questioned and are absccnding only reinforces our suspicions," said Garg. Investigators claim the income of both Pawan Dubey and B K lala has nsen 'exponentially' in the last one year, a time period that coincides with Essar's attempts to repair its pipeline damaged by the MaOists in May 2009. The police believe both the men mediated Essar funds to the Maoists to buy peace. "We have hard evidences ccrroborating what lala has told us," said Garg, refusing to divulge more details, calling it a 'sensitive case'. In a statement,

a spokesperson

of Essar strongly

refuted the

allegations, stating, "Such baseless allegations are being made to hurt the image and reputation of the group, which is a law abiding corporate. " Essar does not mine iron ore in Oantewada but sources iron ore fines from the waste dumps of government mining firm NMOC, mixing them with water and transporting the slurry to the port town of Vishakapatnam through a 267 km pipeline running through Maoist territory in Chhattisgarh and Orissa. In a background note, the company has claimed its pipeline and plant have been damaged at least 15 times ever since they turned operational in October 2005. The note also pointed out that, "Industries in the area do not have access to any security cover". It is widely believed that any group, small or large, that engages in economic activity In Oantewada, whether it is collection of beedi leaves, or road construction. or mining activity, need to pay levies to gain Maoist sanction. Essar group, the largest private sector company operating in the region, in particular, has been under a cloud since its pipeline cuts through Maoist heartland. The speculation of the company striking deals with the Maoists got a boost after a leaked Wikileaks cable, dated 11 January 2010, sent by the US consulate at Mumbai, quoted an unnamed Essar representative as stating that the company "pays the Maoists 'a significant amount' not to harm or interfere with their operations." The company denied the allegations.
