Tobacco Industry refers to organizations, entities, associations, and individuals who work for and in behalf of t.I:e tobacco industry, such as, but not limitcd, to tobacco rranufacturers, wholesale distributors, importers of tobacco products, tobacco retailers, from groups and /or organizations, including, but aot limited to lawyers, scientists, and lobbyists who work to further the interests of the tobacco industry. 4.

Tobacco Industry Interference refcrs to the broad array of tactics and strategies utilized by the tobacco industry to influencc or interfere with the setting and implementation of tobacco control policies.

Provision on No Tobecco Industry lnterests by Partners and Donors

ln line with the policy enunciated under Joint Memorandum Circular 2010-01 issued by the Civil Service Commission and the Department of Health, and DepEd Order No. 6. s. 2012 and DepEd Order No.48, s. 2016, the Department of Education does not deal with the tobacco industry, or any individual or entity tirat works to further the interests of the tobacco industry, except to the extent strictly necessary to effectively rcgulate the tobacco industry and tobacco products.'

The First/Second Party confirms that he/she/it (as well as all members of is board and senior management) does not knowingly represent or have any affiliation with or receive any suppon, financial or otherwise, from the tobacco industry and/or those reprresenting its interests, and has not done so in the past year. 'l The First/Second Party hereby undertakes to notify thc Department immediately if it or any of its members and senior management discovers that il,/he/she reprcsents, is afliliated with, or receives support f'rom thetobacco industry. For this purpose,

Tobacco lndustry refers to organizstions. entities, associations. and individuals that work for and in behatf of the tobacco industry, such as but not limited to tobacco manufacturers, wholesale distributors, importers oftobacco products, tobacco retailers, t'ront groups and/or organizations, including but not limited to lawyers, scientists. and lobbyists who work to further the interests ofthe tobacco industry. lntercst and afTiliation in the tobacco indusrry means personal, financial or other interest, including but not limited to: a. Having an existing ownership or investment in the tobacco industry; b. Being a member of the Board of Directors, an officer of the corporation, or a parrnership in the tobacco industry; c. Receiving any contribution from the tobacco industry- "'

Any violation of this undertaking shall constitute valid and reasonable grounds fbr

the Department to terminate the Agreement with the First/Second Party immediately upon written notice.
