Presidential Primary: Post-Election Deadlines

This memorandum provides a friendly reminder of the deadlines set forth in the Elections Code for the canvass period. Elections Code section 3019 was amended (effective January 1, 2016) to provide for an “unsigned ballot statement.” If the elections official processing voted vote-by-mail ballots determines that a voter did not sign the vote-by-mail identification envelope, the voted vote-by-mail ballot will not be rejected if the voter does any of the following (and the signature matches): 1. Before 5:00 p.m. on the eighth day after the election (Wednesday, June 15, 2016), signs the identification envelope at the office of the elections official during regular business hours. 2. Before 5:00 p.m. on the eighth day after the election (Wednesday, June 15, 2016), completes, signs, and delivers via mail, facsimile, or hand delivery an unsigned ballot statement substantially similar to the statement provided in Elections Code section 3019(f)(1)(A)(ii). 3. Before the close of the polls on Election Day, completes and submits an unsigned ballot statement to a polling place within the county or a ballot dropoff box. Elections Code section 15375(c) requires the results for all persons voted for at the presidential primary for delegates to national conventions to be canvassed and sent to the Secretary of State within 28 days after the election (Tuesday, July 5, 2016). Elections Code section 15372 provides that the elections official canvass and submit the results to the county board of supervisors within 30 days of the election (Thursday, July 7, 2016). Elections Code 15375 requires the county elections official to send to the Secretary of State, within 31 days of the election (Friday, July 8, 2016), one complete copy of the returns for all candidates voted for at the primary election, including United States
