OVID TOWN BOARD Regular Monthly Meeting SEPTEMBER 9, 2015 The regular meeting of the Ovid Town Board was called to order at 7:00pm by Town Supervisor Walt Prouty Also present were Councilmen Mark Beardsley, John Hubbard, Brian Flood and Joe Borst, Town Clerk James Vangalio, Bookkeeper Donalie Kelly, Town Attorney Steven Getman, Highway Superintendent Jack Wickham members of the press and other interested citizens. Interlaken Police Chief Anderson spoke to the Board regarding a School Resource Officer. He provided an intermunicipal police services agreement by and between the Village of Interlaken and the Town of Ovid. Minutes of the August 12, 2015 meeting were approved, as written, with a motion by Councilman Borst, a second by Councilman Beardsley and approval by all. A Public Hearing on a Land Use Variance for 4019 Sheldrake Park Rd, Ovid, Tax Map 16-1-49 was opened at 7:10pm with a motion by Councilman Borst, a second by Councilman Beardsley and approval by all. Hearing no comment the Public Hearing was closed with a motion by Councilman Borst, a second by Councilman Flood and approval by all at 7:12pm. A second Public Hearing on a Land Use Variance for 1991 Co Rd 139, Ovid Tax Map 05-1-10.1 was opened at 7:13pm with a motion by Councilman Hubbard, a second by Councilman Beardsley and approval by all. Hearing little comment the Public Hearing was closed with a motion by Councilman Hubbard, a second by Councilman Borst and approval by all at 7:15pm. A third Public Hearing on Proposed Local Law No. B of the Year 2015 Town of Ovid, County of Seneca, State of New York “Repealing Local Law #1, 2004 of the Town of Ovid, Land Use Ordinance” was opened at 7:26pm with a motion by Councilman Hubbard, a second by Councilman Beardsley and approval by all. Several concerned citizens spoke against repealing the current law. The Public Hearing was closed with a motion by Councilman Hubbard, a second by Councilman Beardsley and approval by all at 7:53pm. A fourth Public Hearing on Proposed Local Law No. C of the Year 2015 Town of Ovid, County of Seneca, State of New York “A local law to override the tax levy limit established in General Municipal Law:”was opened at 7:54pm with a motion by Councilman Borst, a second by Councilman Flood and approval by all. Hearing little comment the Public Hearing was closed with a motion by Councilman Hubbard, a second by Councilman Flood and approval by all at 7:55pm. Highway Superintendent Jack Wickham presented his report. Jack suggested declaring the old truck surplus and put it up for bid. Jack’s Transfer Station report was also presented.

The Town Clerk’s Report and moneys collected for August were accepted into the record. It was noted that the dog enumeration had started As Land Use Officer, the Town Clerk reported on activity with land use permits within the town. Board Members received the Bookkeeper’s report. Planning Board Chair Jen Hollleran presented a report on board activities highlighting on member attendance as requested by the Town Board . Supervisor Prouty presented his report. Councilman Borst reported on activities with the Transfer Station Committee. Councilman Borst reported on discarded electronics. Councilman Flood reported regarding the Farm Bureau. Councilman Hubbard presented his reports regarding EMS and Fire Departments. John reported that Budget information was being assembled. Councilman Borst presented his reports regarding the Highway Department. Councilman Beardsley presented his report regarding the Assessment Department. With a motion by Councilman Borst, a second by Councilman Flood and approval by all discussion was opened on repealing the Land Use Ordinance. With a motion by Councilman Hubbard, a second by Councilman Flood and approval by all the Board tabled action on the local law repealing the Land Use Ordinance until the next meeting. With a motion by Councilman Hubbard, a second by Councilman Flood and approval by all the Board elected not to enforce the Land Use Ordinance after tonight, due to concerns that the law was void as the result of the failure in 2004 to comply with SEQR before passing it, and until all aspects of the law including SEQR can be rectified. During this period the Town Clerk shall not be required to enforce the land use ordinance." With a vote of 4 to 1 the Board approved all aspects of the variance thus granting the variance for 4019 Sheldrake Pak Rd. With approval by all the Board approved all aspects of the variance thus granting the variance for 1991 Co Rd 139. With a motion by Councilman Borst, a second by Councilman Flood and approval by all the Board approved Local Law No. C of the Year 2015 Town of Ovid, County of Seneca, State of New York A local law to override the tax levy limit established in General Municipal Law §3-c, override of the tax levy limit established by New York State.

With a motion by Councilman Borst, a second by Councilman Flood and approval by all the Board approved the inter municipal police services agreement by and between the Village of Interlaken and the Town of Ovid. With a motion by Councilman Borst, a second by Councilman Flood and approval by all the Board declared the1972 Ford water truck surplus and agreed to advertise for bids. With a motion by Councilman Borst, a second by Councilman Flood and approval by all the Board directed the Town Clerk to send a letter to a planning board member regarding his attendance. Following the Audit of the bills, Vouchers #301-#331, excepting #316 were approved for payment with a motion by Councilman Flood, a second by Councilman Hubbard, and approval by all, for Abstract #9 for $51,368.62. Supervisor Prouty adjourned the meeting at 9:35pm with a motion by Councilman Flood, a second by Councilman Hubbard, and approval by all. Respectfully Submitted,
