MEDICAL CANNABIS DISPENSARY AND DELIVERY PERMIT SUBMITTAL REQUIREMENTS AND PROCESSING INFORMATION Regulations and Requirements Governing the City of Ojai’s Licensure Program for Delivery Services and Non-Retail, Non-Storefront Dispensaries Providing Medical Cannabis. Purpose:  On November 15, 2016, the Ojai City Council approved an urgency ordinance regulating the use and cultivation of cannabis and adding a new Chapter 25 to Title 4 of the Ojai Municipal Code. Ojai Municipal Code section 4-25.04, subdivision (b) allows a person to deliver cannabis or cannabinoid preparations within the City for medical use if he or she first obtains a license from the City to do so, under regulations promulgated by the City Manager. Ojai Municipal Code section 4-25.04, subdivision (c) allows a person to operate a medical cannabis non-storefront, non retail dispensary if the person obtains a license from the City for such facility, under regulations promulgated by the City Manager. A licensed medical cannabis non-storefront, non retail dispensary must operate as a medical cannabis delivery or appointment-only service and may not engage in any commercial activities related to recreational cannabis within the City’s limits.  These regulations implement Ojai Municipal Code section 4-25.04 and provide the requirements and standards that medical cannabis delivery and medical cannabis nonstorefront, non retail dispensaries must meet. As stated in Ojai Municipal Code section 425.04, these licenses and regulations are intended as a temporary measure, notwithstanding any other provision of the Ojai Municipal Code, to ensure the City’s residents have safe and reliable access to medical cannabis while the City Council considers a more permanent cannabis policy.  The City Manager will issue up to 3 licenses for medical cannabis non-storefront, non retail dispensaries, to be issued by lottery if more than 3 license applications that meet the applicable qualifications are received within the first 30 days after the regulations are issued.

The City Manager will issue up to 3 licenses for medical cannabis delivery services, to be issued by lottery if more than 3 license applications that meet the applicable qualifications are received within the first 30 days after the regulations are issued. Licenses issued by the City Manager under Ojai Municipal Code section 4-25.04 and these regulations do not create any vested right to engage in any such activity or business and are revocable at any time. Nothing in these regulations is intended, nor shall it be construed, to exempt licensed medical cannabis delivery and medical cannabis non-storefront, non retail dispensaries from complying with all other applicable provisions of the Ojai Municipal Code and any applicable state laws. Nothing in these regulations is intended, nor shall it be construed, to exempt licensed medical cannabis delivery and medical cannabis non-storefront, non retail dispensaries from complying with any applicable local and state construction, electrical, plumbing, water rights, waste water discharge, streambed alteration, or any other environmental, building, or fire protection standards, including the provisions of the applicable California Building Code and Fire Code, as adopted by operation of law and amended by the City Council. Nothing in this Section is intended, nor shall it be construed, to preclude a landlord or property owner from limiting or prohibiting licensed medical cannabis delivery and medical cannabis non-storefront, non retail dispensaries from operating on private property. Except as permitted by Ojai Municipal Code section 4-25.04 and as authorized by licenses issued under these regulations, the commercial cultivation, processing, testing, distribution, transportation, delivery, dispensaries, and manufacturing of cannabis in the City of Ojai is prohibited. The processing and manufacturing of cannabis for medical use is also prohibited in the City of Ojai. As stated in Ojai Municipal Code section 4-25.04, subdivision (a), recreational cannabis delivery is prohibited in the City of Ojai. As stated in Ojai Municipal Code section 4-25.04, subdivision (c), recreational cannabis businesses are prohibited in the City of Ojai.

Definitions (a) “Cultivation” means any activity involving the planting, growing, harvesting, drying, curing, grading, or trimming of cannabis. (b) “Delivery” means the commercial transfer of cannabis or cannabinoid preparations to a customer. “Delivery” also includes the use by a retailer of any technology platform owned and controlled by the retailer or independently licensed under California law that enables customers to arrange for or facilitate the commercial transfer by a licensed retailer of cannabis or cannabinoid preparations. (c) “Cannabis” means all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part thereof; and every compound, manufacture,

Please see the highlighted text for the revisions. salt, derivative, mixture, or preparation of the plant, its seeds, or resin. “Cannabis” does not include: (1) Industrial hemp, as defined in Section 11018.5 of the California Health & Safety Code; or (2) The weight of any other ingredient combined with cannabis to prepare topical or oral administrations, food, drink, or other products. (d) “Cannabinoid preparations” means cannabis that has undergone a process whereby the plant material has been transformed into a concentrate, including but not limited to concentrated cannabis, or an edible or topical product containing cannabis or concentrated cannabis and other ingredients. (e) “Medical use” of cannabis or cannabinoid preparations means the use permitted by the Compassionate Use Act (California Health & Safety Code, § 11362.5) and the Medical Marijuana Program Act (California Health & Safety Code, § 11362.7 et seq.). (f) “Person” includes any individual, firm, co-partnership, joint venture, association, corporation, limited liability company, estate, trust, business trust, receiver, syndicate, or any other group or combination acting as a unit, and the plural as well as the singular. (g) “Recreational use” of cannabis or cannabinoid preparations means the use permitted by Section 11362.1 of the California Health & Safety Code. (h) Any term defined in this Section also means the very term as defined in the California Business & Professions Code or the California Health & Safety Code, unless otherwise specified. Allowed Businesses and License Types: (a) Medical Cannabis Delivery Service License A person may deliver cannabis or cannabinoid preparations within the City for medical use if he or she first obtains a license from the City to do so, issued by the City Manager under these Regulations. The license permits the person, and persons employed or contracted by the person, to deliver medical cannabis and cannabinoid preparations to qualified patients and qualified caregivers in the City of Ojai in accord with the medical cannabis uses permitted by the Compassionate Use Act (California Health & Safety Code, § 11362.5) and the Medical Marijuana Program Act (California Health & Safety Code, § 11362.7 et seq.). Licensed persons are prohibited from delivering cannabis for recreational purposes or to any recipient other than a qualified patient or qualified caregiver. Licensed persons must operate the medical cannabis delivery service in accord with these Regulations, and must, at the time such licenses are made available by the State of California, secure any required state medical cannabis delivery licenses. Licensed persons must also secure a City of Ojai business license under Chapter 1 of Title 6 of the Ojai Municipal Code. Initial applications for licenses for medical cannabis delivery service licenses must be submitted within 30 days of issuance of these regulations. If the City receives more than 3 applications that, upon review, meet the requirements of these regulations, then the City Clerk will conduct a public, random lottery drawing by lot to select the 3 applications which will be approved. The initial licenses for medical cannabis delivery service licenses, once approved, will be valid for one year, unless revoked in accord with these regulations. For Calendar Year 2018 and every year thereafter, unless and until these regulations are lawfully modified, renewal applications from licensees for either or both license types who are in full compliance with all applicable provisions of these regulations, as determined in the City Manager’s sole discretion, are exempt from the public, random lottery drawing and will be first considered for one or more of the available 3 licenses of each type. If approval of lottery-exempt renewal applications by the City Manager, under the requirements of these regulations, results in three approved medical cannabis delivery service licenses or three approved medical cannabis non-storefront, non retail dispensary licenses for any given year, then no applications from new applicants will be approved for that year. In all cases, lottery-exempt renewal applications remain subject to all applicable provisions of these regulations and any licenses issued under these regulations are temporary measures and may be revoked at any time by action of the City Council, by amending Ojai Municipal Code section 4-25.04 or otherwise, and these licenses do not create a vested right to engage in these activities or businesses. Additionally, licenses issued under these regulations may be revoked at any time by the City Manager if the City Manager finds substantial evidence supports a determination that the licensed person, or any person employed by or contracted with the licensed person to provide services to the licensed service, has violated any applicable requirements of the Ojai Municipal Code or these regulations. (b) Medical Cannabis Non-Storefront, Non Retail Dispensary Licenses A person may operate a medical cannabis non-storefront, non retail dispensary if the person obtains a license from the City for such facility, issued by the City Manager under these regulations. The license permits the person, and persons employed or contracted by the person, to provide medical cannabis and cannabinoid preparations to qualified patients and qualified caregivers at one or more fixed locations in the City of Ojai in accord with the medical cannabis uses permitted by the Compassionate Use Act (California Health & Safety Code, § 11362.5) and the Medical Marijuana Program Act (California Health & Safety Code, § 11362.7 et seq.). Licensed persons are prohibited from providing cannabis for recreational purposes or to any recipient other than a qualified patient or qualified caregiver. Licensed persons must operate the medical cannabis non-storefront, non retail dispensary as a medical cannabis delivery or appointment-only service in accord with these Regulations, and must, at the time such licenses are made available by the State of California, secure any required state medical cannabis nonstorefront dispensary licenses. Licensed persons must also secure a City of Ojai business license under Chapter 1 of Title 6 of the Ojai Municipal Code. (i)

Additionally, licenses issued under these regulations may be revoked at any time by the City Manager if the City Manager finds substantial evidence supports a determination that the licensed person, or any person employed by or contracted with the licensed person to provide services to the licensed service, has violated any applicable requirements of the Ojai Municipal Code or these regulations. (c) A person may apply for and receive both medical cannabis licenses. Any person intending to operate a medical cannabis non-storefront, non retail dispensary solely or partly on a delivery basis must apply for and obtain both medical cannabis licenses. Application Requirements: (a) Applicants for either medical cannabis license must apply on a form to be issued by the City Manager, and must provide the following items of information: -Applicant’s name and mailing address -If applicant is not a natural person: names and addresses of all persons with an ownership interest in the applicant and all directors, officers, and Board Members, and full name and type of City of Ojai Medical Cannabis Dispensary or Delivery Permit Submittal Requirements & Processing Information Page 5 of 11 174709.1

The City Manager may conduct a background check via the Police Department to verify the criminal history, if any, of all persons listed in the application. -Proposed business address -Proof of ownership of the proposed business location or proof of consent for the applicant from record owner of the proposed business location -A narrative statement describing the proposed medical cannabis business, its proposed planned methods and hours of operation, its intended sources of product, its intended measures to be taken to reduce any adverse impacts to the surrounding community, and intended measures to be taken to ensure that services are provided only to qualified patients and caregivers. -Name and contact information, including cellular phone number, of applicant’s primary contact person, and any designees, who will be available for contact by the City if a need arises. -Proof of a commercial general liability insurance policy of at least $1 million that provides coverage in the event of any personal injury or third-party liability claims that arise out of the operation of the proposed medical cannabis business and which names the City of Ojai as an additional insured. -A certification, under penalty of perjury, that the information in the application is true and correct and that no person listed in the application, as applicant, or as owner, director, officer, or board member of the applicant, has been convicted of a felony. -An application fee of $300. (b) Applicants for a medical cannabis delivery service license must also submit the following items of information: -Proposed business address(es) from which deliveries will depart -Proposed delivery availability schedules -Proof of Comprehensive Automobile Liability Insurance (owned, nonowned, hired) providing coverage for bodily injury, including death, of one or more persons, property damage and personal injury, with limits of not less than One Million Dollars ($1,000,000). for all proposed delivery vehicles. -A narrative statement describing the proposed measures to be taken to ensure that services are provided only to qualified patients and caregivers. (c) Applicants for a medical cannabis non-storefront, non retail dispensary must also submit the following items of information: -All proposed business address(es) of the dispensary -Proposed operating hours -A narrative statement describing the proposed operations and the measures to be taken to ensure that the medical cannabis dispensary operates only as a non-storefront, nonretail dispensary by appointments and/or delivery service and does not become a public nuisance. -A narrative statement of how they intend to meet the security and operational requirements of these regulations and a copy of the security plan.

(d) Applicants for both a medical cannabis delivery service license and a medical cannabis nonstorefront, non retail dispensary license must submit all information described in subsections (a) through (c). License Issuance Decision (a) The City Manager may issue a medical cannabis delivery service license upon finding that: (i) The applicant has submitted all required application information and paid the required fee, (ii) The applicant meets the requirements of the Ojai Municipal Code and these regulations, (iii) Issuing the license would not create a public nuisance. (b) The City Manager may issue a medical cannabis non-storefront, non retail dispensary license upon finding that: (i) The applicant has submitted all required application information and paid the required fee, (ii) The applicant meets the requirements of the Ojai Municipal Code and these regulations, (iii) Issuing the license would not create a public nuisance. (c) After approval by the City Manager, the City shall issue a medical cannabis delivery license and/or a medical cannabis non-storefront, non retail cannabis dispensary license to applicant and the applicant shall be required to comply with all requirements of the Ojai Municipal Code and with these regulations. The applicant shall also be required, as a condition of approval of a medical cannabis delivery license and/or a medical cannabis non-storefront, non retail cannabis delivery license to indemnify and hold harmless the City of Ojai and its agents, officers, elected officials, and employees for any claims, damages, or injuries brought by affected property or other third parties due to the processing, testing, distribution, transportation, delivery, and dispensing of cannabis and cannabinoid preparations for medical use and for any claims brought by any person for problems, injuries, damages, or liabilities of any kind that may arise out of the processing, testing, distribution, transportation, delivery, and dispensing of cannabis and cannabinoid preparations for medical use. Operating Requirements (a) Licensed medical cannabis delivery services shall comply with the following requirements: (i) All vehicles used for delivery shall be maintained and operated in a manner and in a condition required by law and applicable regulations. (ii) The following persons may not drive delivery vehicles: a. any person who has been deemed at fault within the two years immediately preceding the application in any motor vehicle accident causing death or personal injury;

Please see the highlighted text for the revisions. b. any person who has been in three or more motor vehicle accidents within the previous 12 months; c. any person who has been under suspension, revocation or probation by the Department of Motor Vehicles for a cause involving the safe operation of a motor vehicle, or has been convicted of any of the following offenses: driving while under the influence, or reckless driving involving bodily injury, or who does not possess a valid driver’s license; or d. any person under 21 years of age. (iii) The following persons may not be involved in making deliveries: a. any person who is required to register as a sex offender under Section 290 of the California Penal Code; b. any person who has been under suspension, revocation or probation by the Department of Motor Vehicles for a cause involving the safe operation of a motor vehicle, or has been convicted of any of the following offenses: driving while under the influence, or reckless driving involving bodily injury, or who does not possess a valid driver’s license; c. any person who has been convicted of a felony; d. any person who has been involved within the two years immediately preceding the application in any motor vehicle accident causing death or personal injury; f. any person who has been in three or more motor vehicle accidents within the previous 12 months; or g. any person under 21 years of age. (iv) Persons involved in making deliveries must have in their possession a copy of the document memorializing the City’s approval of the delivery service. (v) Delivery vehicles may not advertise any activity related to Cannabis or advertise the name of the Dispensary. (vi) Delivery of the Medical Cannabis shall be directly to the residence or business address of the recipient. Deliveries to any other location are prohibited. (vii) Deliveries of marijuana may occur only between the hours of 8:00 a.m. and 7:00 p.m. (viii) All delivers must be pre-arranged and designated on a delivery route schedule issued to each driver at the start of a route. All orders to be delivered shall be packaged by the names or state-issued patient identification number of the person for whom the delivery is intended. (ix) The person responsible for making deliveries shall have a copy of the record of all delivery requests for that delivery route while making deliveries. (x) All licensed medical cannabis delivery services shall maintain at all times Commercial General Liability providing coverage for bodily injury, including death, of one or more persons, property damage and personal injury with limits of not less than One Million Dollars ($1,000,000) per occurrence and Comprehensive Automobile Liability (owned, nonowned, hired) providing coverage for bodily injury, including death, of one or more persons, property damage and personal injury, with limits of not less than One Million Dollars ($1,000,000). Please see the highlighted text for the revisions. include a severability of interest or equivalent wording, shall specify that insurance coverage afforded to the City shall be primary, and shall name the City of Ojai and its agents, officers, elected officials, and employees as additional insured. Failure to maintain insurance as required herein at all times shall be grounds for immediate suspension of the privilege of providing delivery service. (xi) If the delivery service origin location is within the City of Ojai, it must be in one of the following zones: M-1 (Light Manufacturing Industrial) or MPD (Manufacturing Planned Development. Deliveries are not permitted to originate from locations in any other zoning district. (b) Licensed medical cannabis non-storefront, non retail dispensary license shall comply with the following requirements: (i) The dispensary location must be in one of the following zones: M-1 (Light Manufacturing Industrial) or MPD (Manufacturing Planned Development. Dispensaries are not permitted in any other zoning district. Dispensaries must be located at least 100’ away from each other. (ii) Dispensaries may not operate as a retail or store-front operation and must operate as a delivery service and/or by appointment only. (iii) Dispensaries may only be open to appointments from 8:00am to 7:00pm. (iii) Appointments must be made at least 24 hours ahead. (iv) Licensed persons and any employees or contractors staffing the dispensary may not be any of the following: a. any person who is required to register as a sex offender under Section 290 of the California Penal Code; b. any person who has been convicted of a felony; or c. any person under 21 years of age. (v) Dispensaries may only provide cannabis and cannabinoid preparations to qualified patients and qualified caregivers at one or more fixed locations in the City of Ojai in accord with the medical cannabis uses permitted by the Compassionate Use Act (California Health & Safety Code, § 11362.5) and the Medical Marijuana Program Act (California Health & Safety Code, § 11362.7 et seq.). (vi) Dispensaries may not have any cannabis or cannabinoid preparations displayed in a manner that is visible from outside the business. (vii) Dispensaries may have external signage that states only the name of the business [excluding the words: cannabis and marijuana or their derivatives], the address, and that it is by appointment-only. The business may not display a green cross or an image of a marijuana leaf. (ix) Dispensaries must comply with the following security requirements: (a) Implement sufficient security measures to both deter and prevent unauthorized access to areas containing medical cannabis and cannabinoid preparations and deter and prevent theft of medical cannabis and cannabinoid preparations. The dispensary must provide a copy to the City of its security plan meeting this requirement. The City Manager must approve the security plan before the dispensary may open to the public or starting taking City of Ojai Medical Cannabis Dispensary or Delivery Permit Submittal Requirements & Processing Information Page 9 of 11 174709.1

The security plan must include provisions for adequate lighting and alarms in order to insure the safety of persons and to protect the premises from theft. All security guards used by dispensaries shall be licensed and employed by a state licensed private-party operator security company retained by the dispensary and each security guard used shall possess a valid state Department of Consumer Affairs “Security Guard Card” at all times. Security guards shall not possess or carry firearms or tazers while working at a dispensary. The security plan shall show how the dispensary and its site will be monitored at all times by closed-circuit television for security purposes. The camera and recording system must be of adequate quality, color rendition and resolution to allow the ready identification of an individual on or adjacent to the site of the dispensary. The recordings shall be maintained at the dispensary for a period of not less than thirty (30) days. The security plan shall provide that professionally monitored burglary and fire alarm systems shall be installed and such systems shall be maintained in good working condition within the dispensary at all times. (b) Prohibit individuals from remaining or loitering on the premises of the dispensary if they are not engaging in activity related to the dispensary’s operations. (c) Establish limited access areas and a develop a circulation plan ensuring that only authorized individuals have access to medical cannabis and cannabinoid preparations. (d) Store all medical cannabis and cannabinoid preparations in a secured and locked room, safe, or vault, and in a manner that prevents diversion, theft, and loss, except for those limited amounts of medical cannabis and cannabinoid preparations used for display purposes, samples, or immediate distribution. (x) Dispensaries must immediately notify the City and local law enforcement within 24 hours of discovering theft, burglary, product diversion, or any criminal activity pertaining to the operation of the dispensary. (xi) Dispensaries must keep records describing their acquisition and disposition of medical cannabis and cannabinoid preparations. The dispensary must also maintain records regarding the cultivation of the medical cannabis distributed by the dispensary, including the location and dates of cultivation. (xii) Dispensaries must permit an inspection by City of Ojai personnel before beginning operations, within 24 hours of a request by the City, and at least once annually. Renewals, Violations & License Revocations (a) Each license issued under these regulations shall be valid for one year from the date of issuance. (b) Licensed persons may apply for a renewed license by applying for a license as provided in these regulations. (c) Licenses issued under Ojai Municipal Code section 4-25.04 and these regulations are a temporary measure. As such, these licenses may be revoked at any time by action of the City Council, by amending Ojai Municipal Code section 4-25.04 or otherwise, and these licenses do not create a vested right to engage in these activities or businesses. (d) Additionally, licenses issued under these regulations may be revoked at any time by the City Manager if the City Manager finds substantial evidence supports a determination that the City of Ojai Medical Cannabis Dispensary or Delivery Permit Submittal Requirements & Processing Information Page 10 of 11 174709.1

Provide Proof of Ownership or Property Owner Consent: Attach a copy of the lease or equivalent for the proposed location, or provide proof of property ownership of the proposed location. Narrative Statement: Attach a narrative statement describing the proposed medical cannabis business, its proposed planned methods and hours of operation, its intended sources of product, its intended measures to be taken to reduce any adverse impacts to the surrounding community, and intended measures to be taken to ensure that services are provided only to qualified patients and caregivers. Proof of a commercial general liability insurance policy: Attach documentation showing proof of a commercial general liability insurance policy of at least $1 million that provides coverage in the event of any personal injury or third-party liability claims that arise out of the operation of the proposed medical cannabis business and which names the City of Ojai (and its employees, agents, officers and volunteers) as an additional insured. Application Fee An application fee in the amount of $300 shall be submitted with the completed application. The application shall not be deemed complete or filed without payment of the application fee. MEDICAL CANNABIS NON-STOREFRONT, NON-RETAIL DISPENSARY ADDITIONAL REQUIREMENTS Applicants for a medical cannabis non-storefront, non retail dispensary must also submit the following items of information: All proposed business address(es) of the dispensary:

Attach Proof of Comprehensive Automobile Liability Insurance (owned, non-owned, hired) providing coverage for bodily injury, including death, of one or more persons, property damage and personal injury, with limits of not less than One Million Dollars ($1,000,000). for all proposed delivery vehicles. Attach a narrative statement describing the proposed measures to be taken to ensure that services are provided only to qualified patients and caregivers. Signer hereby certifies, under penalty of perjury, that the information in this application is true and correct and that no person listed in the application, as applicant, owners, director, officer, or board member of the applicant, has been convicted of a felony.
