MINUTES BUILDING APPEALS BOARD January 27, 2016 Call to Order Bob Daddi, Board Chair, called the meeting of the Ojai Building Appeals Board to order on Wednesday, January 27, 2016, at 6:00 p.m. in the Council Chambers of Ojai City Hall, 401 S. Ventura Street, Ojai, California. Pledge of Allegiance

Roll Call On a call of the roll, the following Building Appeals Board Members were present: Chair Daddi, Vice Chair Farmer, and Board Members Hanson, Quilici, and Ulrich. Absent: None City staff present: Stephen Stuart, Contract Building Official, Shari Herbruck, Secretary. Public Communication

Consent Item 1. Minutes of the Building Appeals Board Meeting on September 8, 2015 Recommendation: Approve as submitted. Motion: Board Member Hanson moved and Board Member Quilici seconded the motion to approve the consent calendar. The motion passed as follows: AYES: Daddi, Farmer, Hanson, Quilici, Ulrich NOES: None ABSTAIN: None ABSENT: None Building Appeals Board Liaison Report Oral Report-Planning Commission Rosalie Zabilla reported on projects the Planning. Oral Report-City Council, Mayor Paul Blatz addressed the Board. Oral Report- Council Member Liaison, Severo Lara was also addressed the Board and was available for questions. Discussion Item 2. 2016 California Model Codes Adoption Process Board Chair Daddi opened the item for discussion and turned the time over to Stephen Stuart, Building Official who reviewed the staff report that was provided to the Board.

Chair Daddi opened a discussion on fire requirements. Board Member Quilici asked if OMC Sec. 9-9.101, which states, "The Legislature of the State, in Sections 65302, 65560, and 65800 of the Government Code of the State, has conferred upon local government units authority to adopt regulations designed to promote the public health, safety, and general welfare of their citizenry," does this adoption by reference mean the 2013 codes are considered part of the OMC or not? Contract Building Official Steve Stuart answered, "In my interpretation the answer would be no," because the latest edition of the Uniform Building Code is from 1997, and is no longer in publication. It has been superseded by the International Code. Contract Building Official added that the California Building Standards Commission in their regulations have mandated cities to enforce the California building codes, plumbing, mechanical, electrical, and so on, if a city opts to enforce codes. Board Member Quilici asked if the California Title 24 regulations are included in Title 9 of the Ojai Municipal Code. Mr. Stuart answered that is his understanding. Board Member asked if new references will need to be added to OMC Title 9. Mr. Stuart answered, "What we would be looking at is essentially a re-write of the code provisions that you see in Title 9 dealing with plumbing, electrical, mechanical, so on, codes, to bring them into conformance with the State Codes, with amendments." Board Member Quilici confirmed that they are referring to the 2013 version and asked when the revision to this code should happen. Mr. Stuart answered they have approximately 6 months to work through some of the details and then make a recommendation to the City Council, hopefully by July or August of this year, to adopt the amendment. Then they need to file it with the Building Standards Commission, so that by January 1, 2017, the City is ready to use the new 2016 codes. Contract Building Official Steve Stuart added it is his goal and the job of the Building Appeals Board to provide technical resources and make recommendations to the City Council who will make findings and adopt ordinances that work for the City of Ojai. He listed a potential timeline as follows: • In the months of July, or August, or September present recommendation of adoption and recommendation of a resolution to City Council; • If the Council refers back to the BAB to make adjustments that could take another month; • The Council would need to adopt and have a first reading and second reading, and thirty-days before the ordinance goes into effect; • File with the Building Standards Commission and receive comment from them before January 2017.

He further spoke about the Health and Safety Code criteria, and the City is allowed to make amendments to this code, per topographic, geographic, and climatic, reasons. He said he provide the Board with a list of the California Building Standards Codes that are known as Title 24, under the state statute which include: 2016 California Building Code 2016 California Residential 2016 California Plumbing Code 2016 California Mechanical Code 2016 California Electrical Code 2016 California Existing Building Code 2016 California Green Building Standards 2016 California Energy Code 2016 California Historical Code These are all codes that will become effective January 2017, whether the City adopts them or not. Contract Building Official Steve Stuart suggested another task he would like the Building Appeals Board to consider having a discussion on post disaster provisions, to recommend to the City Council to have an ordinance in place in the event of a disaster. If a disaster occurs the City will have an ordinance in place to start a recovery process. He asked for direction from the BAB to bring that forward to a future meeting. Contract Building Official Steve Stuart suggested another assignment the BAB might consider is a discussion on the International Maintenance Code. The City currently enforces the 1997 Uniform Housing Code and the 1997 Dangerous Building Code. The City can maintain these codes if the Council so chooses, but the City may want to take a look at code that is promulgated by the International Code Council known as the International Property Maintenance Code. Contract Building Official Steve Stuart reviewed the list in the staff report of the potential code amendments as follows: 1. Relocated Structures - amendments to provide procedures for relocating structures. 2. Annual Maintenance - amendments to provide for the issuance of permits for ongoing maintenance repairs. 3. Exempted Work - amendments to provide clarification and added improvement for work not subject to a permit such as block wall and storage buildings. 4. Permits - amendments to provide clarification and time limits on various construction permits. 5. Investigation and Processing Fees - amendments to provide a method to collect fees for work conducted without permits and illegal occupancy changes. 6. Inspections - amendments to give authority to conduct inspections for various activities not addressed in the code such as business licenses.

7. Notice of Noncompliance - amendments to give authority to record a notice on the title for noncompliance of City regulations. 8. Materials and Construction Methods for Fire Hazard severity zones — This chapter will provide construction standards for structures in fire hazard severity zones. The requirements include regulating ventilation openings, roofing materials, eave protection, fireplaces and exterior wall construction. 9. Roof covering — This amendment increases the fire rating of roof materials. 10. Drainage and Footing Construction - amendments to provide additional requirements for foundation and drainage requirement due to our expansive soil conditions. 11. Conductors - amendments to limit the use of aluminum wiring to larger conductors. 12. Electrode - amendments to require a concrete-encased electrode for electrical services when available due to the soil conditions. 13. Knob & tube wire — amendments to limit knob and tube wiring. 14. Hood & Ventilation Systems — hoods over residential cook tops requirements. Board Chair Daddi suggested creating ad-hoc committees and would like the Board to meet every 3 weeks. Board Secretary Shari Herbruck informed the Board what the City Attorney, Matthew Summers, had explained to Planning Commission at their January 20, 2016 meeting, what the differences are between a sub-committee and an Ad-Hoc committee, as follows: Mr. Summers, City Attorney. • "A sub-committee is formally created by action, as an agenda item, has an ongoing mission and an ongoing existence. Once that is created, no matter how many members are on that sub-committee it becomes a Brown Act body, that the Brown Act applies to and its meetings need to be legally noticed with an agenda. The creation of a sub-committee needs to come by direction from the Council." • "An Ad-Hoc committee is created with less than a quorum solely with members of the legislative body, which means you can't mix bodies. As always for a group consisting of less than a quorum of a Brown Act body this meeting does not need to be noticed or otherwise agendized, as it is not subject to the Brown Act. An Ad-Hoc committee has a specific goal with a reasonable end date to accomplish the project. An Ad-Hoc committee can have an expert or consultant to the City or the City's staff or counsel meet with them. The public cannot be invited because it would create a public meeting that requires noticing. Council direction or approval is not required to form an Ad-Hoc committee. However, you can request their blessing." Vice Chair Farmer is in favor of creating a committee. Board Member Ulrich is in favor of more frequent meetings.

Second Unit Compliance Program Recommendation: Receive the City Council report dated January 12, 2016 and discuss. Chair Daddi turned the time over to the Board for comment. Board Vice Chair Farmer would like the City Council to extend the program another 6months. Public Comment

Motion: Board Member Quilici moved and Board Member Hanson seconded the motion to recommend to the City Council the following: 1. Extend the Second Unit Compliance Program deadline to July 31, 2016; and 2. Obtain the Planning Commissions input on this subject; and 3. Advise current and future applicants of this program there may be conditions under which the Ojai Unified School District fees may not be required or may be refunded if already paid. Motion Amended: Board Member Quilici moved and Board Member Hanson seconded the motion to amend recommendation #1 to the City Council the following: 1. Extend the Second Unit Compliance Program deadline for application s for the program to be set at 6-months subsequent to the date the City Council approves such extension, if the Council so extends.
