This is an application filed in November, 2015, for a new distillery license that was tabled multiple times in 2016. The board previously approved a distillery license (Skagway Spirits) in Skagway, and issuance of an additional license would exceed population limits for Skagway per AS 04.11.400(a). The applicant has previously requested that its application be kept on the board’s agenda because of his skepticism that the previously licensed distillery would actually operate. Question for the board is whether to deny this application based on population limits or continue to table the matter. Recommendation:
Deny the application based on AS 04.11.320(a)(7), which requires compliance with statutory population limits. Applicant may reapply if a license becomes available. Continuous tabling of the application denies the applicant their due process.
