We hope to provide Commission and Appraiser Board news to all of you once a month to better update you on current events, licenses, deadlines, discipline, issues and concerns. As always, our correspondence is delivered via email, so make sure that our emails are not going into your SPAM folder! This e-newsletter will focus primarily on discipline and cancelled licenses. Last month, we hosted an open house to acquaint licensees to our new office space in East Cheyenne. We hope all of you that were able to attend enjoyed the event. It was also a great pleasure to visit with the Board of Directors of the Wyoming Association of Realtors while they were meeting here in Cheyenne. In February, our Commission also said farewell to Ray Elser from Jackson (see photo). Ray served on the Commission for six years and will be sorely missed. Ray’s vacant seat has been filled by Governor Mead and we are excited to report that Debbie Gibbs from Rock Springs will be serving as our new Commissioner. Farewell Ray! Welcome Debbie!

Respondent will have two opportunities to achieve a passing score. E-Newsletter—March 2016 WORD FROM THE INVESTIGATOR KAMRON RITTER LEAD INVESTIGATOR “Public or Private” Recently, Wyoming Certified Appraisers have been looking for some kind of direction on how to answer the question: “Private” or “Public” regarding the road/street adjacent to the subject property. To answer this question we need to look at whether it is asking about “Access or Ownership”! Fannie Mae states, “the subject property should front on a publicly dedicated and maintained street…” They further indicate that if the subject property fronts on a street that is community-owned (such as homeowners association) or is privately owned and maintained, then “an adequate, legally enforceable agreement or covenant for maintenance of the street is required”.

E-Newsletter—March 2016 WORD FROM THE INVESTIGATOR– continued “Public or Private” Simply put, FHA states even if a subdivision plat may stipulate that the HOA has accepted responsibility for the street (i.e. maintenance), it is “private” and not “public”. Public only applies if the street has been dedicated to and accepted by a unit of government. So it appears the question regarding the road/street adjacent to the subject property is “Public or Private” pertains to Ownership, not access. With that said, when the question is answered as it pertains to Ownership, the Lender will know if further documentation is required pertaining to use and maintenance. Thank you!
