1. Introduction LG Electronics Inc. (“LGE” or “we”) is committed to protecting the information of those individuals and groups who use LG Smart TV Services. This Privacy Policy sets out how we collect, use, and share information that we obtain as a result of your use of these services and, in particular, sets out: • What information LGE may obtain from you or your LG Smart TV; • How LGE uses the information that it obtains; • When LGE shares information with others; and • How you may control LGE*s use and sharing of your information. LGE’s Smart TV Services provide access to “apps” and links to other services owned and operated by third parties, such as content providers like Netflix and YouTube. These third party services are outside the scope of this Privacy Policy and have their own policies that apply to the collection, use, and sharing of information in connection with their services. We encourage you to read those policies. LGE is not responsible or liable for the privacy practices of such third parties. 2. What information does LGE obtain? When you first set up your LG Smart TV, you will be prompted to enter certain information, such as the country where the LG Smart TV is being set up and your zip code or postcode. This is to enable us to configure your LG Smart TV so that it displays the appropriate services and content for your region. When your LG Smart TV is connected to the Internet, during the set-up process and thereafter, we will receive certain information, including Device Information, that is needed to authenticate and set up your LG Smart TV, as well as power its basic functions. This information is necessary for the basic functioning of the Smart TV and does not require agreement with this Privacy Policy. However, in order to gain access to the full range of Smart TV services, you must agree to our Privacy Policy, which facilitates a greater exchange of information between your LG Smart TV and our systems.

The information that we may receive when you use your LG Smart TV falls into the following categories: 

Device Information. This refers to information collected about your LG Smart TV and certain related devices, such as your set-top box, remote control, and DVD or Blu-ray player. Device Information may include information to authenticate your LG Smart TV with our servers, the country code and zip code or postcode of the region where your LG Smart TV is being set up, your IP Address, device type (e.g., settop box, DVD player, etc.), MAC address (or in some circumstances, a truncated MAC address), software platform version, language, set-top box manufacturer, screen resolution, and model number.



Viewing Information. This refers to information about your interactions with program content, including live TV content, movies, and video on demand. Viewing Information may include the name of the channel or program watched, requests to view content, the terms you use to search for content, details of actions taken while viewing (e.g., play, stop, pause, etc.), the duration that content was watched, input method (RF, Component, HDMI) and search queries.



Basic Usage Information. This refers to information which records your interactions within the LG Smart TV, such as the menu items you click on, the apps you access (but not your activity within apps), what channels are available to you, and information regarding external devices connected to the Smart TV.



Voice Information. This refers to voice commands and associated data (such as information about the input device that records your voice) used to recognize and act upon the command, OS information, TV model information, content provider, channel information and service results.

As well as receiving the above information directly from your LG Smart TV, LGE may receive further information that you choose to provide in order to access certain LG Smart TV Services. For example, some of our services require that you become a member of LG Smart World, which may be subject to separate terms. You may join LG Smart World either through your LG Smart TV or by other means, such as through certain LG websites. This Membership Information may include your user ID, password, telephone number, name, date of birth, gender, email address, address, social networking service ID, security question answers, purchase history, and related payment information, such as credit card information or details of your PayPal account and more. Device Information, Viewing Information, Basic Usage Information and Voice Information are handled by LGE in such a way that members of your household are not generally identified or identifiable from that information, so such information is not generally “personal information." If you become a member of LG Smart World and are logged-in to LG Smart World when you use LG Smart TV Services, however, then certain Device Information, Basic Usage Information, Viewing Information, and Voice Information may be associated with your Membership Information in such a way that it may become personally identifiable to you. How will LGE use the information it obtains? We use information obtained from your LG Smart TV (both non-personal information and, where applicable, personal information) for various purposes, including:          

to provide our Smart TV services; to analyze, review and improve the products and services we offer; to understand how customers are using LG Smart TVs; to develop new products and services; to provide you with a user-friendly navigation experience; to protect and defend our rights and property, including by way of legal proceedings; to collect payment for content you purchase; for marketing; for internal record keeping; to deliver advertisements.

We may combine information obtained from your LG Smart TV Services, including personal information, with information that you provide to us by other means for the above purposes.

Depending on the country where you are based and the model of LG Smart TV that you own, LG Smart TV Services may include the following features; however, some of the features may have different names and may be combined with other features: On Now. On Now is an interactive program guide that provides you with program recommendations based on your interactions with your LG Smart TV and/or the aggregated actions of others. 3D World. 3D World is an online content service that provides access to paid and free 3D content. To access certain 3D World content, you must register for membership in LG Smart World. Live Plus. Live Plus recognizes the content you are watching and provides interactive services based on the content you’re watching. We may also use information collected via Live Plus to improve our products and your experience, and this information may be shared with third parties. SmartShare. SmartShare enables you to play media content from storage devices connected to your Smart TV. Search. You can search for content on your LG Smart TV. Information about the search queries you enter may be used to improve our search-recommendation services and search results. In addition, some LG Smart TV Services require you to become a member of LG Smart World. These include the LG Cloud service, which enables you to store content remotely via the internet, and certain social networking functionality that enables you to access and use sites such as Facebook and Twitter through your LG Smart TV. LGE reserves the right to add or remove services from its Smart TV services and to modify its Smart TV services from time to time. How we use Device and Basic Usage Information We use the Device Information and Basic Usage Information collected to provide you with LG Smart TV Services. We also use such information to improve and develop our LG Smart TV products and services from time to time. How we use Viewing Information We may collect and use your Viewing Information to power many of our Smart TV services, including On Now, 3D World, and LivePlus, and search as described above. Depending on which Smart TV service you are using, we may use your Viewing Information to provide you with recommendations of TV content that may be of interest to you, to contribute to aggregate statistics to determine the popularity of particular TV content, to serve you with advertisements for content, products, and services that may be of interest to you, to analyze how our services are being used, and make improvements to them. Apart from this Privacy Policy, you will be provided a specific opportunity to agree or disagree with the collection and use of Viewing Information. You may prevent the collection and use of your Viewing Information in connection with the Live Plus service by clicking the appropriate on-screen button in the Settings menu. Please note that if you do so, your Viewing Information will continue to be used for other LG Smart TV services (e.g., 3D World and On Now) unless you separately withdraw your agreement to LGE using your Viewing Information.

How we use your Voice Information Many LG Smart TVs come with a remote control or other input devices that can be operated using voice commands. We may use your Voice Information to power the voice activation used by the Smart TV or input device (e.g., remote control). If you do not agree to our use of your Voice Information then you will not be able to use the voice command and recognition features. Apart from this Privacy Policy, you will be provided a specific opportunity to agree or disagree with the collection and use of Voice Information. Please be aware that if your spoken word includes personal or other sensitive information, such information will be among the Voice Information captured through your use of voice recognition features. How we use your Membership Information Your Membership Information may be used in order to provide you with LG Smart TV Services that require membership of LG Smart World (LG Store). Your Membership Information may also be combined with Device Information, Viewing Information, Basic Usage Information, and/or Voice Information. Our use of Membership Information is more fully described in the separate terms that govern membership of LG Smart World (LG Store). Personalized Advertising We may display relevant personalized advertising on your LG Smart TV. Such advertising may be based on your Viewing Information (where we have your agreement to use Viewing Information), Membership Information, Basic Usage Information, your use of third party applications, advertisements that have previously been clicked on, and other factors intended to select advertisements that may be of interest. When displaying advertisements, we may partner with advertising companies and other business partners, who may receive your Viewing Information and may share with us information relating to the advertisements that they display on your LG Smart TV including, for example, the dates and times of advertisements shown, details of the advertisements shown, and your interactions with such advertisements. Apart from this Privacy Policy, you can choose at any time whether you want to receive personalized advertising by agreeing or disagreeing with the separate document entitled “Personalized Advertising”. If you have chosen not to receive personalized advertising, your LG Smart TV may still display advertisements in connection with the provision of certain Smart TV services. Those advertisements would be selected using non-personal information such as the region where your LG Smart TV is located, as indicated by your TV’s Device Information, and the content that your LG Smart TV is displaying. In addition, if the Live Plus service is on, you may see interactive overlays that invite you to purchase products or services in connection with the content you are watching. Information Sharing Generally, we do not share with third parties the information we receive as a result of you using LG Smart TV services. Nevertheless, please be aware of the following circumstances where we may share such information with third parties: 

When you use LivePlus, we may share certain Viewing Information, Device Information, and Basic Usage Information with third parties for advertising or analytics purposes and to enable the provision of information relevant to what you are viewing;



If you agree to our use of Voice Information, we may share your Voice Information with third party service providers who provide voice analytics to us, to enable our Smart TV services to respond to your voice commands and recognition;



To third party vendors that LGE may engage to provide services on its behalf from time to time, such as to collect payment for content you purchase or to fulfill customer service requests or to provide advertising services;



As required by court order or other government or law enforcement authorities in order to comply with legal process or law;



In connection with a corporate event, such as a merger or sale of all or part of LGE’s business I (including that of a division or subsidiary), where LGE may need to disclose information to a potential buyer and its professional advisers;



In order to protect and defend our rights and property, including by way of legal proceedings;



In order to protect the personal safety or property of our users or the public.

LGE may also share personal information and non-personal information (including Device Information, Basic Usage Information, Viewing Information, Voice Information, and Membership Information) with its affiliates and subsidiaries around the world for the purposes described in this Privacy Policy. Overseas Transfers We, our affiliates, subsidiaries, and suppliers may use information (including your personal information) in countries other than where your LG Smart TV is located in connection with providing you with our Smart TV Services and any other purposes outlined in this Privacy Policy. The data protection laws in many of these countries may not offer the same level of protection as those in the country where you are located. By agreeing to this Privacy Policy you expressly consent to us and our business associates and suppliers processing your data in any jurisdiction, including, without limitation, Korea and the United States of America, in accordance with this Privacy Policy. How long will LGE keep my personal information? We will keep your personal information for as long as is necessary for us to provide you with LG Smart TV Services or other purposes set out in this Privacy Policy. Cookie Consent A cookie is a small data file, which often includes a unique device identifier that is stored on your LG Smart TV. We may use a cookie to count how many times you may have seen a particular advertisement to try to make sure that you do not see it too many times. In addition, we may use a similar technology called a beacon to record details of your interactions with particular advertisements and to share these on an anonymous basis with our advertising partners. By agreeing to this Privacy Policy you consent to our use of cookies and beacons as described. Security We use commercially reasonable efforts to safeguard the confidentiality of your personal information. Nevertheless, due to the design of the Internet, ever-changing technology, and other factors outside of our control, we cannot guarantee that communications between you and our servers will be free from unauthorized access by third parties or that we will not be subject to security breaches. We do not accept any responsibility for the disclosure of personal information due to errors in transmission or unauthorized or unlawful acts of third parties. Protecting the Privacy of Children Protecting the privacy of children is important to us. For that reason, none of our Smart TV services are directed at anyone under 13 and they are not structured specifically to attract anyone under 13. We also do not knowingly collect or maintain personal information from users who are under 13. Should we learn or be notified that we have collected information from users under the age of 13, we will promptly delete such personal information. Changes to LGE’s Privacy Policy This Privacy Policy may be updated by LGE from time to time. If we make a material change to our Privacy Policy, we will update you via your LG Smart TV or other means. If you do not consent to the updated privacy policy, some Smart TV services may be restricted. 11.
