IPU-BAR: THE LEX FIESTA 2K16 MOCK JURY TRIAL (18TH – 20TH MARCH 2016) RULES AND REGULATIONS

I. AIM AND PURPOSE: The aim and purpose of this competition is to promote the skills of a criminal trial and to make the participants well versed with the jury trial procedure. The teams will get in-depth knowledge about the trial process and most importantly, the examination of witnesses as they make their case. So bring out your Allan Shore’s and Harvey Specter’s!!!! II. LANGUAGE: The language of the competition shall be English and no other language is allowed. III. DRESS CODE: All participants will be required to wear formal black and white clothes, as laid down in the guidelines of the Bar Council of India. This will include: a) White Salwar and Kurta or White shirt and black pant/black skirt along with Black Coat and Black Shoes for ladies b) White shirt, black trousers, black tie along with black coat and black shoes for gentlemen. IV. ELIGIBILTY: Participants should be currently pursuing their bachelor’s degree in law i.e. 3 Year LL.B. Programme or 5 Year LL.B. Programme.

V. TEAM COMPOSITION: due to the unique format of the competition, no more than 16 teams will be registered on a first come first serve basis.. a. Each team shall consist of a minimum of 2 and maximum of 4 members. This number cannot be modified under any circumstances. b. There can be 2 speakers and 2 researchers designated for each team. c. Teams have the option of designating two of its members to be speakers for the prosecution and the other two speakers for the defence. The team shall notify such an arrangement before the registration on the day of the competition. Such a team shall not, during any stage of the competition, rearrange the position of its members to form any new combination. d. Each team will be provided with a unique team code upon registration. The identity of the teams shall not be disclosed at any stage, such disclosure shall invite penalties including disqualification. The decision for the same shall be at the discretion of the Administrator.

VI. REGISTRATION: Date- The Last Date for Registration Is 5th March 2016. Form- The Registration Form is attached with the rules or is available in a separate Google form. Fees- There is no Registration Fees per se; the teams are requested to draw toques/Demand Drafts amounting to Rs. 1,500 per team in Favour of ‘Registrar, GGSIPU’ payable at New Delhi. New Delhi- 110078 IMPORTANT NOTE: THE SAID DEMAND DRAFTS OR CHEQUES SHALL BE RETURNED BACK TO THE TEAMS AFTER THE COMPETITION IS OVER, THE SAID DEMAND DRAFTS OR CHEQUES SHALL NOT BE ENCASHED BY US, SO IN EFFECT, THE REGISTRATION IS FREE. VII. FORMAT OF THE COMPETITION: Rule 1:Questions Regarding the Case Materials The Competition case materials consist of a fact pattern containing the following: 1. Statement of facts 2. The FIR 3. The Medico-legal Reports/ FSL Reports/ Expert testimonies 4. Witness Statements/Affidavits 5. Exhibits The witness statements/affidavits and any additional stipulations cannot be disputed at the trial. All questions and clarifications can be directed to the contact details as provided on the official website of the fest. Answers to questions will also be posted on the official website. The final posting will become the official supplemental memo and may be used in the competition. Earlier dated copies, however, cannot be used, if there has been any change/amendment. Rule 2:Additional Materials As regards case laws and authorities: The participants are allowed to cite and case laws, authorities, books or journals they wish to cite to make their case. Such authorities are to be presented to the court masters during the rounds. As regards compendium: The participants are allowed to submit a compendium of cases and authorities for the perusal of the judges. Such a compendium should be spiral bound and submitted before the round begins or during the round as per the convenience of the participants. Rule 3: Pleadings (Written Briefs): The teams are required to submit 5 spiral bound hard copies of the pleadings/briefs based on which they wish to argue in the court. It shall include: 3|Page

1. The cover page with the case title. (Blue for prosecution and Red for defence) 2. Index of Authorities 3. The Arguments Advanced (THE CITATIONS SHALL FOLLOW A UNIFORM METHOD) 4. The Prayer Font – Times New Roman size 12, footnotes size 10, 1.5 line spacing throughout. Note: 1. The hard copy of the pleadings would NOT entitle teams to additional marks. 2. The teams must send the soft copies of their pleadings before midnight of 14th March 2016 at: ‘[email protected]’ 3. The Briefs shall be consistent with the Code of Criminal Procedure, 1873.

Rule 3: the process of the rounds Opening statement by the prosecution followed by the defence Examination of witnesses by the prosecution and their cross examination Examination of witnesses by the defence and their cross examination Closing statement by the prosecution followed by the defence directed to the jury members Decision of the Jury Evaluation by the presiding judge(s). Participants should report to their assigned courtrooms at least fifteen (15) minutes prior to the starting time for each trial. If a team has not arrived within fifteen (15) minutes of the scheduled starting time, the mock trial coordinator may declare a forfeit. If there is an extenuating reason for the forfeiture, the coordinator, in his/her discretion, may attempt to reschedule the match. Rule 4:Preservation of Anonymity Participants should not wear or bring anything into the courtroom that could identify the name of their institution, or identify their own personal identity to any person. Any violation in this regard will result in instant disqualification. Such disqualification will be at the discretion of the organisers.

Rule 5:Costuming, Props and Material Used No costumes or props are permitted. If during a trial a student uses statements or items not included in the case materials, the opposing team should object and ask for a sidebar conference. The jurors will be informed of the violation by the mock trial coordinator and may consider such action in awarding win points. Rule 6:Time Limits Each team will get a total of 45 minutes to present their case for all rounds.        

Opening statement by the prosecution – 5 minutes Opening statement by the defence – 5 minutes Examination in Chief by the prosecution – 12 minutes Cross Examination by the defence – 20 minutes Examination in Chief by the defence – 12 minutes Cross Examination by the prosecution – 20 minutes Closing statement by the prosecution – 8 minutes Closing statement by the defence – 8 minutes

Each of the speakers shall conduct either the chief or the cross-examination and deliver either the opening or closing statement. Therefore each speaker shall compulsorily conduct an examination and deliver either the opening or closing statement. The order of speakers and the examination and statements they would present, is to be intimated by the teams before the commencement of the rounds and cannot be altered at any subsequent stage. Time violations will be considered by the jurors and may affect the verdict as passed by an individual juror. The time taken by a student attorney will be recorded by an official timekeeper, and the record of time taken will be revealed to both the jury as well as the sitting judge by the timekeeper at the end of every round. Rule 7: Witness and jury: We will provide the witnesses and the jury. The witnesses will be generally briefed and assigned by the administrator. However each team will have an opportunity to specifically brief their witnesses. The witnesses to be briefed will be assigned to each team at least 40 (forty) minutes prior to the commencement of the respective round. They Jury would not be briefed and would consist of law students as well as students from other fields.

Rule 9:Trial Judge’s Marking The presiding judge(s) in the court room would evaluate the teams out of a total of 90 marks based on the guidelines to be released with the moot proposition. The marking would be done on the basis of: Ingenuity, Application of law to facts, Authorities relied upon, Handling of witnesses in conducting the respective examinations, Adherence to pleadings amongst other factors which shall be notified upon registration. Rule 10:Juror’s Verdict and Marks The jury in the courtroom would be given certain guidelines and the position of law by the presiding judge after which the jury would either find the accused guilty or acquit him of all charges. The team in whose favor the jury votes would get an additional 10 points which would be added to the total of 90 marks given by the presiding judge. TOTAL MARKS = PRESIDING JUDGE (90) + JURY VERDICT (10) = 100 Rule 11:Announcing the Winner The decision of the trial will be announced at the end of the round by the presiding judge. However, this will be done only once the mock trial coordinator has fulfilled his/her duty of promptly double checking the arithmetic of the jurors and making necessary mathematical corrections, if any. It is only after this that the teams will be notified of the verdict, which will be the official result of the trial. Rule 12:Counsel and Trial Judge/Juror Contact Prohibited Teacher coaches, attorney advisors, students, parents and any other person associated with a mock trial team are absolutely prohibited from contacting jurors or presiding judges to question any scores or decision(s) by the jury. Any and all such questions should be directed to the mock trial coordinator. This rule will be strictly enforced. Penalty points up to team disqualification may be assessed by the mock trial coordinator for a violation of this rule. Rule 14:Scouting Teams shall not be allowed to observe the Oral Rounds of any other teams whatsoever. Scouting is strictly prohibited as per the Rules of the Competition. Scouting by any of the teams shall entail instant disqualification. Any team can file a written complaint to the Organizers for the same. The decision of the organisers regarding scouting shall be final.

IX. ACCOMMODATION AND FOOD: No accommodation or food shall be provided by the Institution. However, the teams shall be guided to decent and reasonable accommodations nearby the institution and food is available all over the campus.
