This book, in the first place, is the result of investigative reporting and monitoring with the purpose of revealing the standing position of regent election crisis of Sampang, Madura, East Java, for the period of 2000 – 2005. It is a general knowledge in Indonesia that in East Java, the role of Kyai (title given to a venerated scholar /teacher of Islam) as local-traditional elites play important roles in the conflict o interest in the election crisis of Sampang Regent (2000-2005). The Kyai have the dominant role in determining the political policies of PKB (Partai Kebangkitan Bangsa, Nation Rising Party) compared to PPP (Development Unity Party – one of the old Muslim party). The crisis began with the dissatisfaction of PKB on the process of regent election. Conceptually government system can be divided into three groups: Parliamentary Cabinet Government, Presidential Government, and Semipresidential Government (combination of the tow systems). In the course of history since its independence in 1945, Indonesia followed one of the two systems but not in the strict way. However, since Soeharto administration started in 1966 - 1998, Indonesia came into a new order system, which was an authoritarian government although in the beginning the government should be strictly based on the 1945 Constitution, however in the course of history the constitution had been deviated. This was the reason for the emerging of ‘people power movement’ in 1998 called Reform Era by thousands of students to force President Soeharto stepped down from presidential chair. After that, the amendment of the 1945 Constitution is unavoidable. So far the amendment has been done four times with some ‘anomalies’. Checks and balances has become one of main stressing in the amendments. The other important point in the amendments is the period of presidential term, restricted to two terms only.

Since the Reform Era in 1998 the constitutional journey of Indonesia as if started again from the beginning. From 1999 until 2002 the 1945 Constitution has been amended four times. In these amendments the Constitution has adopted new principles in constitutional system, starting from the division of power and check and balances up to solve ‘political conflict’ through legal resolution. Through the amendment of 1945 Constitution, People’s Consultative Assembly (MPR) has deconstructed itself to become Indonesian Legislative Assembly (DPR) and Regional Legislative Assembly (DPD).
