Homestay Agreement Form In the following agreement, the visitor from overseas, shall be referred to as the “Guest”. The host family shall be referred to hereafter as the “Host”, and the World Youth Uchinanchu Festival Executive Committee shall be referred to hereafter as the “WYUF Executive Committee”. The Guest will agree to abide by (and uphold) the terms and responsibilities outlined below for the duration of the homestay arranged by the WYUF Executive Committee. The WYUF Executive Committee will act as an agent between the Host and the Guest, but will not act on behalf or in the place of either party. The WYUF Executive Committee also does not offer, expressly or implied, any guarantees other than those expressly set forth herein, or and does not take on any responsibility other than those expressly set forth herein. About the Homestay program Please be sure that you have carefully read, understood and agreed to all the terms and conditions herein before pressing accept this Homestay Agreement Form (hereinafter referred to as “this Agreement”). 1.

Terms and Conditions

(1)A bed or futon will be provided for the Guest. (2)The Guest will be responsible for paying any personal phone charges, cleaning bills, purchases of everyday necessities and any expenses other than those set forth herein. (3)The Guest shall respect and comply with the rules of the Host’s home. (4)Anyone under 20 years of age is not allowed to smoke and drink in Japan. This is mandated by Japanese law. Those 20 years of age or older should abide by their Host’s house rules in regards to smoking and drinking. Responsibilities of the Guest 1-1

If the Guest intends to spend the night outside of the Host’s home and/or will not partake

in dinner or breakfast with the Host, the Guest shall contact the Host by the time agreed to beforehand. 1-2

If the Guest plans to go out other than with the Host, the Guest must inform the Host 1

beforehand and should also inform the Host of their contact information. 1-3

The Guest shall take full responsibility for all of his/her personal effects and valuables

during the homestay. The Host and WYUF Executive Committee will not be held responsible in the event of fire, natural disaster, robbery, or other loss of said belongings.

The Guest shall not:

(i) Let any other person stay overnight or live in the Guest’s room; (ii) Bring any dangerous or extremely heavy objects into the Host’s residence; (iii) Make excessive noise, emit unpleasant odors, make noise late at night or early in the morning, nor cause a nuisance to the Host and/or their neighbors.; 1-5

In principle, the Guest is responsible for purchasing travel insurance and medical

insurance. Neither the Host nor WYUF Executive Committee shall be held responsible for any injury, sickness, hospitalization or medical costs, et al. incurred during the duration of the homestay. 1-6

The Guest agrees that any liabilities or expenses including, but not be limited to,

hospitalization, use of doctors’ services and transportation, shall be borne entirely by the Guest. 1-7 The Host shall not be held liable for any accidents, damage, injuries, loss of possessions or personal items incurred by the Guest in connection with the homestay unless such accident is caused intentionally or by gross negligence of the Host. The Guest shall agree to reimburse the Host or WYUF Executive Committee for any damages caused by the Guest to the Guest's room. The WYUF Executive Committee shall not be liable for any of the above accidents or damages on behalf of the Guest. 1-8

The Guest understands that some host families may be hosting other guests

simultaneously. 2. 2-1

Responsibilities of the Host and Guest The Host shall provide the Guest with meals according to the homestay plan, as per the

custom of the Host. In the event that the Guest is out of the house during said meal times, the Guest shall contact the Host beforehand. The Host will not compensate nor reimburse the Guest in the event that a meal is not needed or if the Guest stays overnight, outside the residence of the Host. In the case that the Host is out of the house during the agreed meal times, the Host 2

shall prepare a meal for the Guest before leaving. All food other than those included in the homestay meal plan as well as food bought for sole consumption by the Guest are the Guest’s responsibility. 2-2

Unless there are valid reasons not to do so, the Host shall provide the Guest with towels

and bed linens on a regular basis, and shall also provide the Guest with the use of bath and/or shower facilities on a regular basis. 2-3

The Host shall not force the Guest to perform household chores or tasks, or to care for the

Host’s children. The Guest will be responsible for cleaning up after him/herself in the Host’s home (such as the Guest’s room, or the bathroom) and shall use the Host’s home with care. 2-4

The Host may, if deemed necessary, outline the house rules (such as meal times, curfews,

telephone usage, bath/shower time limits, trash separation, use of washing machine, etc.) in written form and explain them clearly to the Guest. The Guest shall adhere to the house rules. The house rules must principally be of the same standard as the Host’s, and any house rules that go against the terms of this Agreement will not be accepted. Any disagreements or problems with house rules inconsistent with this agreement shall be resolved using this agreement as a guide. 2-5

The Host shall not ask the Guest to pay for any living costs other than those outlined in

this Homestay Agreement. The Guest will avoid using the telephone and/or bath/shower facilities for long periods of time. Permission must be obtained from the Host before placing any international or long distance phone calls, and any such charges accumulated by the Guest shall be paid in the manner agreed on by the Host and Guest; the WYUF Executive Committee will take no responsibility in this matter. Furthermore, the Host shall not be required to pay for any miscellaneous costs other than those required by this agreement. The Host and the Guest shall mutually agree on the method of payments for the Guest’s meals when said meals are eaten outside of the home. Any insurance purchased to guard against the possible loss of property or other possible accidents or damages is the responsibility of the Guest. 2-6

The Host and Guest shall both respect the other party’s privacy. The Guest shall not enter

the Host’s bedrooms, showers, bathrooms, or any other rooms that are prohibited from entering without permission. Furthermore, the Host shall not enter the Guest’s room without permission while the Guest is away, provided, however, that the Host may enter the Guest’s room for security or safety reasons in case of an emergency such as a fire, earthquake, water leak, illegal intruders, or other such circumstances.

The Host and Guest, respectively, shall contact the WYUF Executive Committee, not a

third party, in the event of any trouble or circumstances that may arise between the Host and Guest that cannot be resolved amicably. The WYUF Executive Committee will do its best to assist the Host and Guest to resolve such issues. 3. 3-1

Responsibilities and Indemnification of WYUF Executive Committee The WYUF Executive Committee will makes the homestay arrangements and shall act as

an intermediary between Host and Guest. The homestay is an arrangement of mutual agreement between the Host and the Guest. Each Host and Guest shall have the rights to and responsibilities for interacting with the other party directly and shall settle any dissensions, troubles, or disputes directly with the other party. The WYUF Executive Committee will not be responsible for any rights and responsibilities (including any delay or failure to uphold any of the instated obligations) between the Host and the Guest nor will the WYUF Executive Committee have any obligation to settle dissensions or disputes between the two parties. 3-2

The WYUF Executive Committee shall not be held liable for any accident, injury, or loss of

possessions or personal items in connection with the Guest, regardless of the cause, during the homestay period. The Guest shall agree to reimburse the Host or the WYUF Executive Committee for any damages caused by the Guest to the Host’s home. The WYUF Executive Committee shall not be be liable for any of the above accidents or damages incurred by the Guest. 3-3

The WYUF Executive Committee shall provide the Host and Guest with a phone number

that is available twenty-four (24) hours a day for use in the event of an emergency. The WYUF Executive Committee shall have the right to provide the Host with the homestay application submitted by the Guest. 4. 4-1

Termination, Force Majeure, and Confidentiality In any of the following events, the WYUF Executive Committee shall have the right to

terminate the homestay period through a written notice given to the Host. In the event of termination of the homestay, the Guest shall remove his/her belongings and leave the residence of the Host immediately upon notice. (i) The Guest states inaccurate or untruthful information on the homestay application form. (ii) The Guest causes a a problem that cannot be settled/resolved amicably with the Host. (iii) The Guest commits a crime or an act in violation of Japanese laws, regulations, public order, morality, or public health. 4

In the event that the Guest leaves behind any of his/her belongings after the homestay

period expires or terminates, ownership of and entitlement to such belongings shall be forfeited and will be deemed as abandoned. The Host is entitled to dispose of said belongings in a manner deemed appropriate by the Host. 4-3

The Guest acknowledges and understands that neither the Host nor the WYUF Executive

Committee shall be liable for the termination of the homestay due to causes beyond the reasonable control of the Host or WYUF Executive Committee, including, but not limited to, natural disasters; the actions of governments or governmental authority, compliance with laws, regulations, or orders; fires, storms, floods, earthquakes, or tsunamis; wars (whether declared or not), rebellions, revolutions, riots, strikes, or lockouts. 4-4

The Guest agrees to hold in confidence any private information concerning the Host and

all confidential information in regards to the WYUF Executive Committee (hereinafter collectively referred to as “Confidential Information”). The Guest further agrees not to make any disclosure of the Confidential Information to any other party. The obligation under this clause 4-4 shall continue after the expiry or termination of the homestay. 5. 5-1

Miscellaneous Any communications between the WYUF Executive Committee and the Guest shall be

made in Japanese language or English language. In case the Guest contacts or communicates with Homestay in Japan in any other language, the WYUF Executive Committee shall not be under obligation to respond and shall not be liable for any delay in response. 5-2

This Agreement is written in Japanese and English. However, only the Japanese text of

this Agreement shall be regarded as an official text, shall supersede the English text, and shall be controlling in all respects in the case of any discrepancy. Personal Information Protection Policy The WYUF Executive Committee collects and uses the personal information of our guests for specific purposes, and does not collect or use any more personal information than is needed. ホームステイ同意書 以下、海外参加者(以下「ゲスト」といいます)、ホストファミリー(以下「ホスト」といいま す) 、世界若者ウチナーンチュ大会実行委員会(以下「実行委員会」といいます)と称しま す。ゲストは、実行委員会の手配によるホームステイの家に滞在している間は、以下の条件 に同意いたします。実行委員会はあくまでもホストとゲストの仲介を努めますが、実行委員 会は本同意書に明示的に定めるもの以外の他のいかなる保証もしません。 ホームステイについて 以下の内容をよく読み、本書記載のすべての条件を理解、同意した上でホームステイ同意書 (以下「同意書」といいます。)に「同意する」というボタンを選択してください。 1.

条件について

(1)ベッド、または布団が用意されます。 (2)電話代やクリーニング、日用品、嗜好品の費用、その他本同意書に記載のない費用は、 ゲストの個人負担となります。 (3)ゲストは、ホストファミリーの家庭内ルールを遵守して下さい。 (4)20歳未満の方の飲酒と喫煙は日本の法律で禁じられています。20歳以上の方は、飲 酒と喫煙については、ホストファミリーの家庭内のルールに従ってください。 ゲストの責任 1-1 ゲストは外泊、食事を摂らない場合は、ホストと決めた適度な時間において事前に伝 えます。 1-2

ゲストは外出する際に、ホストへ事前に知らせておく事とします。

1-3 ゲストは貴重品、持ち物全て、責任をもって自分で管理します。もし滞在中に災害や 盗難、紛失にあった場合、ホストや実行委員に責任は問わないことに同意します。 1-4

ゲストは以下の行為は行いません。 7

(i) 第三者を宿泊させず、または同居させること (ii) 危険物もしくは超重量物を持ち込むこと (iii) 著しい騒音を出し、不快な匂いを出し、深夜もしくは早朝に騒音を出し、その他ホス トもしくは近所に迷惑を及ぼすこと 1-5 ゲストは原則的に自己負担で海外旅行、医療保険に加入します。ホームステイ滞在中 に起こる怪我、病気、入院、治尾療などに対してホストと実行委員会は責任を負いません。 1-6 入院、医師の治療、治療のための交通費などについては、ゲストが全額自己負担いた します。 1-7 ホストは、ホームステイに関連してゲストが被った事故、損害や怪我、紛失物に対し ては、故意または重過失がない限り責任を負いません。ゲストまたはホストの部屋へ生じた 損害については、ゲストがホストに弁済いたします。実行委員は、これらの点について、ゲ ストのために、またはゲストに代わって責任を負うことはないものとします。 1-8 2.

ゲストはホームステイ先に複数のゲストが滞在することに同意いたします。 相互の責任

2-1 ホストは普段の家庭内の規定で、ゲストの食事プランの食事を提供します。もしゲス トが外出する場合などで、食事を取らない場合は、前もってホストファミリーに知らせます。 食事を取らなくてもその弁償はないことを承知します。ホストが外出する際は、ゲスト用に 食事を用意しておきます。上記のゲストの食事プラン以外の食料品、あるいは普段ホストが 購入しない食料品はゲストの自己負担です。 2-2 正当な理由がない限りホストは定期的にタオル、シーツ類をゲストに与えます。定期 的に適度にお風呂の使用時間をゲストに確保します。 2-3 ホストは、ゲストに子供の世話や家事手伝いを強制しません。自分の使用する場所(自 分の部屋やお風呂の使用後)は責任をもって整理整頓をし、きれいに保ちます。 2-4 ホストは必要であれば、文書にして家庭内の規則(食事の時間、門限、電話、お風呂 の使用制限、ごみの分別方法、洗濯機の使用方法等)を明確にすることができます。ゲスト はホストの規則に従います。規則の内容はホストの家族と同等でなければならず、この同意 書に反する内容は認めません。もし同意書に反する場合はこの同意書に基づいて問題などに 対処します。

ホストはゲストに洗濯、ガス、電気、お湯の使用代金等の請求をしません。ゲストは

長電話や長風呂をしないように心がけます。また国際電話・長距離電話の使用料の支払いは ホストとの同意の上で決められた通りに取り計らいます。このことに関して実行委員会は一 切責任を負えません。またホストは契約の範囲外でかかる費用は負担しません。食事を外で とる場合のゲストの費用はホストとゲストが合意するところによります。万が一ゲストが滞 在中に発生するかもしれない不祥事に備え、保険に加入するのはゲストの責任です。 2-6 ホスト、ゲストは、双方互いのプライバシーを尊重しなければなりません。ゲストは ホストの寝室、浴室、その他ホストが立ち入りを禁止した場所に無断で入りません。ホスト はゲストが留守の間、ゲストの部屋に無断で入りません。ただし、火事、地震、漏水、不法 侵入者、その他これに類する事象など緊急時には、安全上の理由から立ち入ることができる ものとします。 2-7 ホスト、ゲストは、双方の間において困難などが生じ解決できない場合、第三者では なく実行委員会に連絡します。実行委員会は、ホストとゲストがこれらトラブルを解決でき るよう援助する点で合理的な努力を払うものとします。 3.

実行委員会の責任・免責

3-1 実行委員会は、ホームステイ先を紹介しホストとゲストの仲介を務めます。ホームス テイはホストとゲストの双方合意に基づく取決めであり、ホストとゲストの間では、相互に 直接に権利を有し義務を負うものとし、相互の不和、問題、争いはホストとゲストとの間で 解決するものとします。実行委員会は、ホストとゲスト間の権利義務(義務の不履行を含み ます。)について責任を負わず、ホストとゲスト間の不和・争いの解決について何らの義務 も負いません。 3-2 実行委員会は、ゲストに関して生じた事故や怪我、紛失物に対して責任を負いません。 ゲストが原因でゲストの部屋で生じた損害については、ゲストがホストならびに実行委員会 に弁済いたします。実行委員会は、これらの点について、ゲストのために、またはゲストに 代わって責任を負うことはないものとします。 3-3

実行委員会はホストとゲストに緊急時と問い合わせ用に 24 時間連絡可能の電話番号

をお知らせします。また、ゲストが記入したホームステイの申込書をホストに提供します。 4.

ホームステイの早期終了・不可抗力・秘密保持

以下の事由が生じた場合、実行委員会がゲストに書面で通知することにより、ホーム

ステイ期間を早期に終了させることができるものとします。この場合、ゲストは、ただちに 自己の持ち物を撤去し、かつホストの住居から退去します。 (i) ゲストが、ホームステイの申込書に不正確または真実に反する内容を記入した場合 (ii) ゲストが、ゲストが引き起こした問題をホストとの間で円満な解決ができない場合 (iii) ゲストが、犯罪行為、または日本の法令、公の秩序、善良の風俗もしくは公衆の衛生 に違反する行為を行った場合 4-2 ホームステイ期間の満了または終了の後、ゲストが所有物を残置した場合、所有権を放 棄したものとみなします。この場合、ホストは自己が適当と考える方法で当該所有物を処分 することができるものとします。 4-3 ゲストは、ホストまたは実行委員会の合理的な制御を超える事由によって、ホームス テイの継続が不能となる場合があり、この場合ホスト及び実行委員会は、ゲストに対し責任 を負わないものとします。かかる事由には、天災地変、政府もしくは政府機関の行為、法律・ 規則・命令の遵守、火災、嵐、洪水、地震、津波、戦争(宣戦布告の有無を問わない)、反 乱、革命、暴動、ストライキ、ロックアウトを含み、これらに限定されません。 4-4 ゲストは、ホストに関するプライベートな情報及び実行委員会に関する秘密情報(以 下これらをあわせ「秘密情報」といいます。)を秘密として保持するものとします。ゲスト は、秘密情報をいかなる者にも開示しません。この義務は、ホームステイ期間終了後も存続 します。 5.

雑則

5-1 実行委員会とゲストとの間の連絡は日本語または英語によるものとします。ゲストが それ以外の言語で実行委員会に連絡する場合、実行委員会はこれに対して対応する義務を負 わず、または対応の遅れについて責任を負いません。 5-2 本同意書は日本語と英語で記載されていますが、日本文を公式な正文とし、英文に優 先するものとします。両者に齟齬が生じる場合、あらゆる点で日本文によって解釈されます。 個人情報の取扱いについて 第5回世界若者ウチナーンチュ大会実行委員会は、個人情報の取得、利用にあたっては、そ の利用目的を特定することとし、特定された利用目的の達成に必要な範囲を超えた個人情報 の取扱いは致しません。 利用目的 10
