STUDENT  –  PARENT  DEVICE  USE  AGREEMENT  /  POLICY     2015  –  2016     NOTE  :   In   this   agreement   "we",   "us"   and   “our”   means  Grapevine-­Colleyville  ISD  and  “you”  and  “your”  means   the   parent/guardian   and   student   enrolled   in   Grapevine-­Colleyville   ISD.   The   “property"   is   a   device   owned   by   Grapevine-­Colleyville  Independent  School  District.     Terms  :     You   will   pay   a  nonrefundable  annual  Device  Replacement  Protection  Plan  fee  of  $35  before  taking  possession  of   the  device.     You  will  comply  at  all  times  with  the  GCISD  Technology  Acceptable  Use  Policy  for  Students.     Failure   to   comply   may   terminate   your   rights   of   possession   effective   immediately,   and   we   may   repossess   the   device.     GRAPEVINE-­COLLEYVILLE   ISD   PROVIDES   THE   DEVICE   “AS-­IS”.   GRAPEVINE-­COLLEYVILLE   ISD   MAKES   NO   WARRANTIES,   EXPRESS   OR   IMPLIED,   OF   MERCHANTABILITY,   MARKETABILITY,   FITNESS   FOR   A   PARTICULAR   PURPOSE   OR   OTHERWISE,   EXCEPT   AS   SET   FORTH   HEREIN.   ANY   IMPLIED  WARRANTIES  ARE  EXPRESSLY  DISCLAIMED  AND  EXCLUDED.     Title:   At   all   times,   the   legal   title   to   the   device   is   maintained   by   Grapevine-­Colleyville   ISD.   Your   right   of   possession   and   use   is   limited   to   and   conditioned   upon   your   full   and   complete   compliance   with   this   Agreement   and   the   GCISD  Technology  Acceptable  Use  Policy  for  Students,  which  is  available  on  the  GCISD  website.     Electronic   resources   owned   by   the   District   should   not   be   released   to   anyone   including,   but   not   limited   to,   law   enforcement   agencies.   The   District   will   cooperate   fully   with   local,   state,   or   federal   officials  in  any  investigation   concerning   or  relating  to  violations  of  computer  crime  laws.  You  have  no  rights  of  confidentiality  when  using  the   device.   Contents   of   email,   information   regarding   your   Internet   usage,   and   network   communications   may   be   reviewed   at   the   sole   discretion   of   Grapevine-­Colleyville   ISD.   By   signing   this   Agreement,   you   further   acknowledge   that   Grapevine-­Colleyville   ISD   is   required   by   law   to   comply   with   the   Texas   Public   Information   Act.     As  such,  you  agree  to  fully  and  timely  comply  with  any  and  all  directives  issued  by  Grapevine-­Colleyville  ISD  in   its   efforts   to   comply   with   the   Public   Information   Act.   You   further   recognize   that   this   may   mean   that   email   content,   Internet   use   history,   network   communications,   and   other   similar   information   shall   be   released   to   third   parties,  if  so  required  by  law.     Warranty,  Loss  or  Damage:   Based   on   the   Texas   Education   Code   -­   Section   11.158,   the   School   District   may   require   payment   of   a  reasonable   fee,   not   to   exceed   the   actual   annual   maintenance   cost   for   the   use   of   technology   equipment.   If   this   fee   creates   a   financial   hardship   in   obtaining   a   device,   please   contact   campus   administration   about   your   eligibility   for   a   scholarship  to  cover  the  $35  nonrefundable  fee.   Included  in  the  nonrefundable  Device  Replacement  Protection  Plan  fee  of  $35  per  student,  not  to  exceed  $100     per   family,   you   will   be   supplied   with   a   basic   warranty   plan.   This   plan   provides   repair   or  replacement  coverage,   both   parts   and   labor   for   the   device,   battery,    USB  cable/adapter  and  up  to  one  incident  of  “accidental”  damages.   A   second   incident   of   “accidental”   damages   will   be   subject   to   a   $49   fee.   After   a   3  rd   loss,   student   may   lose   the   right  to  take  device  home.    

    If   the   device,   case,   cables,   and/or   cords   are   lost,   or   stolen,   you   are   responsible   for   the   reasonable   replacement   cost   on   the   date   of   loss.    Loss   or  theft  of  the  property  must  be  reported  to    the  Grapevine  Police  Department  at   817-­410-­8127.    Grapevine-­Colleyville   ISD   must  be  notified  by  the  next  school  day  after  the  occurrence,  and   a  copy  of  the  police  report  must  be  provided  to  the  District  at  your  child’s  campus.     Items  Not  Covered  by  Warranty:     ● Neglect,  or  deliberate  damage  of  device,  cables,  power  adapter,  and  case   ● Cosmetic  damages   ● Effects  of  normal  wear  and  tear   ● Third-­party  products  or  effects  that  may  damage  device   ● Recovery  of  software  or  data     Default:   If   you   do   not   fully   comply   in   a   timely   manner   with   all   terms   of   this   Agreement   and   the   GCISD   Technology   Acceptable   Use   Policy   for   Students,   including   the  timely  return  of  the  property,  Grapevine-­Colleyville  ISD  shall   be  entitled  to  declare  you  in  default,  and  take  possession  of  the  device.     Term  of  Agreement:   Your   right   to   use   and   possess  the  device  terminates  no  later  than  the  last  day  of  the  school  year,  unless  otherwise   stated   by   Grapevine-­Colleyville  ISD,  or  upon  withdrawal  from  Grapevine-­Colleyville  ISD.  Your  failure  to  return   the  property  in  a  timely  manner  will  be  considered  unlawful.       Indemnity  Provision:   You   shall   defend,  exempt,  indemnify  and  hold  harmless  Grapevine-­Colleyville  ISD,  its  officers,  agents,  servants,   representatives   and/or  employees  from  any  and  all  claims,  suits,  actions,  legal  proceedings,  demands,  damages  or   judgments,   including   all   expenses,   attorney   fees,   witness   fees,   costs,   and   costs   and   expenses   of   appeals   there   from,   arising   out   of   your   use   of   the   device   including,  but  not  limited  to,  your  intentional  or  negligent  acts  and/or   omissions.  This  paragraph  shall  survive  termination  of  this  Agreement.     I   understand   that   if   I   violate   any   procedures   or   rules   I   may   face   legal   or   disciplinary   action   according   to   applicable  law  or  District/departmental  policy.     Parent  Signature:  _____________________________________________ Date:    __________________     Student  Name:  _____________________________  Campus:    ___________________  Grade:    __________       *The  device  agreement  must  be  renewed  each  school  year.
