Editorial Reservation Policy: Need of Reforms and a Complete Review. During framing of the Constitution, reservation was among the most controversial and debated subjects to be included in the Constitution of India. Before Independence, Mahatma Gandhi was completely against any kind of “reservation” as he believed, truly Major like a visionary, that later it will Saras Tripathi become cause of division and strife in the society. This was the reason he had opposed “Communal awards” of the British PM, Ramsay Macdonald in 1932. Later, under Poona Pact with Dr B R Ambedkar, he had agreed for reservation within single Hindu electorate, only to save division within Hindus. However, at the time of framing of the Constitution, Article 15 (3) was included as an article that envisaged that any special provision may be made for women and children belonging to all social groups transcending caste, gender and religion, for their advancement and welfare in all fields. Under Article 15 (4), special provisions may be made for the advancement of any “socially and educationally backward class” and for the Scheduled Castes and the Scheduled Tribes. The "advancement" meant in any field and not clearly defined. The sub-clause (4) of Article 15 was inserted by an amendment in 1951. Article 16 (4) permits the state to make any provision for the reservation of appointments or posts in favour of any backward class, which, in the opinion of the state, is not adequately represented in the services under it. The expression "backward class" in this subclause is interpreted by the Supreme Court as "socially and educationally backward" as is specifically mentioned in the sub-clause (4) that was later inserted in Article 15. Today, when many communities are up-in-arms for their inclusion into “backwards”, it has become imperative to have a relook at the entire gamut of reservation policy. It is most noteworthy that the provision of reservation was only for initial TEN years that too only for SC and ST. Today, Patidars (Patels) in Gujrat, Marathas in Maharashtra, Gujjars in Rajsthan, Jats in Haryana and western UP are some of the prominent (not really backward) castes that are asking for reservation. It is estimated that during Jat agitation in 2016, Haryana alone suffered a damage of Rs 33,000 crore rupees. The strife is increasing day by day, where a new entity (caste) comes forward and asks for inclusion in the reservation category. Broadly, except Brahmins, Kshatriyas and Kayastha; almost all castes (partially or completely, in one state or the other) have been included into reserved category. The Supreme Court has placed a restrictive ceiling of 50%, not to be breached by the states, while giving reservation. But it has been flouted all over at will. Almost every month one or the other state comes out with a proposal to give reservation to one caste or the other or to one community or the other; particularly when elections are round the corner. Latest being government of Telangana that has proposed a 12% reservation for Muslims. It is noteworthy that such proposals/ provisions have been struck down several times by the courts. Following is the status of some of the states who have thrown in the wind the directions of the Supreme Court: • In Tamil Nadu, the total reservation is 69% for SC and 1% for STs, based on local demographics. • In Northeast India, especially in Arunachal Pradesh, Meghalaya, Nagaland and Mizoram, reservation for ST in State Government jobs is 80% with only 20% unreserved. In the Central Universities of NEHU (Shillong) and Rajiv Gandhi University, 60% of seats are reserved for ST students. • In Andhra Pradesh the reservation is reaching up to 66%, including 25% reserved for OBCs, 15% for SC, 6% for ST and 4% for Muslims. • In West Bengal, 35% of educational institute seats and government jobs are reserved for SC, ST, and OBC (22% SC, 6% ST, 7% for OBC A & B). In West Bengal there is no reservation on religious basis but some economically and educationally backward Muslim castes (basis surnames pertaining to different profession e.g. cobbler, weaver etc.) have been included along with their Hindu counterparts in OBC list namely OBC A and OBC B, in both lists caste from both communities are there. There is no reservation granted on the basis of religion in the Central educational institutions at the national level, although reservation has been extended to religious minorities in some states. The Tamil Nadu government has allotted 3.5% of seats each to Muslims and Christians, thereby altering the OBC reservation to 23% from 30%. The Government of Andhra Pradesh introduced a law enabling 4% reservations for Muslims in 2004. This law was upheld by the Supreme Court in an interim order in 2010 but it constituted a Constitution bench to look further into the issue. Public Service Commission of Kerala has a quota of 12% for the religious minority (Muslim or Christian). However, educational institutes run by minority institutions have 50% reservation for Muslim or Christian, as the case may be. This effectively leaves only 50% for Hindus and within that only 25% to the most meritorious: the so called “general category” candidates.The worst suffers are so called “upper castes” constitutionally renamed as “general category”. Many of them are worse than the so called Dalits and OBC. It is estimated that 40% of the sanitary workers (cleaning latrines and toilets) in “Sulabh International” are Brahmins of Bihar and eastern UP. Majority of the lowly paid, malnourished and impoverished security guards working in Metros, under private agencies are so called “upper caste” people. They are fighting multiple battles: poverty, illiteracy, lack of access to costly modern education, no support from the “State”, that is supposed to the “welfare state” for all but discriminates on the ground of their birth. They are suffering for the crime they have not committed and have no control over: that is their birth in a particular caste. Today the state of affairs is so bad that if one could choose, many would like to be born as “backwards”.

Gurugram school and the rape of a minor girl by a school attendant in Delhi, an official of the Directorate of Education (DoE) said. "The checklist has been designed to encapsulate the minimum standards of school safety to emphasize zero tolerance against any violation in this regard. Practicability of implementation and

monitoring has been kept duly in mind," a senior official of the DoE said. Among the points listed are school safety committees, monthly safety walks to identify loopholes in security in the premises, securing boundary walls with grills, CCTV surveillance, maintaining records of every entry into the school and restricting vis-

itors. "All toilets should be well lit and have easy release lock from inside and no lock from outside. There should be no deployment of male staff in toilets for primary classes and all toilet visits of students up to Class II should be surpervised by a woman caretaker," the guidelines state. The guidelines have

been issued to all schools in the city. The government has also directed that prior written consent be sought from parents for allowing children to stay back post-school hours and co-curricular activities held beyond school timings be supervised by, at least, two teachers.Schools have also been asked to ensure cyber security in accor-

dance with existing cyber and IT laws. This includes installation of firewall, filtering and monitoring mechanisms in all computers in the school premises, regular review of filtering and blocking policies and procedure and ensuring that children use computers under the supervision of teachers.

The roots of the crisis in the seed industry Ram Kaundinya For many decades, the Indian policy framework facilitated the interaction of science and innovation with entrepreneurship, which led to competition and the subsequent development of an industry structure that delivered sustainable economic benefits. The government was a major contributor to investments in seed research in India for close to three decades after independence. Policy reforms like the New Policy On Seed Development (1988) and New Industrial Policy (1991), and advances made by science and technology, provided an impetus to the participation of the private sector in the Indian seed industry and private investments helped India benefit from hybrid seed technology and biotechnology. However, according to the Rabobank report (2006), India’s top 10 seed firms accounted for just 25% of the total volume of seeds sold by the private sector in 2005. This level of fragmentation was aided by the low entry barriers. Historically, intellectual property (IP) had no sanctity in the industry. Some of the staff of seed companies had free access to the most vital intellectual property of the company, i.e. the germ plasm and the parent lines. People could easily start a new seed company with the freely available parent lines. Many seed-producing farmers also set up seed production companies. Consequently, research investment by private companies remained at a meagre 3-4% of revenue against the international norm of 10-12%. Investment by the public sector in seed research continued. A steady formal and informal flow of material from public institutions to private entrepreneurs continued. There was no IP law for the seed industry till The Protection of Plant Varieties and Farmers’ Rights Act (PPVFRA), 2001, came about. In the preamble to the Act,

the government said this law was intended to promote research in, and creation of, intellectual property in the seed sector. In a 2014 paper by David Spielman et al, it is argued that science, technology and innovation play a central role in driving change in the industry. Adoption of new technology leads to the creative destruction of old players and systems, pushing forward technological frontiers. They quote Joseph Schumpeter (1934), who posited that innovation by large firms through temporary monopolies or other forms of market power leads to technological reforms and appropriate gains, albeit with short-term consequences for social welfare. In the long run, technological change and economic growth result from the continuous entry and exit of entrepreneurs who innovate on production processes and secure advantages that force the exit of older, obsolete firms from the market. This is an accurate conceptual summary of the impact created by genetically modified (GM) seeds technology, which disrupted the existing industry structure in India. Forty-five Indian seed companies got a licence to use the technology and participated in the explosion in the Indian cotton market. These changes led to a temporary monopoly for the technology provider but the policy framework had the opportunity to help society reap long-term economic benefit by enabling the industry to absorb and exploit the new technology. Sadly, the policies of the Central and state governments fell short of the required visionary approach.First, no steps were taken to encourage competition in the sector. Existing technology providers continued to enjoy a monopoly. Second, the government stifled further research investment by controlling prices, dictating licensing terms and confusing IP laws between different Acts. Third, timely actions were not taken to prevent the illegal introduction of GM technology

Gujarat polls: NCP to contest all seats, talks with Cong fail Ahmedabad, November 20 The Nationalist Congress Party (NCP) on Monday said it would contest all 182 seats in the Gujarat Assembly elections, after talks for alliance between the Sharad Pawar-led party and the Congress failed. In 2007 and 2012, the NCP and the Congress had fought the state elections in alliance. In the present Assembly, the NCP has two MLAs. The Congress alleged that the alliance broke down because of the NCP’s demand for more seats than it should have in the prevalent situation in the poll-bound state.Senior NCP leader Praful Patel said, “We will fight on all 182 seats. We will release our candidates’ list on Monday.” “I think it would be better for us to fight on all the seats on our own than in alliance with the Congress,” the former Union min-

A quick and decisive action in collaboration with state governments to identify and take over fields where illegal GM cotton is being grown. 2. Agree on a national policy on GM crops, define the exact areas where GM is required by the country and where the government will encourage public and private investment in GM technology. This will bring greater clarity and remove the current policy paralysis. 3. A quick resolution to the conflicts between the different IP laws that are affecting this industry and clearly defining how the government wants to encourage research investment with assured IP protection in this important sector. 4. Invest in educating the public about the facts regarding GM technology and stress on its critical role in enhancing agriculture productivity and its benefits to farmers and consumers. 5. Strengthening the regulatory mechanism for the seed and biotech industry to make it transparent, sciencebased, predictable and fair. These actions will bring back normalcy and establish predictability in the system. The implications of not doing so could be very damaging to the seed and biotech industry, with the Indian farmer and the consumer being the ultimate losers.

Zuckerberg’s wanting to eradicate, manage or control all disease, for instance, is not philosophically very far removed from his wanting to connect the world. Such ambition has benefits. Take the US. It is the most charitable country in the world as a percentage of gross domestic product, and therefore, given the size of its economy, in terms of volume. Last year, it saw almost

$400 billion given for philanthropic purposes. The bulk of this, by far, comes from megadonors. A move towards longterm global agendas in areas such as vaccination, malaria eradication and primary education, driven by rigorous data analysis—randomized control trials have become the gold standard over the past decade or so— stands to maximize value for money and minimize opportunity costs. India is a good example of another important benefit. Individual philanthropy here has grown rapidly over the past decade, outstripping corporate social responsibility funds and foreign aid handily. Bain’s “Indian Philanthropy Report 2017” notes that individual philanthropists contributed Rs36,000 crore in 2017, a sixfold increase from Rs6,000 crore in 2011. These donations account for an increasingly substantial chunk of total development expenditure. Designing this philanthropic intervention for maximum impact is essential.
