Welcome to East Verde Park The East Verde Park (EVP) community welcomes you to our small neighborhood nestled in the Tonto National Forest five miles north of Payson. East Verde Park is a place where you can live and play, enjoying nature’s bounty and the association of friends and neighbors. The purpose of this welcome brochure is to assist both homeowner and resident in finding your way around and to help you understand the business and activities of the community.

The community has an active Association, East Verde Park (EVP), Inc. an Arizona corporation, having the purpose of managing EVP common properties and promoting the welfare of its members. Property owners at East Verde Park are members of East Verde Park, Inc., as defined in the Articles of Incorporation and Bylaws of EVP, Inc. Our community is also served by EVP Firewise, which promotes fire-safe practices for our wildland community and sponsors activities such as brush clean-up and brush dumpsters, and the EVP Fire District, a Gila County legal entity that provides for the fire protection of our community You are encouraged to become an active participant of the EVP community, through support of EVP Inc., EVP Firewise, and EVP Fire Board. History of East Verde Park East Verde Park land was assigned to the Tonto Apaches as a mine reservation by the federal government and the Bureau of Indian Affairs. Eventually, most of the Indians left to work and live in the vicinity of the town of Payson until there was only one woman left, Della Cabballachia. The land was purchased by Ray Blevins through the Bureau of Indian Affairs, Pima, Arizona office. The deed was signed by President Franklin Roosevelt for Congress on January 15, 1943. Any sale of the property by Blevins isn’t clear. However, in 1955 a Mr. Orloff and a Mr. King subdivided the East Verde Park property into Lots 1 to 157 north of the River, and Tracts A, E, and F. Shortly thereafter, Tract A was subdivided into Lots 158 to 201 south of the river, and Tracts H and J, which encompass the EVP river properties. Also in 1955, the original “Reservations and Restrictions” were recorded. As sales increased, three large lots at the northwest corner of EVP were further subdivided. Lots 155 and 156, were subdivided into the 15 lots of the “King” addition in 1957, and Lot 157 was subdivided into the 9 lots of the “Orloff Palisades” addition in 1958. Further subdivisions and undivided portions of Tracts B,D,E,F,H, J, plus some of the original lots joined or divided, result in a total of 263 parcels in EVP recorded with Gila County, as of 2015. In July, 1966, the area was incorporated as East Verde Park Inc (EVP), which is referred to as the “Association”. The original Articles of Incorporation specified a 25-year duration of EVP, Inc., subject to renewal in accordance with Arizona Revised Statutes. Therefore, in 1991 the Re-stated Articles of Incorporation were recorded, and provided for the perpetual existence of the Association.

East Verde Park Community and Activities The EVP community is located west of State Route 87, a convenient 5 miles north of the Town of Payson. EVP is most easily accessed via East Verde Estates road, near mile marker 158 on State Highway 87, just south of the highway bridge over the East Verde River. Prior to entering EVP, East Verde Estates Road passes two day-use recreation areas maintained by the US Forest Service. No overnight camping is allowed at these recreation areas. The road crosses the river via a raised roadway built over four large culverts, known as the “First Crossing”. The entrance to EVP is about one-quarter mile west of the first crossing. The primary subdivisions of EVP are recorded in Plats 144, 148, 196, and 209 of Gila County. East Verde Park community consists of roughly 264 parcels, of which 163 contain residences. EVP property residents include a mix of full-time and part-time residents, and a number of renters as well. The assets of EVP Inc. (the Association) include the riverfront property on both sides of the East Verde River which runs through East Verde Park. The association also owns the EVP clubhouse, which is the gathering place of the community for meetings, potlucks, and private events on a rental basis; and the EVP library, which is well stocked with books, videos, puzzles, and includes a lovingly decorated children’s room. The jewel of EVP is the East Verde River, which runs through a lush riparian belt forested with cottonwood, sycamore, and pine trees, as well as other native plant species. The riverbanks are private property of EVP, Inc. and are closed to the general public, but available to EVP members, residents, and guests, for hiking, bird watching, fishing, and just enjoying the beautiful scenery of EVP. The residential areas on the north and south side of the river are connected by a concrete roadway with water flowing over it, known as the “Second Crossing”. The roadway acts as a shallow dam, forming a pond about 100 feet wide x 400 feet long. The river is seasonally stocked With trout and bluegill. A valid Arizona fishing license is required.

Note that both the first and second crossings are occasionally flooded. The river can undergo flash floods that arise quickly, and at such times can be dangerous or impossible to cross. Always use caution and don’t take unnecessary risks. Flooding of the East Verde River at the Second Crossing

Access to the National Forest and wilderness areas to the south and west of EVP is through a locked gate at the end of Wayne Drive. The forest service roads provide access to Highway 87, and the natural attractions and recreation opportunities of the Tonto National Forest. Hiking, mountain biking, dirt biking, and 4-wheeling are prime activities. A hike or ride westward on the Crackerjack Mine road is interesting and scenic. Always be aware that you are in the wilderness, and be prepared with weather-appropriate clothing, water, and emergency supplies. Adhere to all forest service and county rules for motorized vehicles. Please always close and lock the gate to avoid general public traffic through our neighborhood. EVP is an excellent place to make your headquarters for excursions into Arizona’s high country. The Tonto Natural Bridge and Fossil Creek are awesome attractions northward on Highway 87, as are the towns of Pine and Strawberry with their country charm and frequent festivals. Further to the north, or east past Payson on SR 260, the high elevations of the Mogollon Rim offer alpine scenery, forest lakes, boundless camping, and winter sports. Heading south on Highway 87, Roosevelt Lake in the Tonto Basin is easy to access with multiple camp grounds and boat launches for water sports and fishing. And of course, nearness to the Town of Payson allows you to enjoy your EVP property surrounded by National Forest, while having easy access to city amenities, including groceries, hardware and construction materials, shopping, schools, and dining. Unique activities in Payson include the Mazatzal Casino; the Payson Rodeo (known as the world’s oldest continuous rodeo) in September; July 4th fireworks at the lovely Green Valley Park; and the Saturday farmers’ markets at the Sawmill Crossing Plaza. Membership in EVP, Inc. By definition in the Articles of Incorporation of EVP Inc., all owners of record at EVP are members of EVP, Inc., which is also known as the Association. Members in good standing (ie: dues are current) are entitled to cast votes for the Board during the Spring community meetings, and any motions that are brought before the community at both the Spring and Fall community meeting. In addition to participating as members of the Association. You are encouraged to Page 3

consider becoming a board member. With annual elections, the opportunity comes up every May. Positions are President, 1st Vice President, 2nd Vice President, Treasurer, Secretary, and up to four directors. Our community is what we make it. All members are encouraged to become involved in community issues and activities.

Potluck Dinners In May and October, on the days of the Annual and Semi-Annual community meetings, a social hour and potluck dinner is held, with the Association providing burgers and hotdogs, grilled to perfection by the most capable Board member. The EVP tradition is to minimize cleanup and simplify logistics by having attendees bring their own plates and utensils. But if you forget, that’s OK—supplies are available at the clubhouse. Also, bring your own beverage. Feel free to bring some to share—some of our EVP residents are excellent brewers and vintners! New members are always welcome (and seldom embarrassed). The potlucks are a great way to meet your neighbors and stay current on community events.

EVP Inc. Annual and Semi-Annual Meetings of Members (aka Community Meetings) The Spring community meeting is held the Saturday of Memorial Day weekend in May, at 1:00 PM, and is known as the Annual Meeting. Business at the annual meeting includes review of the previous fiscal year-end financial status, review of the current fiscal year budget, committee reports, elections for the EVP Inc., Board of Directors, Firewise and Fire Board reports, and any business brought before the Membership from prior board meetings or by any member. The Spring Newsletter announcing the Annual Meeting is sent by mail to all EVP members, based on the property ownership records of Gila County. Enclosed with the newsletter is the annual dues billing for the fiscal year (April through March), as well as a proxy form that can be used by any members who may not be able to attend the meeting. The proxy is important to establish a quorum for votes. Dues are payable prior to, or on the day of, the Annual Meeting. Members whose dues are current are considered to be in good standing and are entitled to vote in the elections and on any motions brought before the community for a vote.

The Fall community meeting is held the third Saturday in October, typically at 1:00 PM, and is known as the Semi-Annual Meeting. Business at the semi-annual meetings is similar to the Spring Annual Meeting, except without Board Elections. The semi-annual meeting is announced in the Fall Newsletter. Page 4

Annual Rummage Sale The annual EVP rummage sale is held in early June of every year. All proceeds go towards projects for the benefit of East Verde Park. The rummage sale is second only to dues as the largest fundraiser for EVP. Donated items are accepted at the Clubhouse during the week before the event. This is a great event that allows us to do some spring cleaning and put the old stuff to good use for our community. Community Clean-Up Days Community clean-up days are scheduled as needed – generally one in the Spring and one in the fall. The purpose of these events is to clean EVP’s common grounds of unwanted debris and brush and other vegetation. This is a critical event, as EVP is a rare natural resource that we must constantly protect from the dangers of wildfire. The clean-up events are typically held in coordination with the EVP Fire District and EVP Firewise, to make use of a delivered dumpster or other means of disposal. Volunteers are always needed! It’s a great way to get some exercise and fresh air and pal around with your fellow EVP volunteers.

Volunteer Committee Leadership The EVP community runs on volunteers. Committees of EVP include: • Library Committee—keeps the library organized and tidy • Clubhouse Committee—keeps the clubhouse tidy and coordinates any rentals • Health, Safety, and Roads—focal point for health, safety, and roads issues. Liaison to the County on road maintenance in EVP. • Water—spokesperson for EVP to the water utility and the Arizona Corporation Commission. • EVP Spirit Committee—organizes events and activities to bring the community together by having fun, building relationships, and volunteering. We’d love to have you join us in service to our community.

Entities of East Verde Park There are three entities in EVP that operate for the benefit of EVP owners and residents: 1. East Verde Park, Inc. 2. East Verde Park Fire District 3. Firewise, East Verde Park Inc. All three entities have Boards with are comprised of volunteers of the EVP community. There is often cross-over between volunteers of each of the entities because they all draw from the same pool of resources—the residents of EVP. Each entity has a specific purpose.

East Verde Park Inc. East Verde Park Inc, referred to as the Association, is an Arizona corporation, registered with the Arizona Corporation Commission (ACC). The ACC file number for EVP Inc. is 0069324-6. EVP Inc. is a non-profit corporation under the laws of Arizona with no power to issue stock. The Association’s purpose is to manage the properties owned by the corporation, and to promote the health, safety, and welfare of its members and residents. Membership & Meetings of Members (also known as Community Meetings) All owners of EVP properties are members of EVP Inc, as defined in the Articles of Incorporation and Bylaws. As explained in the previous section of this handbook, EVP Inc. holds its Annual and Semi-Annual meetings of members in May and October, respectively, after announcement by mail to all owners of EVP property as recorded in Gila County records.

Board of Directors EVP Inc, is governed by a Board of Directors. The elected officers consist of President, First Vice President, Second Vice President, Secretary, Treasurer, and up to four Directors. All elected board members must be members in good standing with voting rights. Board Meetings In addition to the community meetings, the board meets at least bi-monthly, typically on the third Saturday of the month at 9:00 AM at the EVP Clubhouse, to conduct the routine business of EVP Inc. All members are welcome to attend board meetings to provide input and raise issues, but votes at the board meetings are within the board only. Page 6

EVP Inc. Membership Dues All members with dues paid up are considered in good standing and entitled to vote. However, the main reason for dues is to fund the obligations of EVP Inc, including taxes and insurance of the common EVP properties. Dues also fund the maintenance of our properties and administrative costs such as office supplies and postage for the mailing notices required by the Bylaws. The next page provides a “friendly reminder” on the importance of member dues. EVP Inc. Governing Documents The governing documents of EVP Inc. are the Articles of Incorporation and the Bylaws. These documents set forth the purpose of EVP, Inc., and the rules by which the Association operates. Following is a synopsis of these documents:

Re-Stated Articles of Incorporation The minimum document to establish a corporation in Arizona is the Articles of Incorporation, which state the specific powers, objectives, and purposes of the Association, its Board, and its Members. These include: • Perform all duties and obligations of the Association as set forth in the Declaration • Fix, levy, collect, and enforce dues. • Pay expenses and obligations incurred by the Association, including taxes. • Adopt bylaws and rules and regulations relating to the operations of the Association, including managing properties, election of Board of Directors, etc. • Define “Members” as owners of record of lots in the EVP subdivision. The original Articles of Incorporation of EVP were recorded in 1966, and established a 25year duration of the Association, in accordance with Arizona law at that time. Therefore, in 1991 the Articles of Incorporation were restated and revised. The re-stated Articles provided for the perpetual existence of EVP Inc. Bylaws Key provisions of the Bylaws include: • Further clarification beyond the Articles of Incorporation, regarding definition of members and voting rights. • Further clarification beyond the Articles of Incorporation, regarding dues, special dues for extraordinary expenses, and enforcement of dues. • Definition of the frequency, purpose, quorum requirements (including proxies), etc. of board meetings and meetings of members (aka: community meetings). • Rules for the number of board officers and directors, election of board members, term of office (1 year), and vacancies. • Definition of the duties of the officers of the Board. • Authority of the Board to execute contracts, establish budgets, manage finances, and maintain records. • Rules for amending the Bylaws. The bylaws of EVP Inc. came into effect in August 1986, and were last amended in 2006. Copies of the Articles of Incorporation and Bylaws may be obtained by requesting it directly from any Board Member. They have also been posted to the EVP Facebook page and website. They are also available from the Arizona Corporation Commission, with a fee charged for certified copies. Page 7

East Verde Park Fire District The East Verde Park Fire District, commonly known as “Fire Board” is a Gila County legal entity administered by an elected board of five members who are empowered to budget and dispense monies as needed. Funding for the EVP fire district is by a property tax line item. The EVP Fire District has contracted with the Town of Payson Fire Department for fire protection and medical emergencies. The Fire Board acts as liaison with the Town of Payson Fire Department. The Board also advises on potential fire hazards to EVP Inc. The Fire Board also works with Firewise and EVP Inc on the renting of dumpsters, arranging for curbside brush pick-up, and other activities to reduce fire risk at EVP.

Firewise East Verde Park Inc. In August 2006 the EVP Fire Board and the Association voted to support the formation of EVP Firewise. The Firewise Board held its first meeting in September 2006, and began to work toward becoming a named Firewise community by the Firewise Communities USA organization. With this process, EVP was assigned a representative from the Arizona State Land Department to assist in assessing Firewise needs in our community, and to provide guidance, direction, and technical information to aid in improving forest health and fuel reduction treatments within our community. The Firewise Board submitted the EVP Firewise plan in November 2006, which was approved in December 2006. Goals of EVP Firewise include: • Thin brush and trees from around homes and community property • Encourage homeowners to sing up for a Wildland fire assessment • Establish community clean-up events with a dumpster available • Hold an annual Firewise Day and reapply annually for Firewise status • Where property around the community backs up to the Tonto National Forest, work with the Forest Service to get the forest properly thinned. • Improve the evacuation route from the south end of the community to exit via Crackerjack Road. • Work with Payson Water Company to negotiate an agreement for use of their water tank for fire fighting. • Explore the possibility of better use of the river for fire fighting • Work with Gila County to explore a program which would provide maintenance and emergency assess for all the roads in East Verde Park • Work with the County and Forest Service to improve the roadway at the first crossing to install a two-lane bridge. • Encourage all EVP residents to develop an evacuation plan in accordance with the “Ready-Set-Go” guidelines of Firewise USA. Thanks to the efforts of the Fire Board and Firewise, the Public Protection Risk Classification, commonly known as the ISO Rating, for EVP was lowered from 8 to 4 (lower is better). Key factors were the responsiveness of the Payson Fire Department and the strong Firewise program at EVP. This is a very good risk score for a wildland community, and helps assure continued insurability of our properties at EVP. Page 9

Assets of the Association Riverfront Property The premier asset of the Association is the riverfront property on both sides of the East Verde River. To provide for the ongoing conservation of this area the Association established the EVP Riverfront Property Management Guidelines. A synopsis of these guidelines: • All riverfront property in East Verde Park is private property owned and governed by EVP, Inc. • A majority of the members voted in October 1999 to retain the property as a “natural riparian area”, as documented in the “EVP Riverfront Property Management and Use Plan”. • Specific regulations included in the Riverfront Plan include authorized activities: Hiking, jogging, fishing, bicycling, photography, painting, swimming, and picnicking. Unauthorized uses include: equestrian activities, driving motorized vehicles, personal bonfires or campfires, cutting of live trees and vegetation, and placing of personal property such as chairs, tables, benches, hammocks, swings, boats, or clotheslines.

EVP Clubhouse The EVP Clubhouse is the Association’s meeting place. All Board Meetings, Member Meetings, and Potluck Dinners are held at the Clubhouse. The Clubhouse has a kitchen, banquet tables, and outdoor charcoal grill. The Clubhouse has Wi-Fi service available. Additionally the clubhouse is available for use by EVP members for a nominal fee per event-day, plus a cleaning deposit. Contact an EVP Board member to arrange rental of the clubhouse or get the Wi-Fi Password. Clubhouse Use Fees • $60/day for Paid Members • $85/day for Unpaid Members • $60 cleaning deposit

EVP Library The EVP Library, located at the corner of Nellie and Eleanor, is maintained by volunteers within EVP. There is a significant collection of donated books, magazines, videos, and journals in the library. There is also a very impressive “Kids Korner” Contact an EVP Board member to obtain a library key.

Utilities The information below is provided as a convenience to EVP owners and residents, and does not imply endorsement of any public utility or business by EVP Inc. While an effort has been made to provide comprehensive information, there may be other public utilities and businesses not listed herein that are able to provide the noted services.

Water Payson Water Company (PWC), a subsidiary of JW Holdings, provides water service to EVP. PWC is a private water company, not affiliated with the Town of Payson. They operate 3 wells in the community, treat the water, and store it in the tank at the corner of Nellie and Eleanor, across from the library, before distributing it to users. Contact Payson Water Company at 1-888-644-6771, or email [email protected] In 2014, after a complicated and lengthy rate case at the Arizona Corporation Commission, PWC was granted a significant rate hike for the communities that they service. At EVP, this also included provisions for water hauling fees during the months of May to September. The water conservation stages are posted at the entry to the community. The water stage definitions and associated fines are as follows:

Private Wells Some EVP residents obtain their water from private wells. There are a number of well drilling companies and consultants in the Payson area who can assist. Note that there is a wide range of well productivity throughout EVP—some wells are very productive and others are not. Drilling a private well entails some risk of high expense with little or no water output. Electricity Arizona Public Service (APS) provides electricity at EVP. Contact them at 800-253-9405 or website www.aps.com. Page 12

Telephone Century Link provides local land line phone service: 1-800-244-1111 (billing & customer service) or 877-348-9005 (troubleshooting & repair), or website www.centurylink.com Garbage Pick-Up and Disposal Various Companies in Payson provide trash pick-up. Current vendors include Road Runner at 928-474-0603 and Waste Management at 928-474-1214. Recycling Recycling is encouraged. Although recycling service is currently unavailable at EVP through local waste disposal vendors, dumpsters are located in Payson at Wal-Mart and Green Valley Park for newspapers and other materials. Local providers include: • Alliant Gas (formerly Energy West): 928-474-2294 or website www.alliantgas.com • Ferrellgas: 928-567-6806 or website www.ferrellgas.com Internet Access Internet access is currently available through dial-up, satellite, and local wireless highspeed service. • Pointe Wireless maintains an antenna at EVP. 928-970-0377; www.pointewireless.com • Exede Internet provides service via satellite. 866-867-0315; www.exede.com. • A number of companies provide dial-up internet service via your telephone land line. One such company is Earthlink. (866) 406-4585; www.earthlink.net/dial-up • Note that although Century Link, the local telephone provider, markets internet service on their website, this is not yet operational at EVP. Wi-Fi internet access is available at the EVP clubhouse. Contact an EVP Board member for the password. Cell Phone Access As of this printing, due to the remote canyon location of our community, EVP does not have cell phone coverage by any national carrier. However, many EVP residents now have internet access, and are able to use cell phones at their homes by means of a network extender that communicates with their router. If you have internet service, contact your cell phone provider to determine if you can set up local cell phone coverage. Cell phone coverage is available at the EVP clubhouse via a Verizon network extender.

Pets and Wildlife One reason people buy In East Verde Park Is their love of animals and the forest. This is a good location for both reasons. There is a history in the neighborhood of consideration and respect of others in dealing with both pets and wildlife.

Pets Everyone enjoys their pets. As a courtesy to all residents, please keep your pets on a leash at all times. Also be aware that excessive barking is often a nuisance to your neighbors. Please show consideration in controlling excessive barking by your pets. There is a leash law in Gila County for dogs. Fines are issued for dogs that are not under direct control by means of leash, chain, rope or enclosure of the owner or person responsible for the dog. Excessive barking and any incident of cruelty can also invoke a fine. The local County Health Department, located across the street from the Post Office can provide you with a copy of the county ordinance and Information on rabies. The Gila County animal control office number is 928-474-1210.

Wildlife Living in East Verde Park, wildlife becomes a part of your life. The experience can be very rewarding, such as bird watching, observing and photographing raccoons, rabbits, coyotes, javelina, deer, elk, herons, river otters, and, sometimes, skunks and mountain lions. However, you must be aware of precautions necessary so that you and your pets avoid getting hurt. Also be aware that wild animals sometimes get rabies. It is important to know the regulations set by the Arizona Game and Fish department. These regulations can be picked up at the Tonto National Forest office In Payson.

Game and Fish advises against feeding wildlife. This can lead to injury or death of pets and/or the wild animals.

Other Info and Stuff Roads and Speed Limits The roads in East Verde Park are public roads, maintained by Gila County. The posted speed limit is 25 mph. As all residents know, 25 is often too fast for the health and safety of the residents. The unpaved roads often create a tremendous amount of dust and often there are children playing in the yards and roads. Please use caution – slow down. Speeding and reckless driving is not necessary in the small confines of East Verde Park. Please report offenders to the Sheriffs Office (928-474-2208) and identify the vehicle as best you can. In case of an accident and/or possible injury, call 911. County maintenance of roads, and especially roadside drainage and culverts, has been a challenge, as county budgets are squeezed. Getting service often requires multiple calls to the county by several people. This is a case of “the squeaky wheel gets the grease”. Please help the Board in this regard. In addition to informing the Board of road maintenance issues, feel free to “squeak” to the county at 928-474-2553.

ATV Usage and Activities To operate an ATV on our public roads in East Verde Park, you must be at least 16 years of age, wear a helmet and have your vehicle licensed as street legal.
