COMMUNITY DEVELOPMENT DEPARTMENT RECOMMENDATION APPROVAL with conditions. STAFF RECOMMENDED CONDITONS Should the Planning Commission recommend approval of the rezoning request, the following conditions are recommended by the Community Development Department:  

1. The subject property shall be developed in general accordance with the site plan received by the Community Development Department on July 26, 2016. 2. The subject property shall be limited to a maximum of 155 multifamily dwelling units at a density of 45 dwelling units/acre. 3. The development shall occur in general accordance with the architectural elevations received by the Community Development Department on June 30, 2016. 4. The commercial floor area of the property shall be a minimum of 20,000 square feet. 5. Building height shall be limited to three stories (45 feet) along Caldwell Road and four stories (60 feet) along Dresden Drive and Parkside Drive. 6. Any portion of the parking deck visible from the public right-of-way shall be constructed to meet screening and materials requirements of the Brookhaven-Peachtree Overlay District. 7. Owner/developer shall provide at minimum twenty-five percent of the total acreage of the development property for a publicly accessible open space, conforming to the open space requirements of the Brookhaven-Peachtree Overlay District. 8. The common area/open space for the development shall be privately owned and maintained by a master association. 9. Owner/developer shall dedicate additional right-of-way along Dresden Drive along the property frontage to a distance of 40 feet as measured from the center of Dresden Drive or to the back of the sidewalk, whichever is greater. 10. Owner/developer shall dedicate additional right-of-way along Caldwell Road along the property frontage to a distance of 27.5 feet as measured from the center of Caldwell Road or to the back of the sidewalk, whichever is greater. 11. Owner/developer shall dedicate additional right-of-way along Parkside Drive along the property frontage to a distance of 27.5 feet as measured from the center of Parkside Drive or to the back of the sidewalk, whichever is greater. 12. Owner/developer shall dedicate additional right-of-way at the intersection of Parkside Drive and Dresden Drive to accommodate a mitering of the right-of-way. Miter shall consist of an arced miter with minimum radius of 20 feet or a straight miter with a minimum of 15 feet as measured along the right-of-way of the respective roads from the point of intersection of the rights-of-way. 13. Owner/developer shall widen and restripe Dresden Drive to a minimum roadway width of 40 feet from the edge of the on-street parking on the south side to the edge of asphalt/edge of on-street parking on the north side (43 feet from face of curb to face of curb) consisting of two 10-foot travel lanes, one 10-foot center turn lane, and two 5-foot bike lanes. 14. Owner/developer shall install new curb and gutter consisting of a minimum 18-inch gutter and 6-inch curb along the property frontage along Dresden Drive and Parkside Drive. 15. Owner/developer shall install/reconstruct granite curb with a 6-inch reveal as measured curb from the top of asphalt to the top of curb along the property frontage along Caldwell Road. 16. Owner/developer shall install a new sidewalk consisting of a 5-foot landscape zone and 10-foot sidewalk along the entire property frontage of Dresden Drive. 17. Owner/developer shall install a new sidewalk consisting of a 4-foot landscape zone and 6-foot sidewalk along the entire property frontage of Caldwell Road and Parkside Drive. 18. The subject property shall be limited to a single full access curb cut/driveway on Dresden Drive, a single right-out only curb cut/driveway on Caldwell Drive, and a single full access service drive (no parking deck access) along Parkside Drive. 19. Owner/developer shall install a raised island and improvements to curb radii and install necessary signage as approved by Public Works to limit traffic movements from Caldwell Road to Green Meadows Road to Right-In only (no left turns allowed). Full Leftout/Right-out access from Green Meadows to Caldwell Road shall be maintained. 20. No on-street parking shall be permitted on both sides of Caldwell Road or Parkside Drive for the entire frontage of the development. No-Parking signage as approved by Public Works shall be installed as part of the proposed development. 21. Owner/developer shall relocate/reconstruct the existing speed hump on Caldwell Road adjacent to the proposed right-out driveway. 22. Owner/developer shall inspect and replace as required by Public Works all storm drainage pipes and structures along the north side of Dresden Drive along the property frontage. The existing grate inlets in the travel way of Dresden Drive shall be reconstructed as approved by Public Works to eliminate any grates within the travel way and bike lanes of the road. 23. Owner/developer shall execute and submit all required petitions necessary to establish a Street Light District to facilitate the annual assessment of street light fees to the subject property. 24. Owner/developer shall comply with the Georgia Stormwater Management Manual (GSMM) Stormwater Runoff Quality Standard (water quality) by providing measures that treat the required water quality volume through transpiration, infiltration, and/or evaporation and be subject to review and approval of the Community Development Department. 25. Approval of a combination plat shall be required prior to the issuance of a land disturbance permit. 26. Utility cabinets or transformers shall not be located on any sidewalk, within the public open space, or within the public right-of-way. 27. Owner/developer shall record access easements allowing public access to all open spaces included in the “publicly accessible open space” requirement calculations. 28. Trash pickup, deliveries, and moving trucks shall be limited to the hours between 8:00am and 7:00pm. 29. All lighting associated with the development located outside the public right-of-way shall be designed and implemented to not allow light spillage to occur or cast upon adjacent properties.
