Globalisation and the Realisation of Human Rights: Legal, Political and Ethical Challenges
The course will cover the emerging and cutting-edge issues at the intersection of the existing human rights standards, both in the international and the national legal frames, and the contemporary developmental processes in the wake of globalisation. It will provide an overview of the institutional processes and frameworks and how these structures responded to (or failed to respond to) some of the critical challenges in actualising the human rights standards.
Modules (Proposed) a. ‘Protect, Respect and Realise’ Human Rights: The Politics of International and National Norms and the Institutional Mechanisms This module provides an overview of the law and politics of the international and national standard setting processes and the consequent institutional frameworks that emerged. b. How do human rights norms cope with social, economic and technological Change This module will present a perspective on changing contexts from a human rights perspective and their implications for the future of human rights. c. Realising core Social Rights: From Progressive Realisation to Violations approach, and then to an Eco-systems approach: the contours of a changing debate This module will survey the major currents arguments in realising social rights and the implications of their shifting contours.
d. Settled Norms and Unsettled World: new challenges to the protection of core civil and political rights This module will address the unprecedented crisis into which many settled standards of civil and political rights faced in the wake of recent rise of new security state, both at the domestic level as well as at the international level (wars on terror, religious fundamentalism, genocides etc).
