Case No.2014/17 11.04.18 Today, this Court is also working as Link MM of Ld. MM, Ms. Mahima Rai.   Present :

Petitioner in person alongwith Ld. Counsels, Sh. Debopriya Pal and

Sh. Kunal Kumar. It is stated by the Ld. Counsels for the petitioner that vide order dated 13.02.18,   this   court   allowed   the   petitioner   to   serve   the   summons   upon   the respondent no.1 namely Sunny Choudhary through whatsapp, text messages and e­mail. Ld. Counsels for the petitioner submit that respondent no.1 has been duly served through Whatsapp  and also through   Text  Message  on his  Mobile Number through the mobile number of the petitioner. They further submit that summons have also been served upon the respondent no.1 on the e­mail Id i.e. [email protected]  through   the   e­mail   Id   of   the   petitioner   i.e. [email protected]   Petitioner submits that the mobile number and e­mail (as mentioned in   the   affidavit),   on   which   respondent   no.1   has   been   served,   belongs   to   the respondent no.1. She has filed an affidavit of compliance in pursuant to the order dated 13.02.18 alongwith some documents on record. Submissions heard. Record perused. Perusal   of   copy   of   documents   which   are   filed   on   record   reveals “Double   Tick”   on   the   printout   of   the   Whatsapp   messages,   which   prima­facie shows that the copy of the summons has been delivered on the mobile number of the respondent no.1. However, none has appeared on behalf of the respondent no.1. At this stage, it is stated by the Ld. Counsel for the petitioner that the petitioner challenged the order dated 15.07.17 vide which only respondent no.1

was summoned and Ld. Counsel for all the respondents i.e. including respondent no.1 appeared before the Ld. Revisionist Court, therefore, respondent no.1 is very well aware about his summoning in the present matter. Today, no adverse order is being passed against the respondent, in the larger interest of justice.  Put up for further proceedings on 04.05.18.
