DEPARTMENT ORDER NO. 47-98 June 23, 1998 Pursuant to the recommendations of the Industry Development Council (Executive Order No. 380 s. 1996 as amended), the exigencies of the service, and in the interest of National Policy for Transparency with the a;ctive participation of the private sector to address current issues on import valuation, amendments are hereby promulgated under Customs Administrative Order (CAO) No. 2-96: 1. To introduce a new paragraph to be nominated as No. 4.1 under Sec. II ASCERTAINMENT AND PUBLICATION OF EXPORT VALUES, to read as follows: "The Customs Valuation Team created by the Commissioner composed of the Bureau of Customs and the Industry representatives formed under Memorandum of Understanding of March 7, 1997 with the Philippine Chamber of Commerce and Industry and the Federation of Philippine Industries shall be considered as the appropriate Private Sector Government body to propose review and make recommendations to the Commissioner on all proposed published values including protests on the applicability or accuracy or on petitions to review published vlaues. This special collegial body shall function in tandem with the special Customs Appeals Bodies created under Section 16.0 herein following and all findings shall likewise form part of the official recommendations to the Commissioner of Customs."
2.) To introduce a new paragraph to be nominated as No. 8.1 to read as follows: "That the Industry representative of the particular article which is the of the Appeals subject of appeal be accepted as interim member Committtees with equal opportunity as other regular members to express his view leading to a resolution limited to the specific article subject of the appeal." This Order shall take effect upon its publication in two newspapers of general circulation.
