My Life book 3 (by Tristan Bancks) Short Story Competition

! Terms and Conditions: !

1) Entrants aged under 18 years must obtain the consent of their parent or legal guardian to enter the promotion and provide personal information about themselves. All entries of entrants who are under the age of 18 years and who enter the promotion without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental or legal guardian consent (as and where required) will be deemed invalid. These Terms and Conditions will bind the entrants and any parent or legal guardian who gives their consent (for entrants aged under 18 years). Entry into this promotion is deemed acceptance of these Terms and Conditions by the legal guardian and entrant.

2) The promotion commences on Sunday 1 June 2014 at 9am EST and concludes on Friday 22 August 2014 at 11.59pm EST. One winner will receive a selection of Random House books worth up to $100 AUD plus four signed copies of My Life book 3. The winner may, at the sole discretion of the Promoter, also be offered the opportunity to have their short story published in Tristan Bancks’ next collection of short stories, which has the working title of My Life book 3.

3) The winner will be announced on Friday 19 September 2014 at 2pm EST at Random House Australia, Level 3, 100 Pacific Highway, North Sydney 2060. The winner will be posted on www.tristanbancks.com. 
 4) Should the winner decline to enter into an agreement to publish the story, or should their parent or guardian fail to guarantee the winner’s adherence to the agreement, by 15 October 2014 the Promoter reserves the right to withdraw the main prize and select a new winner. Please be aware that entering into this agreement will mean that you may be required to work with Random House editors and potentially edit or revise parts of your story and must be available to do so, if required, between 19 September 2014 and 15 December, 2014

Eligible entrants may enter an unlimited amount of times.


 6) Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request entrants produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm an entrant’s identity, age, residential or email address, eligibility to enter and claim a prize and any information submitted by the entrant in entering the promotion (including confirming consent of the entrant’s parent or legal guardian and the name, age and address of the parent or legal guardian that gave their consent where an Entrant is under 18 years of age), before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the entrant or entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that entry will be deemed invalid. All prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole

discretion.
 
 7) To submit an entry you must:
 (a) be aged between 10 and 14 years old on 22 August 2014
 (b) have your parent or legal guardian’s consent to enter. 
 8) Entrants from outside Australia are not eligible for the main publishing prize but are welcome to enter the promotion.
 
 9) The Promoter accepts no responsibility for lost, damaged or delayed entries or submissions, whether due to system error or otherwise. Proof of submission is not proof of the Promoter’s receipt of an entry or submission.
 
 10) Events may occur which render the awarding of a prize impossible due to reasons beyond the control of the Promoter and the Promoter may, at its absolute discretion, vary, amend or suspend the prize with or without notice. 
 
 11) Your entry must be originally created by you, must not infringe copyright or any other intellectual property right of any third party, be libellous or in any way contrary to law, must not defame or invade the personal privacy rights of any person or organisation or breach any regulation relating to data protection, or infringe any other legal rights, regulations or laws. You warrant that your entry and story complies with this clause. Please be aware that if you do not comply with this clause, it may mean that the Promoter cannot publish your story and will not be able award you the prize.
 
 12) As a condition of entering this promotion, the Entrant consents to, in the event that they are the winner of the promotion, the Promoter using the entrant’s name, town of residence, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products manufactured, distributed and/or supplied by the Promoter. 
 13) The prize-winner’s name will be available from 19 September 2014 on http:// www.tristanbancks.com/
 
 14) The promoter’s decision is final and no correspondence will be entered into in relation to the promotion. No cash alternative to the prizes will be available. 
 
 15) The Promoter will use your personal information only for the purposes set out in these terms. Your personal details will not be kept on file by the Promoter and will not be passed on to any other person or organisation.

16) The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.

17) The Promoter is not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

18) The Promoter, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law (including any applicable Consumer Guarantee under the Australian Consumer Law), for any direct or indirect injury, loss and/or damage arising in any way out of the promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; and/or (iv) acceptance and/or use of any prize. Applicable manufacturers and/or distributors should be contacted in regards to all prize warranty claims. 
 19) Any questions, comments or complaints regarding this promotion must be sent to the Promoter.
