THE FUNCTIONS LGA HAS BEEN BROKEN:
LOTTERIES AND OTHER GAMES [CAP. 438. 1 CHAPTER 438 LOTTERIES AND OTHER GAMES ACT To make provision for the regulation of lotteries and other games and gaming operations in Malta, for the setting up of a Lotteries and Gaming Authority, and for any other purposes connected therewith including the amendment and consolidation of existing laws relating there to. 2nd September, 2002; 16th February, 2004; 1st October, 2007 ACT XXIV of 2001, as amended by Act III of 2004; Legal Notices 426 of 2007 and 168 of 2008; and Act XXII of 2009. 11. The functions of the Authority shall be – a-m = functions of LGA Red text = broken rule or rules Green text = explanation why the rule or rules have been broken (a) to issue a National Lottery license and licenses to operate other games and to supervise the operation of licensees to ensure that licensees comply with the terms and conditions of their license and with the provisions of this Act and of regulations made under this Act and with any applicable directives issued by the Authority in terms of this Act or regulations made thereunder;
(a) Everlear Gaming Ltd has been holding illegal cash out limits 3000 euros per month, which it changed at unexpectedly. Even if the player would not have agreed the new T&C, it would have taken years for some players to withdraw their winnings from their player account. Example: Player balance 70 000 euros Withdraw rate 3000e/month 80 000 e : 3000 e/month = 23,7 months 26,7 months :12 months/year = 2,2 year That leads to situation when players money have not been paid in reasonable time frame as the Malta’s and EU’s gaming legislation demands. If player decides to play at Everleaf Gaming Ltd. with the changed rules and wins on the average 3000 euros per month, he will never get his winnings. LGA has been broken this function because situation has been explained for LGA with the Letter of Demand made by the layer at 26th of September 2012. (b) to issue permits to sellers of games forming part of the National Lottery in terms of article 36; (c) to inquire into the suitability of licensees and the main suppliers thereof, and to ensure that those involved in the operation, promotion or sale of authorised games operated by such licensees are fit and proper persons to carry out their functions relative to such games; (d) to ensure that licensees publish the rules of the authorised games operated by them in terms of their licence in such manner as may be deemed appropriate by the Authority; (d) Everleaf Gaming Ltd. has broken several rules of the License that LGA demands for the licensee. For example they have not paid the players’ winnings “precisely and accurate and in the reasonable time frame”, as it is designated in the Malta’s and EU’s gaming legislation. LGA has been informed about these violations for over one year. That means that LGA has broken function (d) pointed to the Authority. (e) to use all powers vested in it by this or any other law to ensure that games and gaming are kept free from criminal activity, and to prevent, detect and ensure the prosecution of any offence against this Act, other than an offence arising under any provision of Part VIII;
(e) LGA has been informed that tens of thousands of player’s funds has been stolen from player’s account and even one year after over 10 000 euros has not been returned to the player. The data of the fraud and the information of the unreturned money has been delivered to LGA several times by email, chat support and by phone. LGA has ignored the aggravating information so they have broken function (e). (f) to ensure that authorized games are operated and advertised fairly and in a responsible manner and in accordance with the law; (f) Everleaf Gaming Ltd. has been offering games which allow player to easily win much more than he is able to cash out in reasonable time frame which is demanded in the Malta’s and EU gaming legislation: “All the winnings must be paid precisely and in the reasonable time frame”. Look at the example at the section (a) LGA has ignored delivered information so they have been broken function (f). (g ) to regulate by licence the manufacture, assembly, repair, service, placing on the market, distribution, supply, sale, lease, transfer, making available for use, hosting and operation of relevant gaming devices, and to ensure that they are secure and satisfactory for the use for which they are intended; (g) Games are not safe and secure if customer are not able to cash out their winnings or if the cash out takes years. It is not either satisfactory when players are forced to wait their winnings for a year. LGA has ignored the complaints so they have broken the function (f). (h ) to supervise, attend and validate the draws of the National Lottery and of such other authorised games as it deems necessary; (i ) to receive and investigate complaints by consumers relating to games; (i) LGA has strongly neglected this by ignoring all the complaints for over a year and allowing Everleaf Gaming Ltd. to keep license without paying the winnings. This will be proven by hundreds of customers. LGA has broken the function (i). (j) to advise the Minister on new developments, needs and risks in gaming and to make such proposals as may be deemed necessary or expedient to respond thereto; (j) Given that LGA has not informed or made proposals for Minister to prevent the ongoing corruption and frauds, Minister has not got the realistic picture of the risks of
the reputation of Malta’s gaming industry to be in danger, LGA has broken the function (j). (k) to advise the Minister on the making of regulations; (l) to issue directives it is authorised to issue in terms of this Act or of any other law or of regulations made thereunder; (m) to perform any other function as may from time to time be assigned to it by this Act or any other law or by regulations made thereunder.
LGA HAS NEGLECTED ATLEAST 7 OUT OF THE TOTAL 15 FUNCTIONS APPOINTED TO AUTHORITY IN THE LOTTERIES AND OTHER GAMES ACT.
