For Release on Aug. 1, 2016 Contact: PJ Johnston, 415-923-8944, [email protected] STATEMENT FROM MISSION STREET DEVELOPMENT LLC (DEVELOPER OF MILLENNIUM TOWER): The statement released by Transbay Joint Powers Authority regarding 301 Mission Street today is misleading and self-serving, designed to distract the public from basic facts and sequences of events, and to absolve TJPA from its responsibilities. Some facts are quite straightforward. 301 Mission Street (“Millennium Tower”) was built before TJPA began its excavation and construction of its massive underground train tunnel project – which has been marked by TJPA’s massive cost-overruns. It is a fundamental tenet that any new building or underground construction must be constructed in a manner that does not negatively impact existing buildings. TJPA acknowledged that obligation in its own environmental and related studies, and in legal agreements. In fact, TJPA admits its responsibility on its own website: http://transbaycenter.org/uploads/2004/04/Updated-MITIGATION-MEASURESPRESENTED-AND-ANALYZED-IN-FINAL-EIS-EIR-AS-ADOPTED.pdf In section SG 1, it states: “TJPA shall monitor adjacent buildings for movement and, if movement is detected, take immediate action to control the movement. “ (Note that action is required regardless of the cause of the movement; TJPA is still required to take immediate action to control the movement.)

In section, SG 4, it states:

“TJPA shall underpin existing building, where deemed necessary, to protect existing structures from potential damage that could result from excessive ground movements during construction. Design the tunneling and excavation procedures (and construction sequence), and design of the temporary support system with the objective of controlling ground deformations within small enough levels to avoid damage to adjacent structures. Where the risk of damage to adjacent structures is too great, special measures will be implemented such as: (1) underpinning, (2) ground improvement, and/or (3) strengthening of existing structures to mitigate the risks.”

Contrary to what TJPA is now claiming, the measured settlement of 301 Mission St., at the time of its opening in 2009, was well within the range of the revised settlement expectations that were determined by the building’s engineers and reviewed by the City.

Prior to the commencement of adjacent excavation by TJPA, the settlement had slowed and was anticipated to stop within the predicted range. As soon as TJPA began its excavation, however, the settlement accelerated. Every step of the way, the developer of 301 Mission St. (Mission Street Development LLC), informed TJPA of the soil conditions, estimated settlement and related issues – and TJPA acknowledged its responsibility to “immediately control movement,” as described in its EIR. Despite this awareness, and assurances that it would suspend construction on its project if any impacts arose – no matter what was the cause – TJPA continued to push ahead with its underground work until completion. With 301 Mission St. fully approved, built and occupied by 2013, TJPA not only continued to push ahead with its work, even as concerns about soil settlement were being identified, it unilaterally changed its project design, apparently exacerbating settlement issues. Also, contrary to TJPA’s assertions now, a decade later, 301 Mission St. was never designed, expected, advised or required to drill pilings “200 feet down to bedrock.” In fact, 301 Mission St. was built to the highest standards for the location, met all city requirements, and achieved all approvals. 301 Mission St., like virtually all other large buildings in that part of the city, has its foundations in layers of geological materials within the “Colma Formation,” just like 350 Mission, the Marriott, the Meridian, the St. Regis, the Intercontinental, SFMOMA, even 101 California … and dozens of others. The difference at 301 Mission: It exists in a location where TJPA’s massive underground construction work was subsequently performed, by an agency that was obligated to monitor and protect existing structures, and to mitigate any impacts of its work. 301 Mission has settled more than originally anticipated because it was affected by this subsequent construction. TJPA can try to rewrite history all it wants – but that won’t change the fact that it had, and has, a clear obligation to stop and mitigate all impacts of its project, whether or not there was disagreement over the extent or even the cause of the problem. There’s no doubt it’s been a rough few years for TJPA. Now that the agency appears to be pulling itself together, organizationally, it’s unfortunate that it would take such an irresponsible path in this matter. TJPA has, and always has had, an obligation to protect the existing buildings around it, and to protect the hundreds of people who live in 301 Mission St.
