International Economic Law in 2018: Between Reform and Contestation At the Conference of the European Society of International Law taking place in Manchester, Great Britain, the ESIL International Economic Law Interest Group, chaired by Peter-Tobias Stoll, Elisa Baroncini, Holger Hestermeyer, Catharine Titi, and Marina Trunck-Fedorova will convene a full day workshop, which will take place on 12 September (afternoon) and 13 September (morning) 2018. Two panels and one roundtable will be organized, which will deal with 1) 2) 3)

Electronic Commerce. Cyberspace & International Economic Law (panel) Reform of Investment Dispute Settlement and Developments in EU Investment Law (panel) The Multilateral Trading System in Trouble (roundtable)

For the two panels and the roundtable of the workshop the ESIL IEL IG invites papers, which should be unpublished, in an advanced stage of completion, and ready to be included in the ESIL SSRN Conference Paper Series and in the ESIL Conference Proceedings. If published, the ESIL IELIG may authorize authors to present a related paper at the ESIL IELIG Workshop. The working languages of the ESIL IELIG are English and French, and thus the proposals may be submitted in English or French (see below for the paper submission procedure and timeline).

Panel 1: Electronic Commerce, Cyberspace & International Economic Law Cyberspace rapidly develops and forms part of our all days life, as electronic commerce, the advancement of social media and the internet of things may illustrate. Obviously, the 1

economic dimension of these developments is crucial. For long time, international economic law has been charged with details of these developments: with intellectual property, services, tariffs and with the many detailed issues of the WTO’s work programme on electronic commerce. Now, that recent events raise issues like national security and privacy and have called legislators into action, fresh thought is needed to reconcile emerging human rights and privacy standards, security needs and the principles of an open and non-discrimatory world economy.

Panel 2: Reform of Investment Dispute Settlement and Developments in EU Investment Law Panel 2 will focus on two topics that have recently dominated debates on international investment law, at least in the European Union, as follows. First, we encourage submissions on reform of investment dispute settlement. This includes the European Union’s proposal for an investment court system (ICS), negotiations on a multilateral investment court (MIC), and the ongoing work of UNCITRAL’s Working Group III on reform of investment dispute settlement. Second, we welcome submissions analysing recent developments in the European Union involving intra-EU BITs, investment dispute settlement and the position of the Court of Justice of the European Union (CJEU). Preference will be given to analytical, rather than descriptive, pieces. Roundtable: The Multilateral Trading System in Trouble The proposed Roundtable aims at providing a most complete overview and full discussion and exchange of views of the highly significant issues which have been emerging as major challenges of the international trade system. Therefore, scholars and practitioners are invited to submit papers on the WTO Appellate Body composition crisis, the WTO case-law, also in comparison with the reports expressed in the RTAs' dispute settlement mechanisms, DSU and WTO reviews, the constantly rising tension on tariffs escalations between the United States and China, security issues within the WTO system, and the status of negotiations, conclusion and implementation of mega-regionals, also with specific reference to sustainability issues.

PAPER SUBMISSION PROCEDURE Submissions are welcome from senior and junior scholars. Abstracts must not exceed 800 words, and have to be submitted to the following mail addresses: [email protected]; [email protected]; [email protected]; [email protected]; [email protected] In addition to the abstract, each submission should contain a separate file containing information on: • The topic of the call for papers for which the abstract is submitted; • The author’s name and affiliation; • A short (one page) author’s CV, including a list of relevant publications; • The author’s contact details, including email address and phone number; • Whether the author is an ESIL member and the date of affiliation. TIMELINE The deadline for the submission of abstracts is midnight 23 May 2018 (CET). 2

Successful applicants will be informed by 15 June 2018. The deadline for the submission of the papers of accepted abstracts is 1 August 2018. The Workshop will take place in Manchester on Wednesday 12 September 2018 (afternoon) and Thursday 13 September 2018 (morning). The deadline for the submission of final papers for publication is 1 November 2018.
