VENDOR AGREEMENT (must be signed or application will not be accepted) The undersigned agrees to exercise the utmost care in the use of facilities and properties of the Chelmsford Farm & Garden, Inc – DBA Chelmsford Agway. The vendor also agrees to indemnify and save harmless the Chelmsford Farm & Garden, Inc, its officers, employees and agents from any and all claims, actions, judgments, losses, costs (including reasonable attorney fees) and damages whatsoever, including accident, injury, or death caused to persons or property of any kind, arising out of, in connection with, or incident to, the Chelmsford Farmers Market. Should a vendor at any time occupy the premises in a manner contrary to the rules of the Chelmsford Farmers Market (see attached rules), or in any manner that is hazardous or offensive to the public or vendors, upon request of Chelmsford Agway, vendor shall immediately cease such offending conduct. Failure to immediately conform its conduct as requested shall be cause to revoke this agreement and the vendor permit. Upon failure to so vacate, the Market is authorized to remove all property of vendor from the premises at vendor’s expense. Chelmsford Farm & Garden, Inc. is relieved and discharged from any and all loss or damage occasioned by such removal. Chelmsford Farm & Garden, Inc will not be responsible for storage or safekeeping of property so removed.

Chelmsford Agway Farmers Market 2016/2017 Rules Handbook MARKET RULES A. PRODUCTS Chelmsford Agway reserves the right to: Prohibit any vendor from selling a particular product in the market Vendors must submit a complete list of products that they wish to sell at the time they make application to the market. All products must be approved by Chelmsford Agway prior to being sold. B. PRICES & SIGNAGE Prices must be clearly marked or posted for customers. Pricing is at the complete discretion of each vendor. C. BAKERY & PREPARED FOODS *IMPORTANT* Vendors of Prepared Foods are required to obtain a permit from the Chelmsford Board of Health at an annual charge of $35.00 for vendors who are not currently licensed in Chelmsford. If you are participating in the Chelmsford Summer Farmers Market your certificate will be in effect for one year from the issue date. IF YOU ARE A VENDOR OF PREPARED FOODS YOU MUST CONTACT THE CHELMSFORD BOARD OF HEALTH DEPARTMENT AT 978-250-5241. If you do not have a permit – you will not be allowed to sell at the market! D. FEES Vendor participation fee is $25.00 per week per booth space. Checks should be made payable to “Chelmsford Agway”. Board of Health permit fees, if applicable, must be paid directly to the Chelmsford Board of Health. Any dates requested, but not paid for by October 15, 2016, will be forfeited. Once the market begins, any cancellations by the vendor are NON-REFUNDABLE. E. INSURANCE Vendors may be required to provide a Certificate of Product Liability Insurance listing Chelmsford Agway as an additional insured. F. VENDOR EQUIPMENT AND SUPPLIES Every vendor is responsible for providing their own tables, chairs and displays each week - and removing any and all equipment and supplies at the end of the market each week from the Chelmsford Agway Farmers Market. G. SIGNAGE Each vendor must prominently display a sign identifying the name of their farm or business. All signs must remain within the allotted vendor’s exhibit space and must not block pedestrian traffic or interfere with other vendors’ display or views. H. BOOTH LOCATION Chelmsford Agway has full authority to assign exhibit space. Requests for particular sites will be given consideration, and reserves the right to assign and locate all vendors. A floor layout is provided each week – it is REQUIRED that you set up in your assigned space. Specific booth location is not guaranteed for each week of participation, due to the fact that we allow week to week participation and vendors fluctuate throughout the season. I. HOURS OF OPERATION The Farmers Market shall operate every Saturday from 10:00 am – 2:00 pm. The first week of operation will be November 5, 2016 and will run through February 25, 2017.

J. SET-UP, CLEAN-UP AND BREAKDOWN Set-up starts at 8:45am and must be completed by 9:45am. Vendors are responsible for keeping their area clean during the market day. If a vendor sells out of their goods before closing time at 2:00, it is expected that they maintain a presence at their booth as a courtesy to the other vendors. Vendors are responsible for removing their own refuse and unsold product from the market premises.. Stall spaces are to be left in the same condition as when they arrived. Please note that Chelmsford Agway employees are not available to assist in either set-up or breakdown.

K. VENDOR UNLOADING AND PARKING From 8:45am – 9:45am we ask that vendors unload as quickly as possible and then BEHIND THE AGWAY GREENHOUSE OR ACROSS THE STREET AT THE BYAM ELEMENTARY SCHOOL. We need to keep all store front parking spaces available for customers! L. INCLEMENT WEATHER Vendors may call Chelmsford Agway at 978-256-9991 concerning market closure due to inclement weather. M. CONTROLLED SUBSTANCES No vendor shall smoke tobacco, drink alcohol, and/or possess or use any controlled substance while at the Chelmsford Agway Farmers Market. N. SALES TAX Vendors are responsible for collecting and remitting their own sales tax O. ENFORCEMENT All rules of the market will be enforced by Chelmsford Agway employees. Possible violations will be discussed and a resolution will be attempted. Vendors selling prohibited items will be asked to remove those items from sale. Continued violations will result in expulsion from the market with no reimbursement of fees paid. P. MARKET RULE CHANGES Chelmsford Agway reserves the right to modify the rules of the Market as circumstances warrant. Q. ATTENDANCE You must notify the market manager by 9:00AM on the Thursday before the market if you are unable to participate. We send out our emails on Thursdays and want to ensure that customers know who will be attending. There will be no reimbursement of fees for absences.
