Office of Barber and Cosmetology Licensure ADVISORY COMMITTEE MEETING MINUTES November 10, 2014 1560 Broadway, Conference Room 110A Denver, Colorado THIS MEETING OF THE ADVISORY COMMITTEE WAS PUBLICLY NOTICED ACCORDING TO THE DIVISION OF PROFESSIONS AND OCCUPATIONS POLICY 80-17 I.

CONVENE

The regularly scheduled advisory committee meeting of the Office of Barber & Cosmetology Licensure was called to order by Ofelia Duran, Program Director, at 10:04 a.m. ADVISORY COMMITTEE MEMBERS PRESENT:

PUBLIC COMMENT: A member of public was introduced by Ofelia Duran given her interest in serving on the advisory committee. This member introduced herself and provided comment on her interest in serving.

REPORTS: STAFF UPDATES: Diane Blea informed the committee that she will be retiring, effective December 31, 2014. A. PROGRAM DIRECTOR REPORT : Ms. Duran informed the committee that endorsement applications for the five Barber/Cosmetology license types will be available online on November 20, 2014. Paper applications will be distributed in very limited situations.

Ms. Duran also provided the committee with the State of Colorado and DORA’s new branding logo. B. EXAMINATION VENDOR UPDATE Ms. Wingate shared current examination result status reports and vendor accomplishments. Modifications to the current examination are underway and the updated exams are scheduled to go live on July 1, 2015. C. REVIEW OF OUTREACH AND EDUCATION UPDATE Outreach activities that have taken place since the last Advisory Committee meeting were shared with the committee. D. NEWS Articles provided to the committee in the agenda packet were reviewed. The discussion focused on the health grade article, whereas each shop/salon would receive a letter grade based on inspection results. The committee briefly the importance of parental consent and consultation of an adult for Salons and with salon owners in determining the decisions of whether or not to provide services involving children and minors. E. STATE OF WASHINGTON NEWS AND NACCAS ACTIONS The committee reviewed this information and took no action. IV.

NEW BUSINESS A. 2014 SUNSET REPORT The barber/Cosmetology Sunset Report was published on October 15, 2014. Each recommendation provided in the report are listed below (Each recommendation was discussed and no action was taken): 1. 2. 3. 4. 5.

Continue the Barber and Cosmetology Act and the Barber and Cosmetology Advisory Committee for 11 years, until 2026, and repeal the separate sunset provision for the committee. Clarify that places of business must register with the director and the director may take disciplinary action against registrants. Exempt practitioners of natural hair braiding form the Act. Articulate the minimum length of training programs in contact hours, rather than credit hours. Establish as a grounds for discipline failure to disclose within 45 days of a conviction pf any felony, or other crimes related to the practice of barber, cosmetologist, esthetician, hairstylist, or manicurist. Establish as grounds for discipline aiding and abetting unlicensed practice.

Revise section 12-8-132 (1)(b), C.R.S. to address fraudulently attempting to obtain a license. Establish as grounds for discipline failure to respond to a complaint. Add language clarifying that licensees may not treat diseases or ailments. Clarify the language regarding exemptions from the Act. Revise section 12-8-108(2)(a), C.R.S., to reduce the number of times that the advisory committee must meet from four times to at least once a year. Require licensees who have had their licenses revoked, or who have surrendered their licenses in lieu disciplinary action, to wait two years to reapply. Authorize the director to transmit letters of admonition to licensees by means other than certified mail. Make technical changes to the Act.

Ellen Graham reviewed the bill drafting process with the committee and this chart demonstrates the process: Discuss draft recommendations Senate review Committee hearing Draft a Bill Governor’s desk for signature Bill becomes a law “An Act” Ellen Graham explained the nuances with the state legislature and the Department of Regulatory Agencies (DORA). The committee was reminded to keep in mind their positions, statements, and personal views when discussing this legislation. B. NIC BULLETIN The committee discussed the NIC Presidential elections for 2014 and took no action. C. 2014 NIC ANNUAL CONFERENCE HIGHLIHGTS Megan Ripko discussed the presentations that she thought were of interest to the advisory committee, specifically one that outlined the history of the Vietnamese community in the manicuring field. Other presentations from the conference covered deregulation, updated infection control standards, regulatory reform and unintended consequences as a result of regulation. V.
